    After a bit of craziness, we re-filed the I-130 application for my wife through DCF at the London embassy/USCIS. The package arrived through UPS 2 weeks ago but neither myself or our lawyer has received any notification yet. As a cashiers check was sent from our lawyer, the lawyer cannot see if the cheque was cashed as the funds are withdrawn immediately.

     

    What should I do? Is this normal? How do I contact the embassy?

    Took mine a month for approval of the petition. You need to be a bit more patient as its a time consuming process. Relax.

    Get notarised affidavits from where ever you will be living as well as family members confirming your return. Make sure to include photocopy of the persons ID

    told my husband what an amazing day it would be if we got our daughter and a visa approved on the same day lol

    That is the generic status for London from before and even after an interview. It means you're back to normal. It will most likely change to AP briefly, then finally to Issued. 

    Thank you so much for your insight. I definitely thought it was just the generic status as we've been told several times another interview wouldn't be needed. 

    You've put my mind at ease about not having to make another trip up to London as we are hoping to go into labour tonight!!❤️❤️❤️

  5. So his status has just been switched from "refused" (from the first medical) to "ready". Under the status is a statement about procedures for scheduling an interview at the embassy HOWEVER he has already had his interview back in March at which he was told after the second medical he wouldn't need to come back for a second interview as well as when they requested the passport it was in bold that he need not return for a second interview. I'm thinking the statement below the changed status might just be something that automatically comes up? Anyone have any ideas?

    The status hasn't changed yet, I think they wait until the visa is issued in the passport so I'm hoping we might know by next week. The consular officer told my husband that everything else checked out at the time of his interview and that they would just like him to undergo a new medical so we had to wait until the first expired. His second medical went so well as he has made some major lifestyle changes so fingers crossed we get word it's been approved!

    Just out of curiosity, can you state the date of first medical, interview, second medical, passport request.

    So date of his first medical was sometime in February, interview was in March, second medical was September 1st and the passport was requested on September 7th. 

    We are expecting our first child due on Wednesday so I am very excited at the thought that we might have an approval before her arrival, what a wonderful treat that would be!!

  8. So I would like to update our case.

    During my husband's interview at the embassy he was given back his passport, along with a blue slip stating that he needed to undergo a new medical exam when his current one expires. This was having to due with a past DUI. It has been six months and he has gotten a favourable medical exam that was sent to the embassy. They have just contacted us asking only for his passport. What could this mean?

    No one else was injured he did however take a turn too quickly and had an accident. It was his only DUI but in his first medical back in February he still would drink on the weekends and I think they saw that as alcohol dependancy so he was asked to undergo another exam after that one expired. He has since then completely stopped drinking and we are hoping that is the result they were looking for. It's just not part of his life anymore with our baby due any day now and I've never really been a drinker

    I think this is more due to the DUI and not the drinking. If his last drink was March of this year then that is a non issue at the medical. Alcohol only stays in your system for up to 4 days after intake or 80 hours. Its actually called the 80 hours test.

    So I wonder now what the real issue is? 

    I think because having had a DUI in the past and continually drinking on the weekends they saw it as an alcohol dependency which I am hoping we have corrected in their eyes by completely staying away from it.

  11. So my husband had his first medical exam in February and the outcome was not favourable because he said he still occasionally drinks and he has a DUI on his record from 9 years ago. 

    When he went to his embassy interview the consular officer said unfortunately he couldn't approve the visa that day due to the medical exam and asked him to undergo a new one after the previous expires.

    Since then my husband has not drank alcohol and we are hoping we have done everything we can for a better outcome. His last drink was in March after our announcement of being pregnant with our first child. Alcohol is not a part of our life anymore so my question is have we done all we could to improve our outcome? If there was no way to improve it wouldn't they have just denied the visa and not told him about a second exam?

    His next exam is next Friday so I'm just a bit anxious now.

    Yeah that's what it seems like which I understand where they are coming from. We just feel so lucky to have an opportunity to provide a better result with this exam. Fingers crossed as I would love to raise my baby with my family around.

    It's because of his DUI from 9 years ago. They can also test your blood to see how hard your liver is working due to excess alcohol consumption that's why we figure it be best to just stop completely, especially with a little one on the way

He can't go and re-do the medical and lie to change the answers so that he is approved. Not that I'm suggesting he would but if he goes back and does the medical all over again under the same circumstances and the same tests the result will be the same, surely? If I were you, I'd want to know that was "wrong" with the first medical and why a new medical will change the outcome if your husband's situation has not changed. 

    He needed to completely quit drinking because they saw still having drinks on the weekend as too much of an opportunity for the same thing to happen so even tho he is barely a drinker he has completely stopped and will be taking another exam in September 

  15. UPDATE! I've sent an email to the embassy for further information and apparently we do not need to reapply. They said that my husband just needs a new medical exam from Knightsbridge when the current one expires and when they receive the new one they will review his application. I've never really heard of this before but we are so pleased and looking forward to a better outcome!

    It sounds like the doctor may have said he was an alcohol abuser, since he still consumed alcohol after having gotten a DUI.  There are some panel physicians who strictly interpret it that way.  I, too, would suggest a first step would be to e-mail the Embassy and seek clarification on  what he was told was the next step, i.e., what the officer said about a new medical and when he could do that.  It might give you a better picture on how to proceed.

    Anyway unless you find a way to get this done fast, look might need to look the next 1-2 years in the future, that you might still be in the UK.

    I greatly appreciate your help and advice. I think I may need to bite the bullet and get a lawyer's help. I guess for now I'll contact one and concentrate on my little one on the way. Trying to find the positives at least the baby will have dual nationality if born here and nhs is a god send. I know people have worse circumstances and living conditions so I should just be grateful for health and try again in a bit. Just wish I had my mom with me through this new chapter of becoming a mother myself.

    Did you try calling the doctors office and ask? Usually the medical exam results are your property and all doctors always gave my wife a full copy after the exam. This way we always knew what the CO would see in his hands.

    I haven't tried that but will!!! I wanna go home so bad but I need my family together he's just doing it for my sake. I need to find a way to get a successful approval. We are good people he just had one hard year 8 years ago 😔
