It seems the presumptive death route to end marriage has been used for convienance and individuals in contact with their spuses have used it in the Philippines. It seems like the embassy views presumptive death with a presumption of fraud. Jenny was called back for a second interview, where they kept making promises that she could come to the USA is she would just admit that she had contact with her husband. The trouble was is Jenny has had no contact with him in years. He literally disappeared. They said they would contact her in one to two months, so we are hoping. Annulment I believe is out of the question because I believe, if he is alive, that we would have to serve him which is difficult when someone has dropped off the face of the earth.

If you can find your spouse, annullment might work especially if he is not supporting you and/or your child. (Emotional immaturity). When I researched this out as I was trying to find Jenny's husband when I first met her, a Gaum divorce was a possibility. At that time in Guam if 2 individuals agreed, neither have to show up for the divorce. I think that has changed. If you have gone the presumptive death route, what I think helps you is a showing that you and your spouse had a good relationship until he disappeared. Pictures of them and letters are things that should be brought to the embassy.

Off hand does anyone have the phone number for the embassy, that can be called from the USA. I plan to give the embassy a call later this week.

I do not know if this will help anyone. It seems like we were rejected because Jenny did not have a picture of her and her ex-husband who deserted her and her child 5 years ago putting her brothers and then me in the position of supporting her and her child. Everything else was fine. I will fly over there and marry her soon. I will then come back and liquidate assets and emmigrate to the Philippines. I do not know if this is stating that presumptive death even though stated by the embassy is a valid show of singleness or not. I think we will never know the real reason for rejection. Anyway, I do not know if this helps anyone, but might be a reason to try annulment instead of presumptive death. Good luck to all of you and thanks for all the help this forum has been.

I can tell you for a k-1 there is no packet 3 or packet 4. Just one packet sent to my fiancee. That does not mean in different types of visa there are packet 3 or packet 4. This idea came from somewhere and sure confused me for awhile.

Thanks, that makes sense. If I am getting all sorts of deductions from money spent in previous years, it has no relevance on whether or not I can support Jenny.

I have seen this before but cannot find the topic. My gross income was significantly different because of some large deductions. Has anyone had experience with this.

Jenny called the embassy and they said all three forms should be filled out electronically so bar codes match. I have found a site for 2 of the forms still looking for 156K form

Approved in mid to late august; isent to embassy mid to late september; interview date January 19. The delay kind of sucks!

NVC stated they got my paperwork September 5 I believe. They said it would be sent to the embassy within a week. Later they told me they had received the paperwork August 31st and had sent it to the embassy on September 19. The embassy stated the received the paperwork on September 26, then later stated they received the paperwork September 19. Depending on dates we have a chance in January, if not in February. Just wondering is there some accurate computer record of the dates things were sent and when they arrived.

Just checking. I heard September 7 was the cut off date for December interviews, but I am seeing several individuals with dates before September 7 who did not get interviews.

My fiancee talked to someone claiming to be a "consultant" she said it is not adequate. When I search I get comments like this; "If approved, the K-3 visa can be used to enter and leave the United States ... a death certificate or a court ruling of annulment or of presumptive death as ..." but cannot get any direct language on the embassy site. A consular officer will only accept a death certificate or a court ruling of annulment or of presumptive death as evidence that a Filipino marriage has been terminated.
