I would definitely consider speaking to an immigration attorney about this.  While you know of course that your fiance had no intention of committing fraud and staying when she entered, the fact is that if she is on a tourist visa, she has a k-1 visa on the go, that could be a serious problem for USCIS.  An immigration attorney will likely be able to tell you how they are ruling on this particular issue right now.  All of us that have gone through the immigration process know that there isn't a lot of logic with how immigration works. Yes, there is a pandemic and circumstances change, but immigration may not take that into consideration.  It really depends on what the policy from the Trump Administration is telling them.  Going by how much he is trying to keep people out, I wouldn't be risking it since it would be a permanent bar for her if they said there was immigration intent.

    I'm arriving in the US in two days. So glad for it all to be finally over. Looking forward to seeing my fancy green card soon.

    NVC finally told us our new interview date of July 11th.

    I'm constantly paranoid that there may be another "system/booking error"..... so still calling them every other day to confirm/follow up.

    I had a question for you. After you received the email for the appointment letter, did you get any other emails following that one? If so, what was the timeline for that? And also, when did your ceac status change from "At NVC" to "Ready"? 

     

    I'm headed to Austin. I can just imagine your paranoia. Totally sucks what happened to you. 

     

    Yes, I got a letter from the consulate to say they'd received my file. It came a few days after your interview was cancelled so when I first saw the email I instantly thought the worst. I can't recall how long it took for it to say 'ready' but around the time I received the email from the consulate. If your status has changed to at least in transit you should be fine. That's the first status change once your interview is booked. 

     

    And the the consulate will ask you to email them to reconfirm your interview. It's all in the email they send.

    However, they rejected my Police certificate from South Korea because it is 4 MONTHS old. I didn't even doubt my police certificate that was issued "ONLY" 4 months ago would be expired already. (I haven't lived there more than 7 years now.)  They requested a current police certificate. Sigh.  

     

    Yet, I heard it only takes from a few hours to a day for them to re-review it once I upload it, if I'm not mistaken... right.?

     

     

    That's crazy about the police certificate. If you're not living in a country any more they're not supposed to have an expiry. Even if it did, most are valid for a year.

    The only weird thing is that my fee payments were rejected for apparently no reason. I called the NVC and they said it was no big deal and to pay when my husband goes for his interview, so i'm just wondering if this has happened to anyone else? 

     

     

    I would really check with your consulate about paying there. Everything is supposed to be paid prior and you take the proof of receipts with you. I wouldn't rely on the NVC giving correct information because they get it wrong all the time.

    We never received notification of the original interview date. Has anyone else had something like this happen?

    Yes, this happened to another Aussie recently who had their interview scheduled for 6 June. From members it was booked around 5 May and they had received the interview letter and had done the medical too. 

     

    I guess on the bright side you didn't know you had an interview  to start with. It seems this new system is causing all sorts of problems with booking appointments because it's happened to a few people from consulates who now upload documents to the CEAC website.

    We were unfortunate enough find out this week that our interview was cancelled and in line to be rescheduled due to some system error! :crying:

    The NVC said that there was no issues with our case, it is still case complete, but there was a booking error and had to be cancelled.

    Our flights/hotels were booked for June 6th and medical examination done too! ughh... so disappointing.

    Does anyone know what can be done in this situation?

    Have you still not heard anything about a new date - or hopefully the same date they originally scheduled?

    It's been a while since i've looked into this.. But I did some search again after posting.... Says in France that we can get all of our vaccines up to date before the exam.. But the X-ray and blood tests need to be done by the "embassy "approved" physician and/or facility" Can go the Medical Exam the day before interview, and everything will be ready.. 

     

    That sounds about right.  I didn't have any vaccination records so did a blood test for MMR and Varicella by my GP and took the results. I was missing immunity to one, so my GP gave me that.   My work has someone who comes in and does flu shots so had one of those done recently.   Also required tetanus, which I had done at the medical.  After almost 15 years of no vaccinations my poor body:(

    I'm pretty sure that would open a can of worms for people using unreliable doctors and potentially having someone else do the tests for them if they didn't want something to show up.  There is a list on each countries pre-interview checklist who you can use.  It has to be them, they have all the necessary paperwork and can send the results directly to the Consulate.  I chose to collect mine, didn't want to take the chance of it going missing.

    The website date just means they have touched a case for that date.  It doesn't unfortunately mean they have completed all of them, or that they are up to everyone for that date.  It seems to be so random. 

     

    Nebraska is the main service centre, hence why they receive the most and why they are the slowest.  Don't ask me how they determine which ones to send to other SC's.

    The amount of people on this website is so tiny in comparison to the actual real numbers of people who apply for visas.  I didn't think they were really processing K3 visas much these days, they seem to make people switch to the IR1. This could also be why it's taking so long. Or, there could be no explanation and just a bit of bad luck😔  Hang in there.

    I don't think that's quite correct.  Unless it has changed, 90 days prior to being in the country for 2 years you have to go through another process and they then review your case before they change it to IR1.  That means still keeping evidence of your relationship etc. 

     

    Edit:

    Oops, I think you may have been referring to when you have been married for 2 years during the NVC process.  For that I don't know so just ignore me:)

    My interview was Nov 29 ... Visa was issued and in transit 2nd of December ... I received it 5th of December ... I flew SYD to LAX on the 6th of December ...

     

    Butttt I had a very stressful 5th of Dec - when the courier company literally had NO CLUE where my package was - for around 5 hours. 

    Seems TOLL don't make calls to Depots - they communicate by EMAIL ... Hours went by before they tracked it and I'd almost pulled out all my hair....You had 1 job, Toll :rolleyes::jest: 

    Suffice to say, they finally found it and I drove myself to the Depot to collect it, didn't trust them to deliver. lol. 

    Oh man. How stressful. My interview is 6 June and I fly 24 June. I'm thinking surely I'll have my passport in hand by then. They express post it which is a little scary. I don't particularly trust Australia Post but what can you do!?

    You should call the NVC to ask. If going by past months, you could expect to find out at the end of this month when your interview is. They often don't email you the letter until a week or so after it's been booked so most of us call every few days to check.

    Also, thanks for the update with Sonic Plus! We booked our appointment and you were right, they didn't require the appointment letter. Strangely or maybe just a coincidence, after I posted the issue about the interview appointment letter, got the email around 5pm yesterday. (what a relief!)

     

    That's great about the appointment.  They even told me I could bring Australian size passport photos.  I said, I paid good money for American size ones as per the instructions so they'll be getting those;)

     

    I still haven't received my interview letter but I think it takes quite a few days.

    Did they actually ask to see any more evidence when you were at the interview?  The Australian consulate doesn't request that you bring evidence but I have copies of what I used for the I-130 and put a stack of cards and photos in an envelope just in case.
