    You can file I-765 for your EAD and get it while VAWA is pending but only if you apply for I-485. To apply for I-485 now, your spouse has to be a USC. If you decide to file both, I-765 should be with category c(9). 

    Remember that if you do decide to apply for I-485 now and your VAWA gets denied your I-485 will automatically be denied and you will more than likely be put in removal proceedings.

    You can apply for I-765 without I-485 but you will not get your EAD until I-360 is approved in that case. If you apply for both I-485 and I-765 (category c9) you will get EAD while you're  waiting for VAWA to be adjudicated but keep in mind that if your VAWA is denied and you have a pending AOS, it will be denied and you will face removal proceedings.

    Yes, some people get it sooner, usually about a month from Biometrics. But you always want to give yourself a little extra time just in case and so you're not disappointed if it doesn't come exactly in a month 😉

    Work permit comes within 2 months from Biometrics.

    I don't think she's eligible to apply for a new EAD until she has a new I-485 pending.

     

    The previous one was denied because her husband withdrew his affidavit of support. We get our EAD's based on pending AOS. She has to have a pending AOS to be able to get EAD.

    You can make an appointment for your InfoPass there. You will have to pick a language and provide zip code for your area so they can determine which InfoPass office is for you. If there is no available appointments, keep checking every day. They will come ☺

The IO explained to me that since I submitted a fee waiver, my petition went to get approved for the waiver first before it got handed to the responsible units, so I should use 02/02 (Notice Date) as the date to go by.

    No questions are stupid here and if you are applying for VAWA then this forum is definitely for you. Go back and read through VAWA part 5, 6, and 7. If you don't find an answer to your questions there, send a private message to @sandranj and explain in detail what your situation is. Not getting a Prima Facie is not necessarily a bad thing. I've heard of people who have gotten their Prima Facie and were rejected at the end. There's also been cases when people didn't get Prima Facie and were approved. As we discussed earlier, Prima Facie decision rests solely with the Immigration Officer to whom your case was assigned. Maybe he/she needs more information and has sent you RFE (request for evidence) before they can give you a Prima Facie. Unfortunately they will not provide any information about VAWA cases over the phone unless your a lawyer assigned to the case and the processing time of your case is out of the regular processing times. Something you can do is make an InfoPass on the governments website and see if you can get any information that way. 

     

    Do you have your receipt notice and case number? It will be helpful if you end up making an InfoPass appointment. It is still early for your case to be worried. I submitted my case on December 20th and didn't even get my receipts until February 10th. Then I had my Biometrics a month later, on March 9th. Then a couple weeks later I got my Prima Facie - it took almost 3 months to get my Prima Facie so you have nothing to worry about just yet.

    I don't know much about applying when the victims is not in the US. I know a victim is still eligible if the abuse happened in the US but I am not sure how exactly the process differs. I would assume it could take longer because the documents travel between different countries.

    Hmmm, this is really strange. Yeah, I suggest to make an infopass and also they will notify you online (if you singed up on their website) when they send you anything so maybe you can call his sister when it happens and ask her to try and get it for you.

    That is unusally long, in my opinion. 2 years? I know at some point it really did take them that long to decide some cases but not recently. We hear about people who have gotten their decisions already and they applied March/April 2016. Definitely get an info pass. As much as we think it's government and they have everything organized, with this many applications coming through, it is possible that a case might get "forgotten".

    If you just submitted your application, the interview is far, far away. You will have time to put yourself together before then. I know it's hard now but time heals the wounds. Also, someone correct me if I'm wrong but I don't think they are supposed to ask any abuse related questions at the AOS interview?

    12/06/2016 - mailed my package

    12/12/2016 - USCIS accepted and waived filing fees

    01/05/2017 - received NOA1 for all forms

    02/14/2017 - update on USCIS for i-765 "New Card is Being Produced"

    02/16/2017 - update on USCIS for i-765 "Card Was Mailed to Me"

    02/16/2017 - received biometrics appointment for March 1st

     

    I guess it's official. Getting an EAD without biometrics is possible.

    I am so happy to hear that Ms. Green! EAD is a big milestone I feel like ❤️

    I applied for a fee waiver under the condition that my income was below 150% of the Federal Poverty Guidelines. My work permit expired in January and so I don't work anymore, but I was working at the time of submitting my application and I used my pay stubs to prove that I didn't make more than 150% of the FPG. They usually want you to submit pay stubs for the past 2 months. There is other conditions you can apply under like:

    1) if you receive means tested benefits, or;

    2) if you have a financial hardship;

    and you can read about them in the instructions for the form I-912. I will link it below:

    They tell you exactly what kind of documentation they will accept as proof.

  16. Hey Guys,

     

    My lawyer just called me and said she got my receipts. I didn't see it yet because she was leaving her office already but when I get it on Monday I will let you know exactly what it says. She said my fee waiver (I-912) was accepted. 

     

    So here, I can finally start building my timeline:

     

    December 20th - Packet mailed (I-360, I-765, I-485, I-131, I-912);

    December 22nd - Vermont received my packet;

    February 10th - Notice of Action received by my lawyer's office and fees waived; 

     

    TBC... ?
