Hello Again! Any update if the name-based search you did with the Commissionaires was acceptable? Did they ask for fingerprints? Please let me know as I am in the same boat.

Yes, the name-based search with Commissionaires is perfectly acceptable for K1. If worked for me and I received my K1 in February. However, you must ask them to send you a hard copy with a dry seal (do not use the PDF version they send you)

That would depend on the definition of qualified alien.

Yes, that is what I'm trying to determine. According to legal definitions, I don't think I will be, because I need to be a lawful permanent resident.
I will have filed my application for permanent residence.
I will just have to speak with the admissions department.

  3. I entered on a K1 last week.
Today, I was accepted into a fully-funded PhD program in America, which includes a university funded scholarship.
However, on the funding page for the university, it says the following "Regrettably, university funded scholarships are not available to students who are not qualified aliens."

By the time I receive the scholarship (in September) I will have filed for AOS, and will (probably) have received my EAD. I will have an SSN.
Will I be a qualified alien?

You should not list the US adress but it is fine that you are listed on the lease. Me and my now husband did the same. I was visiting in February 2016 and we both signed the lease to the apartment and we didn't file the K-1 until mid March. It was approved and nobody asked about it at any time. Just make sure to not list the Adress on any documents as your residence.

When you filled out the DS-160, you must have listed the apartment as the place you will be staying, yeah? It asks "Where will you be staying in the US?"

If you list a US address as a residence, then you will be admitting that you lived illegally in the US.  Bad idea.

I will not be listing the address as a residence. But on the DS-160, it asks: "Where will you be staying in the US?" ...I will be staying at the apartment where I've signed a lease.

  6. I am Canadian. My fiancee is a permanent resident of New Jersey (her family home is there, her driver's license is still NJ, she voted there, etc.), but has been living in Philadelphia and working there since August.

Before she rented the apartment, we had submitted our initial petition. When she rented the apartment, the landlord asked if anyone else would be staying in the apartment during the dates indicated on the lease, we said that I would eventually be immigrating and would be staying with her. I was required to sign the lease.

Is this OK? I was only in the country on a tourist visa.

Should I put this address on the DS-160 form?

  7. Really, eh?

So... It says right on my form that it is to be used for US immigration, and I did in fact notify commissionaires that K1 Visa is what it will be used for. As far as I understood, and as far as I was able to tell from other posts on this topic, fingerprint check is only required if the name and DOB check produces evidence of a criminal record.

Thank you very much for your input.

  8. I am gathering documents for "Packet-3", in preparation for an eventual K-1 Interview in Montreal.

I got a police check from "Commissionaires" Ottawa: I filled out the form online, paid $62.00...  they verified my identity and then did a full name and DOB check, and emailed me the completed police certificate approx. 5 days later. The PDF, when printed out, seems like it would be legitimate enough for the interview. However, I have read some information on here that suggests otherwise.

I just want to know if somebody out there has used a Police Certificate that looks like this one, and has been successful.
    Thank you!
