    I would guess he's exempt from the fact that he's self employed and not making enough money in US standards. They're well-off but unfortunately wages in the PH are low, and it's normal in Philippine culture to live with your parents until you marry, and so that is how he gets by fine.

    He does have a US passport. 

     

    Regarding the IRS, I believe he's exempt considering his domicile is PH and not US, if anything he would just need to catch up on filing those "exempt" claims. His brother moved from the Philippines to the US a few years ago with no problems. But he married his wife there so it seemed to be easier than getting a fiance visa like we are now.

    No, unfortunately. He obtained his citizenship from his father, which explains why he is a dual citizen. We plan to marry in the US and start our life together there.

     

    His brother currently lives in California, but recently just beat cancer and has been out of work for quite a while due to it. We're not sure if we can rely on him for joint sponsor because he has a household of 3 already.

    I was wondering if anyone would know how to go about I-134. My fiance is a dual citizen (US and PH) but has lived in the Philippines all his life. From what I understand, in a case like this, his income doesn't count as the affidavit of support needs to come from someone who resides in the US. Is the only way really to find a joint sponsor? How do we go about this?

    Yesterday we received an RFE and I'm seeking advice on what evidence to mail back.  My fiance is from the Philippines, but she lives and works in Singapore.  I traveled to Singapore in November to visit her.  The RFE states that I have proven that I traveled to Singapore, but I didn't prove that I was with my fiance there.  The evidence I mailed initially was 15 pictures of my fiance and I together, hotel receipt, passport stamps, boarding passes, receipts of attractions we visited with pictures, an email to the hotel stating that my fiance was checking in for us and their response.  I see that the evidence does prove that I was there and the pictures show we were together, but how do I prove that we were together in Singapore in November?  I'm not sure what other evidence to send back.  I can send more pictures of us together, but that doesn't prove a date and location.  We are each going to write a statement that we were together too.  We are also going to show evidence that she lives there (permanent residency documents) and a letter from her employer that she works there.  If anyone has any other suggestions for evidence, I would appreciate it.

    Hey Jon, really sorry to hear about this. Not sure what the officer wants from you, but I've got a few ideas on how you can get even more detailed about proof of you being in Singapore with your Fiance in November:

     

    1. Did you or your fiance by any chance upload your photos onto Facebook to share with friends and family? Usually, you can include a location when you do this. Maybe this is something you were able to do back in November. If not, the date of when it was uploaded on Facebook is still proof you were there on said dates. 

     

    2. The photos you took, were they on an iPhone or Android smartphone? If so, majority of the time, gadgets nowadays are able to include location of where the photos were taken. This can also be proof... I've attached a photo below to show you how it can be proof.

     

    3. If you don't have location services on, you can still check the "EXIF data" for each photo, this data includes the date, time your photos were taken. You could probably print this alongside the photos as proof. 

     

    In regards to number 2, my iPhone automatically records where my photos are taken, I've attached an example below of how my iPhone does this... It even detected we were above Russia on our way from the PH to Europe last December -- and to think during that time I had no cell service or data on my phone, yet it knew where we were when I took photos inside the plane. Creepy, but quite useful for times like this!!

  6. So two things:

     

    1. Are we the only ones who didn't submit proof of financial status/support with our petition? It wasn't included in the list of requirements, yet I see people talking about that on here. I do, however, see that requirement for when we apply for the visa itself. Im just a little confused, and worried, that we missed that requirement with the petition and will end up with an RFE.

     

    2. I just checked the Case Status Checker on the USCIS website and it's currently down, apparently they're doing maintenance and HOPEFULLY they're finally going to fix it, or at least update the damn thing at the least.

    We've got the same received date! Still no approval. The person above me has gotten theirs approved so I'm hopeful we'll get ours soon!!! 

     

    I received my NOA1 in snail mail around March 11. It took that long because my fiance is a US citizen living here in Manila. Hopefully the NOA2 has been approved and just taking forever to get to us in the mail, apparently no emails are being sent out, unlike with the NOA1. Quite annoying. Haha

  8. Hi everyone! Just another Feb filer who's been lurking the forums but finally decided to create an account to join in the conversation.

     

    I just want to thank everyone on here who has been so positive and supportive, it's nice to know that my fiance and I dont have to be alone in this journey! I check back on this fourm almost daily and I cant wait until everyone starts getting approved. My fiance (currently with me in the PH) and I are a bit worried of the delays in approval because we're hoping to fly out to NYC by August and get settled there -- but fingers crossed and praying daily :)
