I was planning on writing a statement explaining why we hadn't filed, that we have an extension and we were planning on bringing 2019s tax return to the interview. Then providing 2018, 2017, and 2016s returns with I-864. Would that work?

She has pay stubs yes.
What are tax transcripts? are they available if 2019s taxes haven't been filed yet?

For form I-864, my wife does't have the most recent tax return, we have an extension for filing 2019s taxes as I don't have a SSN yet. She does have 2018, 2017 and 2016 though. What should we do? Thanks

Thanks for the replies guys. Much appreciated. The dreaded feeling has slightly subsided, I have a feeling I'll be working on this new form for a solid tow weeks. I really wish I had applied a year ago when it didn't exist lol.

I've been married to my US citizen now for about 3 years, I'm from the UK and entered on K-1, and now applying for AOS, cost and other factors have delayed the process.
I'm presuming I have to file this new I-944 form?
However I'm a bit confused over everything being asked for. The whole point of applying for a Green Card is so you can work legally, yet it wants all kinds of work related info, income, tax, (don't even have a SSN yet) as that's par to the AOS process lol. Even credit score, none of these I have, my spouse earns good money which again I'm presuming will come into play with the afidavid of support form. It seems like a catch 22, I can[t provide income, assets, credit score etc, when I can't legally work.
Any advice would be appreciated.

Thanks for your reply, the SSN now comes with or very shortly after the EAD card, about two weeks after. So i'd be looking at it arriving in about 4 months or so. The ITIN takes about 10 weeks to process, and I'm concerned it's going to cause great confusion having an ITIN and SSN on file. For the sake of a few months, I think I'll just wait for my SSN to arrive and file an extension for taxes, giving us 6 months.

Yes I do need an ITIN or SSN to file jointly, that's mainly my question to anyone really. With a tax extension I have about 6 months for my SSN via my EAD to arrive, so hopefully that will be enough time to then file our taxes.

Hi Everyone
I entered on a K-1 and married within 90 days, that was over 3 years ago. I'm just in the process of preparing my AOS and EAD.
My question is, we're about to file a joint tax return, which are ready to e-file. and obviously I need either a ITIN or SSN before we can submit our taxes, the ITIN seems overly complicated, as declarations and other nonsense have to be attached to file jointly. Should I just file for my EAD and SSN right away instead and file a tax extension if need be? or still go through with an ITIN which may take almost as long and possibly cause more confusion.
Any advice would be appreciated.

Thanks, it does states on the USCIS website though, even with advance parole they can deny you based on overstay of 180. I'd advise anyone to apply for AOS prior to those 180 days of illegal stay to reduce any issues like that.

True, but they've have no grounds to deny you entry if done within 180 days, or with a valid green card.

Ok thanks. Having said that, it does state if you've accrued more than 180 of illegal stay and travel even with advance parole you can be denied entry. So I'd probably rather just wait for my AOS to be granted, and not even take the risk travelling with advance parole, so filing it seems pointless.

I have read that if 180 days has passed you can't file form I-131 for advance parole, is that correct?

Hi guys
I arrived in the states last August, and was married within the 90 days on a k-1 visa. Is there a time limit on when I should file my AOS? I would have done it a while ago, but as always it's just the cost holding me back.
Any advice would be appreciated.

No I havne't sent in the forms yet for my AOS, that's what I'm saying and didn't want to rush the remaining forms to meet a deadline of Friday for when my medical expires.

Yeah the one year since my medical expires on Friday, so I'd rather not rush it and just get a new one done.

Thanks for your reply. My medical is getting close to expiring anyway so it's probably best I just get another complete exam done and just get them to transcribe the vaccines I've had done at the same time.

I'm in the process of applying for AOS and my vaccinations are up to date, however on my DS-3025, MMR and Influenza were missing, and they told me during the medical to get these done by my local GP so my vaccinations are up to date, which I did. Do I just include the letter from my GP showing my medical history which lists the up to date vaccinations along with my DS-3025?
Any help would be appreciated.

Thanks, that seems to relate to if you didn't earn enough though for that tax year, not if you have an extension filed/awaiting SSN in order to file. Which the green card gives me, bit of a catch 22. I'm assuming a statement explaining will be enough.
