    Hi, im sorry but I wont be of much help to you. What I failed to realize was that the criminal record disclosure only applied to the green card holder. So it didnt apply to us anyway. Good luck though!

  2. The IRS's security system prior to this idme was not much better. Around 3 years ago I tried logging into my IRS account to make a change to my payment plan. I discovered a new security protocol and I had to go through many steps to ID myself. Problem is unless you fit into this neat box that the computer thinks we all live in then some of us can't be identified. For instance the program wanted a credit card #. Don't have those. The program wanted a home mortgage #. Don't have that. Program wanted student loan #. Don't have that. And so on......  I began at least somewhat to realize how people who are discriminated against feel. 

    So now I'm locked out of my account and rather than waiting hours to talk to some ya-hoo on the phone I send letters which have a current turn around time of around 9 months. 

  3. Hi all,  so we are ready to send off our I-751 package and question has occurred to me, when it comes to the evidence of relationship, USCIS does just want new material, evidence, that pertains to the last 2 years right?

    USCIS site says they want full arrest report but the timing is not as clear as it was in the original AOS. I could, but would just as soon not include the mountain of criminal activity paperwork from 44 years ago that I have already submitted.

  4. Hello, I'm just wondering if anyone else has tried to use the re started San Francisco Consulate reservation system for passport interviews.

    They started back up again on the 3rd with a new site format that doesn't appear to be working. Ive emailed them numerous times but its like talking to a brick.

Hi all, my LPR bride and I were going to try and update her passport on our trip to the Philippines in April but flight through Korea was cancelled and now its looking like getting in and out of Manila, not so good. My question is does anyone have any advise on how to renew her passport from the states..... online?

    So for domestic travel she can use her green card as ID  and travel under her married name. For international travel, she has to use her maiden name.

     

    Airline policy on fixing this can vary. For a trip to Florida from here in CA where I'd gotten too far ahead of things and got tickets in Anastasia's married name before she had any ID in that name, Southwest changed the name on the ticket for free (we had a copy of our marriage certificate with us). But others in other circumstances have had to pay change fees or get new tickets.

    Thanks, yes I can certainly see the point of using her new documents for domestic travel. She has annual trips to the Philippines planned though and this business of using a passport and travel documents with the wrong name is just unsettling.

    Im thinking maybe the solution is to apply for new passport in correct name on next trip to Philippines.

    There is no law requiring a SSN for health care.........You might have to go up the chain of command, but they should add you if you qualify.....

     

    I have had some experience with insurance companies and my immigrant wife. My auto insurance company insisted that my state, Washington, had a law that said all people in the household over 17 had to be listed on the policy as drivers. This was before my wife had her green card so of course she couldn't drive. I explained the circumstances to the company but not only did the insist on listing her but they also raised my rates. I sent an e mail to my state insurance commissioner mentioning the name of the insurance company and immediately the commissioners office sent an inquiry to the company. In a couple of weeks I got a letter from the company basically 2 stepping their way out of what they had done and saying they were refunding my premium. It pays to go to the top!

     

     

    Also, as to the business of immigrants having health insurance, my wife just had her AOS interview 3 weeks ago and it was very casual. We were very prepared EXCEPT for the very close examination of her health insurance. She had her insurance card with her of course but the interviewer wanted very detailed info about when it was purchased, how it was paid, how long the policy was for. This all had to shown with paper documents. 

    I don't know if this is a reflection of new pressure by USCIS or what?

  8. Hi all, this is probably pretty obvious to most of you but after getting screwed up once by not having the correct name on an airline reservation and then having to purchace new tickets I want to make sure I get it right before I get to the airport this time.

    My filippina bride has changed her last name to mine as is now on all her documents including green card, marriage certificate, SSC, etc. It has been said on some chat groups that she should get her tickets under her maiden name and pass through the airport as such. Of course her PH passport is still under her maiden name. There is always going to be a conflict one way or the other...…. please advise.

    My experience with my local SS office has taught me that they are ill equipped to deal with immigration related SS issues. Our first visit we went in with the attitude of blind faith just as we had with the Consulate, Biometrics, USIS office etc. I was actually quite shocked to find out that i knew more about what was going on with my wifes process than the lady sitting across the counter from me. This lady was quite intimidating and had i not been there my shy and very non confrontational wife would have just assumed she was correct.
    Couples need to go to the SS office armed with all the information necessary to state their case and stick to their guns.
     
    Our first brush with the SS people was actually a little comical. I really didnt do any research into what it was going to take for the SS process other than reading about it here on VJ. It seemed pretty cut and dry to me.
    We got married in April 2018, 45 days after we arrived back here in US. Right away we went into SS with all the right paperwork to get a card with new name. This was a successful process after a little arm twisting.
    Not knowing much about anything beyond this point, i was talking with a person waiting for the same thing and they said that when my wife got this card it would be a temp card and when she got her work authorization we would need to go back in for the permanent card........ ha ha little did i know. 
    So along comes work authorization and off we go to SS office. The lady at the counter asks me what im doing there? Here for new card. Then this lady launches into this long dialog about how she doesnt get a new card yet ( of course ) but then goes on to question me as to why we were waiting to work in the first place. She insists that the K1 Visa guarantees her the right to work immediately upon entering the US.???????    hmmmmmm

    When we attended the interview we thought we were leaving all of our "devices" in our room. I was unaware of a short cell adapter cord that was still in my brief case. They found it in the search inside and so....... Yes to your question there is an area with shelves in the search area where they put your confiscated items till your departure. There are guards in this area but they are busy so i wouldn't trust it with a nice cell phone. It would be easy for a thief to walk by and grab a couple of phones.

    No.        I didnt get any answers from VJ. I did get some responses elsewhere but everyone just says they left it blank. I went ahead and sent it in with it blank.

    I did notice on the VJ forms example for I-485 that it was left blank. I have a feeling that if i was supposed to put in the original WAC # then its really no big deal that i didnt. They have that information.  If on the other hand they are looking for a filing # from a previous I-485 filing then that doesn't apply to me and i should indeed have left it blank.

  12. Hi all,   we just today went and applied for my immigrant wife's ss card. We followed the suggested procedure here on VJ which was all correct except that the interviewer also required an original of her birth certificate and our marriage licence.

    Interviewer only wanted to look at these documents and made copies from them then gave them back.

    I just though this was worth noting that its worth taking originals or certified copies when you go.

  13. I would like to ask if we can start to file a k1 visa. Even my fiance still has on going issues with his ex wife. Which includes family decree and he has been arrrsted for a false police report. If we file now and support documents later. Do you think it may cause delays. Or is there any other way to make the process shorten or how could it be.

    As someone who was specifically most worried about those very 2 subjects, I can say go ahead and file. Who knows what goes through the mind of the people judging us who have police records during processing. All you can, and what you absolutely have to do is be 100% honest on the I-129. The old I-129, prior to this years, was very specific to certain crimes only and even though applicants still had to include any arrest records, It definitely made it look like they were looking for specific types of offenders. At any rate a false police report (filing one?) seems pretty benign to me and isnt the type of thing that rates high on the radar.

     

    And yes you'll have lots of time to work out the the details of support, providing you have a loose idea anyway.

    Yes, that is a difference. Although i doubt if it will matter. I may not have been clear in my original statement......happens often :huh: 

    After all the trouble we went through to compile this information, the interviewer didnt even ask for any of it. Just asked Have you worked in any other country? to which my fiance answered yes, Ive worked in Kuwait and UAE. She was looking right at the I-129 when she was asking this so she already had the details. 

    That was the end of the discussion about the subject so we didnt need the paperwork we brought with us. Which is not to say you wouldn't with a different interviewer. Who knows, I always like to be overly prepared.

     

    The best place to start as far as documents goes is the USIS site . They have to believe that, right?

    Other than that i just googled my countries of interest attaching police reports to the subject and looked through the results.

     

    We even contacted the UAE embassy here in manila who basically told us the same thins we had already found out on line.

    I cant remember what the issue was with Kuwait embassy, maybe there isnt one?

    The attorney is right that the Philippines will not recognize a foreign divorce unless you go through the Philippines court system (long and expensive).

    They would request the CENOMAR for the K-1 visa. The visa applicant would present the CEMAR (showing the marriage) along with the divorce decree (showing the dissolution of the marriage under US law). USEM follows US law, not Philippine law regarding the ability to remarry. A number of others on VJ have done this exact process successfully.

    Yes, the "system" is set up to prevent you from doing just this very thing. I dont know how you did it but by following "normal" procedures one cant proceed to the medical until you have scheduled for interview and you cant schedule an interview without a confirmation letter/e mail from NVC then the manila embassy sends YOU an e mail saying you are free to schedule a interview.

    Yes you can re book your interview date.

    Have patience my friend. :)

     

    There is a web site you can go to and sign up on, we did, to track NVC timing. it seems right now they are around 38 days

    If she were to interview in Manila for whatever reason, they would request a CENOMAR/CEMAR, but then you would show the divorce decree at the interview to show that the past marriage was dissolved under US law.

     

    Note that the past petition with a scammer that came to the US may raise scrutiny of your case.

    Not that i am an attorney, but according to my attorney....... the Philippines does not recognize the divorce in any other county of one of its citizens. Annulments or whatever need to be accomplished in the PH and a clear CENOMAR has to be presented for K Visa.

    Hello Hank, as a follow up, i wanted to let you know what was happening. 

    I figured out, finally, how to get the CEAC site to work!!!!  Of course it was with the help of my very lovely and persistent fiance who kept insisting she is a immigrant and why dont i put immigrant in the first box???? :P

    I have tried explaining to her that she is not considered an immigrant until after she gets to USA and receives green card and right now is considered in non-immigrant VISA status.

    Soooooooooo after all my preaching to her it turns out that the screwed up wheels of the CEAC system have it so that she has to enter herself as a immigrant in order to proceed with entering her MNL#

    Ironically, then when the window displays your status it says NON IMMIGRANT VISA ............. whatever???????????

    Visa was issued yesterday. that makes it 3 days. Seems to be the norm for the manila area right now, 3-5 days.

     

    By the way, our dashboard is still blank. dont know whats up with that?

  19. Yes it is a great experience to go along with your fiance. I would highly recommend it!

    I went due to several special circumstances that pertained to our case that if the interviewer asked my fiance about i wanted to be sure to follow up with correct paperwork for her. Such as my shady background, we are using real estate for support, etc. Of course after months of preparation and a computer bag full of documents (less the laptop of course) the interviewer didnt even bring any of these subjects up! And HEY, im NOT complaining. :P

     

    Secondly, she wanted me to go with her. To calm her nerves mostly. She keeps insisting her english is not good. She was worried that when nervous she would lapse into Tagalog. She actually speaks very good english as i am constantly telling her. Im so proud her. She speaks my language so well and here i can barely mumble out a couple words of hers.

    As you all know, there is the option for a translator. This option was being used by others as we were there.
