To anyone’s knowledge, if I have been issued a temporary I-551 with an expiry of May 5, 2019, can I visit the US as a visitor between now and then without jeopardizing that? I intend on immigrating in April, however was hoping to visit my spouse once more between now and then. I just don’t know if I cross the border with that, if they will allow me to cross as a visitor and not as a PR. Thanks!

332 day later and we finally get some news!!
Our case was finally approved (priority date Jan 15) and sent to the Department of State. Got notification via email this afternoon! Hard copy of NOA2 hasn't come in the mail yet so I cannot update my timeline quite yet.
Sweet jesus that was quite the wait, but it does come! Now the easy part!!

A good friend told me that, once they where already living in the US, an attorney in NY told her why they didn't apply for a change of status from a tourist visa during one of the frequents visits that the husband had to do during the process??
His husband (Italian) was going and coming several times to Europe, passing 3 months every time and then returning a couple of weeks with friends. Accordingly with this attorney, it was possible that, once she (who is the american citizen) was already working in the states, the husband could enter the country as a tourist, and then apply for a change of status, so he can remain with the family, and the process seems to relatively easier and shorter.

Yes, I've heard of this. But it is very difficult to pull off. You have to prove with the change of status that there was no intent to come into the country as a tourist only to do a change of status. They obviously want you to go through the I-130 channel of immigrating. If they were to find out that you came in as a tourist with intentions to change status by means of marriage, there could be serious consequences. The likes of which I personally don't feel are worth it.

I am confused.It's implying that your I-130 should have been approved already. I doubt that it is given current processing times for all servicing centers, but it wouldn't hurt to give the USCIS a call and see what's going on

Hello all,
My goal in establishing this thread is to create a place where all Nebraska I-130 filers can come together to get an idea as to where the processing dates are. Obviously the USCIS website is less than reliable for providing those dates so we are kind of relying on each other. I am a January 2017 filer so I wont be receiving acceptance anytime soon unfortunately. But by hearing from other applicants about their NOA2 dates, we can all get an idea as to where the USCIS is more efficiently.

Hey PAK123,
I have been down in the states for the past 5 years with a student visa, living with my now husband. Two years ago I obtained my ITIN number when I submitted my request for one with his tax return. You can opt for the certified copy of the passport, the only reason I didn't was because I needed it to fly back to Canada for a visit and it took an additional 2-3 weeks to get the certified copy with my passport being sent. So I sent in my original passport. That being said, everything went smoothly. They used it, and sent it back in a timely manner. So whatever works best for you, but I believe all I needed was my passport for the ITIN application. Nothing else.
Fortunately we were able to file jointly this year and got quite the nice return as a result. Definitely worth doing!!!

For January filers? Not for a few months yet. Depends what service center you were sent to. We were sent to Nebraska and am not expecting to get an approval for another 4 months yet.

So in preparation for the NVC I have almost all the documents together. But I was wondering if we can just send in a regular photocopy of our passport or if I need to get a certified copy from the government. What's my fellow Canadian doing for this? Can anyone else shed some light on this??

Welcome to the club fellow Canadian lol, I got sent to Nebraska too. Glad to hear you got your NOA1! Unfortunately Nebraska is one of the slower processing centers according to processing times. Looks like USCIS will not get around to processing ours till the end of July! Hoping its sooner though!!

Did anyone use a lawyer or go through an agency to file their i-130? We did it ourselves and totally front loaded our case... Fingers crossed!
We did ours on our own as well! When we looked at how much a lawyer would cost beginning to end it was $1000's! Definitely not an option for us lol. But there is so much material and samples out there (all of which I utilized
) that I feel pretty confident in our submission! We added a few additions of evidence proving a bona fide marriage too.

Has anyone notice that estimated processing times for the IR1/CR1 on a day by day basis can go back and forth? I check this site religiously because USCIS hasn't updated their processing times since November 30. One day it can show processing dates for the NVC for July 25, and then the next day they are on July 22. How can this be lol?!

No the text/email date isn't the priority date. The priority date will be shown on the I-797 you will get in the mail

Hello all!
We submitted our I-130 12/27/16
We got out NOA1 via text 1/11/17 with a priority date of 1/3/17
Our application got sent of to the Nebraska Service Center, which annoys me because it appears as they are one of the slower ones lol.
We don't expect to get our NOA2 till about the middle of July.
Hoping it gets approved sooner! Does anyone else have quicker processing times by estimation?

For documents such as birth certificate, marriage certificate, and police certificate, can I just photocopy the documents and send in those or do they need the originals?

To shorten the time that me and my spouse would have to be apart, we are considering for a K-3 visa. We have already received the NOA1 from the USCIS for our I-130 so we could properly file for it. My only question is, if and when I get approved for the K-3 and am granted entry into the US, what happens to the I-130 application. Does it still approved and go through the NVC for processing? Could I wait for permanent residence via that as opposed to adjusting my status once I'm in the US with my K-3? It seems to be much easier and cheaper if that could be the case.
Any light shed on the issue would be great! I'm mainly curious as to what happens to the I-130 application after a K-3 is issued.

I still only have the temporary 6 month stamp in my VISA. I have yet to cross the border and immigrate with that 6 month stamp. I was wondering if I can visit the US with that in there without jeopardizing it when I intend on moving in April
