I actually called last night but I may try again tonight. Luckily I've called 3 times since they have recieved my documents and I havent yet got a hold of a rude rep. They have all been pretty nice . Knock on wood lol. He told me last night it's still being reviewed

Ok. That 's a good sign. This means it was picked up from the mail room.

My fees have been paid since 2015. We had a step in between to complete before sending in documents for nvc. So our i130 and fees have been at NVC  for a little while. My documents were sent and ds260 was filled out on 3/28/17. Documents received on 4/3/17.

Try to call today...Best time is past 9:00pm...The hold is shorter and the reps seem relaxed and more willing to assist.

     ZIZOU,

Jack( USA) is married to Emily( Overseas )

Jack files- I 864  ( But Not Enough Income So taking Co- Sponsor David help)

David has Enough Income( More than  70K ) for last three years and Current year to support Jack Family

When David File - I-864 with his trans scripts & W2, They file their tax filing Jointly His wife Jennifer not working

My Question is Now David Wife Jennifer needed to file I-864A ?

No, as Jennifer will not be sponsoring the beneficiary.

    ZIZOU2017,

Petitioner does not have Enough Income ..He is taking Joint Sponsor help  .

    What If Joint Sponsor(Trans-Scripts & W2 his Income ) submits I-864,

Tax Filing Jointly and  his Income sufficient to support Beneficiary.

Does he need to submit his spouse I-864A ?

    What are your Thoughts?

No, if the spouse of co-sponsor is not used to co-sponsor the beneficiary. Say David is the co-sponsor. David is married to Emily. David and Emily file taxes jointly. David needs to file I-864A providing tax transcripts with his W-2's and preferably his employment letter all showing his portion of joint income. Emily's income is excluding as Emily is not signing the contract to sponsor the beneficiary. For more instructions on I-864A, refer to the link below.

My mother is not self employed so as far as I can tell this is not necessary for her? So can I just submit her tax return and w2?

Let me summarize your story to be in the same page. Your parents filed jointly. Your father is self-employed and your mom is not. You are only using your mom as a co-sponsor. According to the instructions above, your mom has to file I-864A with supporting documents including her IRS tax transcripts and her W-2. The reason they require her W-2 is that her portion of Joint filling income is shown. If she is self-employed then you would send 1099. But in this case, you are not using your father as a co-sponsor.

Joint Sponsor is in USA Not overseas

If his income is sufficient and meets the Poverty Guideline, he does not have to have a joint sponsor. Keep in mind that if he barley meets that guideline, NVC will approve it, but it is at the discretion of Consular Officer to honor it. In some cases, the consular officer will require a joint sponsor.

  7. Sending IRS tax transcript would be sufficient without the need of W-2. "

If you provide a photocopy of your Federal individual income tax returns, you must include a copy of each and every

Form W-2 and Form 1099 that relates to your returns. Do not include copies of these forms if you provide an IRS

transcript of your Federal individual income tax returns rather than a photocopy unless you filed a joint income tax return

with your spouse and are qualifying using only your income."

Individually, if you have filed married separately you can request IRS transcript without having to send copy of W2 or 1099. I, for example, have filed joint with my wife, but only my salary is qualified so I had to send copies of my W-2. Refer to the link below for more help:

    https://www.uscis.gov/sites/default/files/files/form/i-864instr.pdf

In your parent case. Since they filed joint and you are only using your mom as a sponsor then they would require her W-2 and 1099.

As of the year you did not file your taxes you would have to attach a letter articulating the reasons.

    Good Luck

    Hey guys,

I know that with NVC timings the rule is NO RULES :) but does anyone know how the process of booking an interview appointment, after your case is completed, happens? The timings are so random on the spreadsheet (from 3 up to 59)

It depends on the beneficiary's embassy. I would refer you to the appropriate page and either seek advise from people from the same country or visit their timelines for an estimate....I know some embassies share their opened spots for interviews a month ahead of CC and they schedule them usually around the beginning of each month....So say you get CC beginning of June, they might schedule you sometimes on July.

    Good luck

I was stuck in Nebraska, one of the slowest processing center, for almost 6 months. I am currently waiting on NVC. A good practice for you would be that you read about your next step. The link below may help.

hello , In my case they said was in review, then called today again.. and they said to wait until 11 weeks and she doesn't know if is on the review department. unbelievable.

Did you send your docs via e-mail or mail? Some reps would go above and beyond throughout the interaction, some of them do the bear minimum which sometimes leaves you just wondering around.

The USCIS sent my petition to the NVC on May 30th should I start calling the NVC to get a case number or should I just wait?

If I do call what information should I have when call the NVC?

You would need the USCIS case number  as well as the beneficiary full name and date of birth...You can call, but normally it takes about 5-7 days for them to receive it.

    Hi all,

We got a checklist and the financial support response was that the NVC wants to see my 2016 tax return.

I had sent an abundance of information to show that I can support my husband (W2, tons of paystubs, SS form which shows my salary history, letter from my employer, bank statements which alone show an amount well above what would be required to support 1 person, 2015 return, etc) and so I was curious to know why they needed the 2016 return.

Agent: because they want to see that you're filing your taxes. [she might've said paying but I don't remember]

    Me: I'm sorry, what?

A: they want to see that you're filing taxes

Me: ummm... I don't understand. I've never heard of that in any government directions, forum, etc. How does that prove that I can support my husband?

A: It's not about that. They just want to see that you're ..

Me: That I'm a good and upright citizen?

    A: Well, no, it's -

Me: I don't see how that supports my case at all. I didn't file taxes because the government owes me a ton of money and I wanted to wait until my husband got his SS number so I didn't have to file twice, the second time being an amendment, from married filing separately to married filing jointly. I sent the 2015 return, which shows that I file taxes. When I sent my AOS package to the NVC it was February, so I technically had time in which to file by April... I just.... I don't....

    A: I'm sorry ma'am that's what they want.

    Me: [head explodes]

Before I started working I was told that as long as I had enough in the bank I wouldn't even have to show an income. What gives?!?!?

Here in VJ, majority of time we want to be subjective and stay away from judgments and recommendations leading to no substantial help. You said you are only relying on  assets to show your ability to support your spouse. It is up to the embassy to honor that and appropriately review your assets. You are right that a good amount of money that is sitting in the bank is a good to make your case since it can be converted to cash within one year. The point that you are missing here is that it only applies if using that cash to support your spouse will not cause considerable hardship or financial loss.

To put everything in perspective NVC needs and requires you to show your tax return that is a must and arguing around is a dead end. In addition, you mentioned that IRS owes you "ton of money", this is not good. The reason, because that is considered as debt on the cash that you have in the bank. If you subtract that debt, there might be chance the Co might not like the numbers at that time. Another way of thinking about it is: using cars for example as an asset. You can only use a car that is not your primary.

Let's say you own a Corvette that is appraised for 40k, but you have it financed. Your debt balance is 25k. At that point, it is not a reliable asset to use due to the equity.

I would recommend that you first either file your taxes, or apply for an extention....I am not really an expert when it comes to IRS. Plus, just comply with their requirements. If your salary is below 125% poverty guideline, then use your assets.

  13.

Hello! Do I have to resubmit all my original relationship evidence from my I-130 at the interview or just anything NEW? I haven't seen my husband since I sent it so we don't have any new photos, just chats.

Also, can my husband just give the officer his phone for evidence?!? We use a combination of Viber, Google hangouts, and Skype, and getting the call logs from any of those is nearly impossible! I'm not about to have him print 200 pages of ####### that they're not going to read either.

Thanks. Sorry for venting a little bit.

Algiers Embassy does not allow phone devices. As of ongoing relationship evidence. What I did is sending evidence in each step. I Sent some evidence to USCIS and I also attached a set of evidence to NVC asking them to forward it to the Embassy. For the interview, we will gather more chat and call logs in case they are needed. Good luck and let us know how it goes.

From what I am reading through google and travel sites, yes, as a Chinese citizen and passport holder she will need a visa for Taiwan.

That's very interesting. Taiwan is officially named "Republic of China", China in other hand "People's Republic of China". One would think you can easily move between these neighbor countries without a visa...At the end of the day, territorial conflicts prevail. Sad.
