    The time depends on the processing time of your local office. Go to the USCIS processing times page and look up your local office. Currently most offices take anywhere from 6-12 months.

    Did your ex withdraw his affidavit of support from your old petition? If yes, then your EAD filed with that petition becomes invalid. 

     

    If you filed I-485 with your I-360, then you can file I-765 (EAD) under category C9 and you will get it within approx. 90 days. 

     

    If you only filed I-360, then you have to file I-765 under category C31 and your VAWA needs to be approved before they can issue you EAD, which means though you won't be able to work for like 10 months.

    As of June 30th, they were adjudicating August 15th petitions. Considering that two months have passed since then, it can be assumed they are adjudicating October petitions now. However, processing times should be updated within the next few weeks.

    Definitely do not lie. Explain exactly what happened and why you didn't go to a shelter (because you fled to your home country, etc.).

    You should be able to get your divorce decree from the Superior Court where you filed for divorce. Should not be a problem to obtain this. 

     

    Attend at least 5-7 therapy/counseling sessions and have a psychological evaluation written for you at the end. In VAWA Part 8 Sandra explained what needs to be in this, so just read through the entire thread. 

     

    If you were in a shelter, contact the shelter and they can give you documents of your stay. If you were not in a shelter, write down why not. 

     

    If you do not have police records or a restraining order, write down a detailed explanation why not and that should be okay.

    I would wait until your AOS is through and you have your GC in your hands.

    I field  I-360 oct 2015, was approved in Nov 2016

    I field separately for AOS on February 2017.

     

    On USCIS vawa section web cite  show watting time frame for I-360 but not for I-485 AOS.

     

     

    how long is the watting time after filling I-485?

     

    If I sent my I-485 to Vermont office, Is the case process at vermont office or local office (I live in Los Angeles)

     

    What does vermont do with My AOS I-485 after receiving are they transfering my case somewhere?

    Vermont sends it to the National Benefis Center and they send it to your local office who adjudicates it, so for processing times look at your local office I-485 processing times.

    Looking at current processing times on the USCIS website, it takes about 319 days at the moment. Calculate Notice Date (not receipt date!) + 319 days to get an estimate. Of course processing times can change, so this is not accurate but just an estimate.

    Processing times used to be around 90 days (similar to EAD) but when looking at current processing times on the USCIS website, it spans 200 days, so I am just wondering if this is really true or if anyone here has gotten their AP approved faster than that recently.

    Oh okay, understood! You can inquire about that and they should give you information over the phone since your previous I-485 is not VAWA-based. Did your ex maybe withdraw his affidavit of support? Do the documents go to his address maybe?

    You can't expedite I-360. If you are in the US, you can apply to expedite I-765, I-131 and I-485 but it is rare that they grant this. When you are outside of the US, I believe you cannot expedite any of the paperwork.

    The VAWA processing times are currently around 9-10 months, so count your notice date plus processing times. See what semester that puts you at and try to apply again for that time. I am sure a full scholarship is a good enough reason to get your I-485 expedited at that point. 

    I would suggest for you to just earn money or start earning credits in the country you currently live in, so that you save money and can then get your credits certified/translated into the college credits that are being used here. VAWA takes time and patience, so make the best out of the waiting time you have to pass.

    You can't file for a student visa (F-1), which is a non-immigrant visa, while you have a petition for an immigrant visa/GC going as the two contradict each other. It will be impossible for you to prove that you have no intent to immigrate.

    You can't file for VAWA when you already have a GC. You should file I-751 as you said above. VAWA is a way for victims to file for their GC without their spouses needing to submit a petition for them.
