I was wondering how difficult/time hungry is changing from consular processing to adjustment of status?   We have passed NVC stage and since we started the application for spouse visa (November 2016) my wife has gotten a H1B and is already in the US.  She would prefer not to have to return to our home embassy for interview if possible.   I know an I-485 would have to be filed with USCIS, I would just not want it to to take 7 months to get through Nebraska like it did the last time.  Thanks in advance for any help.

    I guess they are transferring some cases out of Nebraska. This does not look good at all for the transferred cases. It depends where they were sent and how behind they are also...

    What I don't get is why they wait until now to make that decision.  They've known for months about the spike in applications, they've known for months that other centers are ahead, just make the decision earlier to distribute the applications as much as possible.  You'd wonder what's going on.

Hey, I thought I would update since there aren't many real updates.  Got approval notice by text this morning, I-130 approved on 07/25/2017.  PD 11/29/2016.  On to the NVC, hopefully things are finally freeing up in Nebraska!  I know its frustrating to see these updates, particularly for all of you with PDs before ours but I think it's better to find out that at applications are being approved.

  4. I don't know a lot about medical residencies, but a lot of fellow postdocs were foreign and had no trouble getting sponsored for visas that way. I don't know that she can go through the standard match process anyway since she's foreign. Universities can easily sponsor people.

    There's no problem with match as she already is interviewing but there is a problem with J-1 - two year home residency rule. There's no way to change status from j-1 to IR1 without a waiver to the two year home residency which apparently is next to impossible to get. I'm so annoyed right now. Again, I know I'm not the only one. We really have to hope for good luck and no RFE's and maybe the visa gets granted before her work starts, and then the only delay will be the green card.

  5. A really honest answer since you're trying to make plans is that there's almost zero chance that you'll have the visa by June or July with Nebraska. It's rare anyone is getting approved there in faster than 5 months. Then a month to send to NVC and them to assign a case number. Then you can accelerate that process a bit, and maybe NVC will get a little less backlogged, but it's probably at least another month there. And then another month or two to interview. So best case with Nebraska is about 8 months. Sorry!

    I was thinking that. It's fairly disappointing. I will have to explore the possibility of a J-1 visa for her and then applying for change of status once the IR1 is approved. It's really frustrating, but I'm sure I'm not the first to have this problem!

    Just got NOA1 and was told Nebraska is our center. I'm pretty gutted as I understand Nebraska is a slow center. I really need my wife to have her visa by June/July at the latest so she can start work - she is a doctor and the recruitment system for residencies is once per year, if she misses this year because of no visa, she will have less chance next year. How likely do you think it is? We have 8 year relationship history married in Ireland last year, I've re-established residency in Texas. According to the publicly available info, they are processing i-130s from 7 months ago which would mean that we won't get it in time. Does anybody think we have a shot?

  7. I know this has been asked a million times but is there anything I can do to get my wife legally into the country with permission to work any sooner than a CR1/IR1 visa? I delayed applying in the mistaken thinking that I would be able to get a K3 for her fairly quickly once the I-130 had been received. This does not seem to be the case. My wife is dependent upon this visa to get an offer of residency training in a hospital here and if she doesn't get it she will miss her one window to apply for these jobs (she will be a much less desirable candidate next year, for reasons too detailed to go into here). I am really worried that if she doesn't get the visa that we will be separated for much longer (like 3-6 years) which would be insane. We've only been married since February and I moved back to the States in July after 24 years out of the country. I hope to get the I-130 in this week.

  8. I am putting together I-130 petition for my wife and I have found scans of old lease agreements that we signed from 5 years ago. I don't have originals. Should I include them in our evidence package? I'm scratching my head about it largely but I've read that tenancy agreements are good evidence. I just don't want her to be asked for the originals later and we are not able to produce them.

    I also have bank statements for joint accounts for about 5 years and I'm just going to include one from each year from those. Lastly, I'm putting together a narrative timeline of our relationship with a written affidavit photos and travel evidence such as airline bookings. Photos will come as screenshots from Facebook and phone with dates in the screenshot. Will it be enough?
