The court document says the father has reasonable access in case he wants to visit the child in the US. Her father said he won't grant permission for her to get a US passport, so we are trying to find a way around needing his permission.

There have been issues if the custody order is for "physical" custody only (and there is no statement like "full legal custody") and the non-custodial parent maintains visitation rights. If it grants sole "legal" custody, that should have been sufficient.
The custody agreement says my wife has sole care, control, and custody of her daughter.

We have not completed this form, but we can try it. We submitted the sole custody from the court, but received a letter saying they still need the father's permission because he is on the child's birth certificate. My wife called the state department to explain the situation, but they said without his permission they can't issue a passport.

Yes, she submitted it with the application, but they said since the dad's name is on her birth certificate we still need his approval.

Yes, we submitted the sole custody document from the court when we applied.

My wife and her daughter became US citizens in April and applied for US passports in May. My wife has sole custody of her daughter, however the state department says that she needs the approval of her ex husband to get her daughter a passport because he is listed on her birth certificate. Her ex is a Singapore citizen and he is not being cooperative. He will not agree to sign the form and give permission for his daughter to get a US passport. The passport website says my wife can get a passport for her daughter without the father's permission if she has sole custody, which she does, but the letter we received said that is not true. Does anyone have advice on how we can get a passport for my daughter without her father's permission?

My wife attended her Citizenship Interview on March 9 and passed her tests. The officer said she can't be granted citizenship until her ROC was approved. The ROC was approved the next day (March 10). What happens now? It has been 17 days and her case online still says "Interview Scheduled" and the estimated case decision time says 11 months. Does that mean it will take 11 months from her interview before they will grant her citizenship? We aren't sure what to do at this point. I guess we just wait.

My wife never received an affidavit about uscis keeping her green card. They just took it and never gave it back. I'm not sure what she'd turn in at her oath ceremony.

My wife attended her citizenship interview last week and passed her tests. She was informed her citizenship can't be approved at that time because her 10 year green card application was still pending. The day after her interview her 10 year green card application was approved. She received a notice of action saying that her 10 year green card application was approved, but that she would not receive a new green card because her citizenship was already approved. When we check her account online and when we call the USCIS phone number her citizenship status does not say approved. They both say her interview was scheduled. Our concern is that she currently has no green card. They kept her 2 year green card at the citizenship interview and the NOA for the 10 year green card says they will not send her one. We haven't received any NOA saying her citizenship is approved and the USCIS website and phone number both say that there is no approval yet. We have no idea what is going on. Has anyone dealt with a similar situation?

My friend is going through the k1 visa process and yesterday he got a notice of action in the mail for his biometric appointment. Is it now required that the US citizen petitioner has to have a biometric appointment? When I went through the k1 process a few years ago I never had a biometric appointment.

My wife, 2 children and I are scheduled to fly back to the US tomorrow after vacationing in the Philippines for the past month. I tried checking in online to print out our boarding passes and my step daughter could not be checked in. I was given a message that DHS has denied her entry into the US and that I need to contact them to get approval. My step daughter is a permanent resident so I dont understand why I need to apply to have her allowed to reenter the US. Has anyone dealt with this issue before?

My wife is Filipino, but received a K1 visa 2 years ago while living in Singapore and moved to the US. We are now visiting in the Philippines and I saw a post on a Philippines group on Facebook saying all Filipinas traveling out of the Philippines need a CFO sticker in their passport. My wife never attended a CFO seminar because she was living in Singapore when I met her. Will my wife be able to travel back to the US from the Philippines without a CFO sticker since she is already a US permanent resident? I see many different responses online when searching this question. Thanks for the help!

Yes, that is the same error that I received online. When I called uscis, the automated system said my case could not be found. Maybe their system is down for certain people. My wife's friend checked her aos case tonight and she had no errors.

My wife and I submitted her k1 and k2 AOS applications in November. The last update was in January and said the cases are waiting to be scheduled for interviews. We checked the cases online today and neither case number, for the k1 and k2, can be found. We called the USCIS phone number and typed in the case numbers to check their status. Both case numbers couldn't be found again. My wife's EAD case number still works when checking the status but the AOS case numbers can't be found. Has anyone experienced this situation? Thanks

My wife is now in the US and we want want to work on her Divorce Recognition in the Philippines. One of the documents we need is a Certified copy of the foreign country’s divorce law. My wife was married and divorced in Singapore. We have been unsuccessful in finding the country's divorce law. We asked family court where the divorce took place and they had no idea what we needed. Has anyone here gone through the Divorce Recognition process in the Philippines and could offer advice on how to get a foreign country's divorce law?

My wife and I were married on Sept. 10 in Delaware and were told that she is not allowed to take my name for her married name. The marriage state office said that she needs to change her last name in her own country (Philippines) first and then bring back a copy of a new passport with my last name before they will allow her to change her maiden name. Now we are doing AOS and the form asks for her married name and maiden name. What do we do? Should I type in her married name with my last name even though it hasn't been legally changed yet in Delaware? We would appreciate any advice. Thanks!

I had a question regarding an RFE. I requested a 2nd copy of my RFE because I was in the process of moving and it didn't show up, but then after 2 weeks it showed up and I responded on Friday. I just got a response today regarding my request for a 2nd copy of my RFE and I'm confused. It talks about approval instead of mailing me the RFE. Yes, I've been to Singapore twice now. Once in November 2016 and then again in April 2017, but I mailed the application in February so the only time I could meet her is November. I've never been anywhere else in Asia. I sent them a copy of my entire passport and it is blank other than the stamp to Singapore.

This entire process is already unnecessarily slow and intrusive, and then it seems that people run across these adjudicators who for some unknown reason try to make life even more of a living hell for people. Sorry that you are dealing with this. I guess all you can do is send more pictures if you have them?
Yes, I agree. They already know she lives and works in Singapore and they said they know I went to Singapore in November, so what other reason would I have to go there? It seems crazy to me. I guess I have to prove that the pictures were taken in November 2016 somehow.

Thanks for the advice. I did send pictures of us together at her apartment with friends, but I can try to send more. I did include in my statement to them that we didn't stay at her apartment because there was no place for me to sleep. I also included pictures of us at a Singapore attraction. The pictures were taken by the company and the attraction was stamped on the pictures. I included receipts with dates showing that occurred in November. It is very difficult to establish a specific time we were together because pictures aren't time stamped.

Hello Everyone,
Yesterday we received an RFE and I'm seeking advice on what evidence to mail back. My fiance is from the Philippines, but she lives and works in Singapore. I traveled to Singapore in November to visit her. The RFE states that I have proven that I traveled to Singapore, but I didn't prove that I was with my fiance there. The evidence I mailed initially was 15 pictures of my fiance and I together, hotel receipt, passport stamps, boarding passes, receipts of attractions we visited with pictures, an email to the hotel stating that my fiance was checking in for us and their response. I see that the evidence does prove that I was there and the pictures show we were together, but how do I prove that we were together in Singapore in November? I'm not sure what other evidence to send back. I can send more pictures of us together, but that doesn't prove a date and location. We are each going to write a statement that we were together too. We are also going to show evidence that she lives there (permanent residency documents) and a letter from her employer that she works there. If anyone has any other suggestions for evidence, I would appreciate it.

She still has a Singapore passport so we are guessing she can leave the US with that, but can't reenter. Yes, we told him she needs a US passport to travel. He doesn't want her to be a US citizen. He wants her to only remain a Singapore citizen.
