  1. My child is a legal permanent resident. His last name was changed and I'd like to file form I-90 on his behalf online (he is 12 years old), in order to get his name changed on his Green Card. Can I create a USCIS account online for him? I had already created an online for myself, but I am not sure how to proceed when it comes to creating an account on a minor child's behalf. Can anybody walk me through it step by step please? Any help would be greatly appreciated. Thank you in advance.

    Hope you are all OK!

     

    So, I applied for my N-400 on September 12, 2020. I received my receipt notice (and number) within a week.

    7 months (approximately) have passed so far and I haven't gotten a biometrics appointment, or a notice indicating the reuse of my previous biometrics (which were provided in the US in 2017).

    Is this normal?! I see others who applied after me and already got their interview date! Is there a way to get in touch with a human being at the USCIS Office/customer service line?

    For reference, I submitted my application online, my Green Card is marriage-based (I checked and I am eligible for citizenship) and my local office is located in Tampa, Florida.

    Any input will be much appreciated. Thank you!

    I'm definitely bringing that along, but won't the difference in names on his green card / court order be an issue. Also, I was thinking of filing form I-90 on his behalf immediately to update the name on his green card, but that'd mean I'd have to wait 8-10 months for the new GC to arrive in the mail. Also, if I file I-90 I will HAVE to send in his current original GC. So, if I show up with no GC for him at all (which would be in USCIS's possession in that case), it might complicate matters even more. What would you suggest:

    OPTION A: refrain from updating the GC and go with his current GC that reflects his old last name + bring court order along

    OPTION B: File I-90 and bring proof of filing + his foreign passport + immigration visa + copy of GC + court order

     

    Please let me know what seems to be less problematic. Keeping in mind that USCIS requires immigrants to update their GCs once a change in name occurs. Also there may be a gap of about 6 months between the issuance of the adoption court order and me actually obtaining my own naturalization certificate (which would be the basis of this whole process).

    Anyone knows what exactly are the documents needed to bring to the post office to issue a minor child's US passport? 

     

    Please note the following:

    1. The child is a legal permanent resident already residing in the US 

    2. The child's passport will be based on the naturalization of an LPR mother.

    3. The child has been adopted by a US citizen step-parent.

    4. The child's name has been changed (through a court order) due to adoption by a US citizen step-parent.

    5. The child's Green Card, passport, admission visa and foreign birth certificate ALL show the child's PREVIOUS last name (which as changed by a court order). The child's social security card, dependent ID card, as well as the court order show the child's NEW last name. The child's FIRST name has NOT been changed. The Mother's name remains consistent on all the documents.

    6. The child has been in the legal and physical custody of the LPR mother since birth

     

    If anybody has an idea about this very particular situation, please let me know.

  6. Anyone knows how long it takes for the passport to be sent back after the visa had been issued?

     

    My visa was issued on Thursday the 14th and I got my passport on Tuesday the 19th (given that Friday and Saturday were a weekend). However, my son's passport wasn't in the same envelope and Aramex said they didn't receive it yet. His visa was issued on the 18th. 

     

    I heard the Embassy sends the passports out the day following the issuance of the visa. Is this correct? It has been in my case.

     

    I am just worried that something happened to his passport or that it got misplaced at any stage. It's been almost 3 days since the visa had been issued for him and yet no sign of his passport at Aramex.

     

    I'm seriously worried. Anybody have ideas?

    That is not correct. They do verify things like that (in terms of where the spouse has been actually/physically living). A house (owned or rented on its own) is not sufficient proof of domicile. A USC can indeed maintain domicile in the US while living abroad - even if he/she does not own/rent a residence (house/apartment) inside the US. 

     

    You probably had different circumstances when filing for your visa, but mine were/are similar to the poster here, this is why I commented in the first place. Each case is different. Have a good day.

  8. Hello everyone,

     

    I am freaking out. We had our interview yesterday and I was approved along with my minor son.

     

    When I checked CEAC today it showed my case as Admin Processing and my son's as (ready for interview). It didn't matter much as I know that everybody goes through AP even if for a couple of days/weeks.

     

    Also, today I got a call from the consulate asking me to go in again next week. 

     

    They kept both passports and gave us an approval notice during yesterday's interview.

     

    Should I be worried about returning next week? They said it was for fingerprints but we've already gotten that done at both Windows. What could be the problem?

    I have a quick question, do we have to notarise the letter that shows intent to return / re-establish domicile in the US prior to submitting it to the NVC or not?

     

    My husband is a USC and he has been living with me in Egypt on a temporary basis. He kept his US bank accounts, US-registered company and everything operating as normal back home. What should we do to prove / demonstrate domicile. Our attorney says we should notarise the letter of intent but I did not see anyone else doing so. Please advise. Thank you.

    Well from the moment you get your scan date (which is when you submit your IV & AOS supporting documents; and NVC receives them into their database), you have up to 8 weeks for the review of your case (8 weeks is the standard review time). It may or may not take longer. I believe NVC is trying to catch up and become current with their processing.

    I've been doing a lot of reading on the subject.

    So far, we submitted the payment and now our receipts say the payment status is (paid).

     

    Our choice of agent is our attorney, but it seems they are really busy, so I'm thinking about filling out the online forms + AOS myself to save some time.

     

    I have a few questions though :

    - the petitions are for myself and my child (the petitioner's stepson). Do we file 2 AOS (one per each applicant) or just 1 that includes us both?

    -if we haven't filed 2016 taxes yet, do we use 2015? Or do we file the taxes for this year and then submit the related transcripts?

    -our attorney wants us to notarize a letter stating my husband is currently living in Egypt with me but his domicile is the US. Does this letter really need to be notarized? The first available embassy appointment is in 3 weeks, that'll cost us a lot of time

    I really hope you are right. My husband has a solid background in politics and he said the same thing too. But then again he's always been the optimistic partner throughout our relationship.

    I didn't make a contact with the customer service. I was also worry like you. 

     

    I hope you will get the approval soon. 

    Our NOA1 was July 14th and as far as we know our case remains with the Nebraska service center.

    I've been checking the status of the case very frequently. According to the chart, they are still processing cases submitted on July 2nd and our NOA1 is July 14th.

    Tier 2 is the 2nd level of customer service and can give you a bit more information on your case. You have to request to speak to Tier 2 once you've reached the first level of customer service. The wait time to speak to Tier 2 is usually long, so I would begin calling them as soon as they open.

    Call about 8:05am CST (4:05pm Egypt time).
