What visa would a person that is a U.S. citizen, not living in the U.S., apply for to get their Canadian spouse to the U.S.? They both live in Canada, the U.S. citizen works in the U.S. and crosses border every day from Canada to U.S.

I used to be a member of Visajourney back in 2004 when I went through the K-1 and K-2 visa processes for myself and my daughter.
My daughter is now a U.S. citizen. I want to ask a question on behalf of my daughter.
Here are the facts:
1. She is a dual (Canada/US) citizen.
2. Her spouse is a Canadian citizen.
3. They live in Canada.
4. She works in the U.S. (she commutes across the border every day with her Nexus pass).
5. They want to move to the U.S., he wants to become a PR and they want to buy a house (because house prices are ridiculous in Canada).
Given that she is a US citizen and has employment in the US (but lives in Canada), are they eligible for the DCF?
Would they go through the Vancouver consulate?
Any comments or advice would be appreciated.

I haven't been here on VJ for quite some time, although I do check in every few months. Our K-1 and K-2 processes seem so long ago that I can hardly remember how it all works anymore. I even find it hard to answer member's questions because immigration has changed so much since 2003 when we started the process.
We are still happily married and living in Washington state, near Seattle. My daughter (the K-2) will finish college in Yakima next June with her Dental Hygiene degree and hopefully will find good employment near where we live so we can see her a little more often. I have lived in the U.S. for almost 8 years now and I still miss Canada so much, and always will. But I especially miss seeing my 2 adult sons (that live in Canada) on any regular basis. I am thankful for the wonderful friends I have made here in the U.S.
I hope you are all doing well and for those of you that are still going through the processes, good luck and best wishes.

I got my AP expedited at the local USCIS office because I needed to return to Canada because my Mom was in the hospital and I needed to find a nursing home for her (I had power of attorney). I made an appointment at the local USCIS office after I had already sent in my AP application, and my AP was approved the day of my appointment. Make sure you take ALL documentation you will need to prove why you need to return to your home country.

You may get an RFE from USCIS asking for the passport pictures. Just wait to see if you get the letter, and then send the passport photos in and the process will continue.

Firstly, welcome to VJ!!! You will find a lot of useful information here as well as lots of very helpful people.
You definitely do not need a lawyer to get through the K-1 process. Most people here on VJ did it themselves, myself included. Read through the "Guides" and "Visa FAQ's" sections to get a lot of answers to any questions you might have.
Sometimes, even if a form has expired, you can still use older versions. Check the USCIS website, go to the forms section, then go to the I-129F, and it will tell you if any expired forms are still acceptable.
Good luck with the process and keep us posted as to your progress. It will feel like a very long process, but every day is one day closer to you being able to start your lives together.

I would provide any and all evidence of your meeting. I am sure that the eticket would work as proof. Good luck.

Most likely you will get your approval by December, but it's never a sure thing.
I definitely wouldn't be too secure in putting down any great amounts of money for a date you're not sure about. Of course, it's your choice, but there is never any guarantee that you will be approved by December.

There is no legal wait time. As soon as you receive your divorce, you can submit your application.
I was the beneficiary, and as soon as I got my divorce, we applied for the K-1 visa. My divorce was not even an issue.

It is a lot nicer to be together while waiting for the process to finish. Luckily, my husband and I only lived 2 1/2 hours from each other, so we got to see each other every weekend while we waited out the process.

So sorry to hear about your Mom not being able to attend your wedding. I can understand how heart-broken you must be. Like another poster stated, you can always go back home after you get AP or your GC and have a small wedding with your Mom present.
Make sure you take lots of pictures to send your Mom. I'm sure she will be with you in spirit on your wedding day!!!! Best wishes!!!

Thank you for your replies. I am asking for my daughter, the dual citizen. They are not actually married yet, so I'm helping them figure out what is the best route to go to get her fiancé (the Canadian) to the US to live after they are married.
They are planning an August, 2021 wedding, so we'll need to figure out when the best time for my daughter to get domicile in the US and then when to start the visa process for her husband.
