  1. Hello, 

    My husband finally received his employment authorization June 2nd, 2018. We went on June 4th to apply for a social security. We had teied that before but they wouldn’t let us apply because he was on a K-1 Visa which expired when we attempted to apply. With the employment authorization card, he was able to apply for a ssn, but I wanted to know how long it took y’all to receive the social security card.

    I got my hopes up the other night...I got a text message notification saying my status on a case was updated. I do not know which number is associated to what,but I have had my EAD/AP since December...So I thought it was my interview finally being scheduled (been ready to schedule since end of october)...Well no after almost 5 months they just updated my EAD status to say it had been delivered...REALLY?!

    Man that Sucks. I know how you feel cuz I’ve been waiting as well. After multiple calls and service requests, we received an RFE. We called a week after they received it what they requested and they told us to wait for a month and call Back. We finally received a notification yesterday sayd EAD is being produced. It took 8 months. Couldn’t be happier! Good luck and keep us updated. 

  3. Hello everyone!

    On Sept 29, 2017, we've filled for an Adjustment of Status after entering on a K1 visa. After 195 days of waiting they've sent us an RFE letter with those bullet points:

     

    • The "Sponsor's Household Size" on the petitioner/sponsor's form I-864, Affidavit of Support (revision date 07/02/2015), was calculated incorrectly or not completed. A household size of 0 or 1 is not acceptable. The petitioner/sponsor must correct and/or complete and return Page 4 of Form I-864.

     

    • Based on the documents submitted with Form I-864, Affidavit of Support, for the joint sponsor, the income did not meet the 125% of the poverty guideline for the joint sponsor household size. Submit evidence of assets that meet the standards listed below or obtain a different joint sponsor.

    If you decide to obtain a joint sponsor they will need:

    • File Form I-864, Affidavit of Support (revision date 07/02/2015)
    • Provide copies of their most recent Federal income tax returns
    • Provide copies of all supporting tax documents (W-2's, 1099's, Form 2555 and tax schedules)
    • Provide evidence of their status as a United States citizens, United States National, or Lawful Permanent Resident.

     

    Although it's pretty clear what they're asking for, I still have some questions (we can never be too sure)

    1- When initially filling the form i-864,  the joint sponsor used his then recent, 2016 income as "Individual Annual Income". The question is: Can my joint sponsor use his 2017 Tax returns Information or simply goes with the prior one?

     

    2- The form I-864 has been updated since then. The current version on the uscis website is dated 03/06/2018. That means the 07/02/2015 has been expired and no longer available for download. Should we ignore the fact that they are specifically asking for the 07/02/2015 and just go for the new one?

     

    3- The joint sponsor agrees to combine his household income in order the meet the 125% poverty guideline, which he didn't do when he was first filling the form. Isn't it safer to just resubmit the whole form I-864 (with the new revision date) and not just the page 4 asked? Since this change will also have an impact on other pages of the form?

     

    I know it's a lot to ask and my questions are kinda confusing, but we've been waiting for so long, I really want to do my best to get everything right. If anyone has experienced this situation or has an idea please let me know.

    I wish my husband could at least get and answer as to what’s going on with his I-765. We’ve been waiting for 163 days with 4 services requests without any responses.

  5. I’ve had 4 service requests with absolutely no answers. They received my husband application since September 29th 2017, he did his biometric on october 23rd 2017, but we have received nothing. We’ve been calling and they can’t give us an answer, and the service requests created are not getting any responses. They keep transferring us to higher lever of customer service (officers and senior officers), but even them cannot tell us anything. I am tired

    I have filed I-765, an EAD card upon graduation (OPT). It is my 2nd time filing it. I'm positive that I haven't made any mistake on it.

    And I'm a JULY filer, why haven't I heard anything from them?

     

    Obviously my case is out of normal processing time, the customer service of USCIS says there is nothing they can do about it. They just want us to wait. 

    We have spoken to a tier 2 representative, he says their process can take more than 75 days legally. 

    USCIS can't provide any updates on the 2 service requests. The last person we spoke on the phone, says my case has not been assigned to an officer yet. That was it. 

     

    I'm furious over something that I can't control and I really want the EAD card to be able to work. 

     

    Should we contact a senator, does it really help?

     

    Has anyone been going through out of normal processing time for I-765 over 100+ days? 

     

     

    I am in the same situation as you. We sent our application on sept 2017. We had the biometric appointment in oct. We haven't nothing since. it's been 164 days. We have called multiple times and have had about 3 requests with no answer. We talked to two officer which transferred us to senior officers. They just tell us that it is a rare and unexplainable thing that the office is not responding to the request. So we're just sitting there waiting and checking.

    Hi, I see that your EAD package was sent a day after mine was received and you had your biometric appointment 3 days after I had mine. Have you heard anything from them since the biometric appointment? I have been calling non stop because ours is out of the time frame but we haven't really gotten any answers. We have talked to multiple USCIS agents, even officers, they all keep saying they send request but never got any response. They said that's rare and hard to understand because the office is not responding. We've just been waiting and don't know what else to do.

    For CSPA consideration, they will subtract the number of days between when the I-130 was approved and the I-130's PD from her current age. So unless the I-130 took over a year for approval, I would be inclined to believe she aged out from the F2A preference to the F2B preference.

     

    Immigrant visas for LPRs (as well as certain relatives of USCs) are considered under the family preference category of visas. These are limited to x amount per year. As such, they set aside different rules to determine who needs a visa most to least. Spouses and unmarried minor (under 21) children come before adult children, married children (USCs only), or siblings (USCs only). That's where the whole idea of a PD comes into play...you need to wait in line until an immigrant visa number becomes available.

     

    When a child of an LPR turns 21, they no longer fit into the F2A preference so they have are put into the F2B preference and have to wait in that line (the time spent in F2A effectively remains...it doesn't reset or anything like that). The Child Status Protection Act (CSPA) lets an LPR petitioner subtract the amount of time that their petition was not adjudicated from the beneficiary's age to determine their CSPA-adjusted age.

    Her receipt date was on March 2, 2016, and the priority date was March 1st, 2016. Her approval date was April (end of April). She turned 22 in August of 2017

    She just turned 22. The I-130 was approved in April 2016 and she has been waiting since then. I do not see a priority date on her notice of action. What is the F2B? I thought her age could be a problem too. What is the F2B?

    I never stated that the entire country (Haiti) was given TPS. Also I do not have any problems given out information. Lord!

    The petitioner must have already filed an I-130 for her and the PD must be after the Dates for Filing chart as noted on the USCIS AOS chart (see F2A): https://www.uscis.gov/visabulletininfo

    Note that this changes monthly....it could change to the Final Action Dates chart, which is usually later.

    Yes, her mother has already filed the I-130 for her. They received a notice of action a year and 7 months ago saying that it was approved and sent to the NVC. But they haven't heard anything since.
