    You can choose to either file as a dual status alien, in which case whatever you made prior to your first full day in the US does not have to be reported. A dual status filing can not be joint.
    If you file married jointly you will at the same time choose to file with the election statement that you elect to be treated as a US tax person for the entire year of 2017, meaning everything you earned will need to be reported to the irs. Filing this way you can also use 2055 foreign earned income exclusion and exclude up to just north of $100k on the return from wages earned abroad. 
    I am less sure about the investments but the only thing you will owe taxes on are gains - you don't mention what type of investments these are.
    I believe I've read about exclusions for gains from house sale - but I could have dreamt that,  so leaving the floor open for someone with specific experience on investments while moving over.

    It might be easier to use the "physical presence test" to qualify on the 2555. That's what I did. I didn't have income after moving, but for the presence test you can use any 12 month period where you were present for 330 days in a row. The bonafide residence test is harder since there are a lot of rules regarding domicile and abode overseas and in the US. There's a higher risk of doing this wrong.
    Depending on how much you made during the year it might help... I don't remember the exact calculation but you can exempt somewhere around $110,000 for the whole year.. so for half of 366 days (or slightly less since you moved in June) you would end up being able to exempt around  $50,000 for the year of 2016. Don't know if that helps.

    WOW!!  in the two minutes since posting that - I checked informed delivery again - and as i saw the USCIS package in the packages section - it arrived in my mailbox!  I have my card!

    Update:  I received my NOAs on Saturday 23rd for my EAD and AP.  Approval date was December 18th (95 days I think).
    Now watching informed delivery for my card...
    so thankful to be able to get some work in January!

    WOW!!  in the two minutes since posting that - I checked informed delivery again - and as i saw the USCIS package in the packages section - it arrived in my mailbox!  I have my card!

    Hey everyone ! 
     
    Little update on our case... we had our GC interview this morning in Raleigh, NC and were approved! Our appointment was at 11:15, we were out by 11:45. They didn’t ask anything special except verifying information like our names, Birth dates etc. And then he asked me a few of the “yes” “no” questions like “have you ever committed a crime” and said we were all good. I should receive my GC within 2 weeks to a month. 
     
    I hope you all get appointment letters or EAD in the mail really soon, thank you for all your support during this journey

    So they just put my card in my mailbox ! I thought I'd have to sign. I do have a locked mailbox though, maybe that's the difference?

    So my delivery date has now updated and I am supposed to get my card tomorrow ! Even better, I will be bale to go and apply for my new SSN card before christmas vacations.

    I hadn't been on in a couple of days and was delighted when I noticed that your signature had changed (I was starting with August updates).  I wrote to my senator on Monday to request a congressional enquiry - so am now really hopeful that I will hear something by New Year!  Your approval appeared to be updated the day after your enquiry was made - I am really hoping my senators office will catch USCIS before the holidays...  This made me so happy - great news!

    Will do! But yeah if tier 2 doesn't see approval, it means it's unfortunately still pending ...Why did you think you were approved? Or is it because it already has been so long? If so I'd suggest to make a congressional inquiry...
    I have weird stories with those...it seems every time I submit one, within one day of it I receive my approval ...Happened a lot..seems too quick to be linked, but it happened 3 times lol...

    OMG, so I called USCIS, the lady didn’t want to transfer me to a tier 2 saying it could take 60 days before getting the combo card and because my approval notice was so soon to give them some time (60days). She couldn’t see my card being produced or sent in her system...I told her, you are also not seeing that my case has been approved, so I would definitely appreciate to talk to a tier 2 officer...she was speechless.

    Make sure you ask to get a tracking number and talk to tier 2...I got my approval notice yesterday and when I call the recording and first line of people don't see my approval. The lady was telling me to wait 60 days, and if I didn't receive the card within that time to call back, because she couldn't see the card being produced. I reminded her she also couldn't see my approval and I still was approved so I would like to talk to a tier 2 to double check and inquire about a tracking number, she was speechless for a minute and then apologized for not being able to help me and that she was going to transfer me but there was quite a wait...I got a call back within 2h and my tracking number.

    Decided to try my luck and call them today. They transferred me to an L2 officer right away but was given an estimated wait time of 77 mins. When the officer called he was very apologetic. He mentioned I should have gotten my card two week s after approval. He said everything looks clear on their side and there is nothing on the system that shows why it's  being delayed. He expedited the SR and said we will hear back with an update in the next 5 days.

    Good morning everyone.  Just wanted to update you on our progress.  My husband had his green card interview yesterday morning and was approved!  
     
    The interview process was very short and simple.  Our appointment was at 8:30.  We arrived at 8:15 and went through security and were directed to the waiting room.  We were called back for the interview a few minutes before 8:30 by a very kind older lady.  She swore us in and then proceeded to go through our application to verify our names, addresses, etc.  She then asked me if I had an attorney put our packet together to which I told her "no, I assembled it myself".  She said that normally only attorney offices include 3 copies of everything and that it is not really needed for the AOS. (essentially, you only need one copy of the requested documents for all three applications, AOS/EAD/AP... Oh well, better safe than sorry).  She then went through the questions with my husband in the application (have you ever tried to traffic drugs, overthrow the US government, etc) and checked them off as she went.  From there she asked us to tell her how we met so we explained that while she jotted down some notes.  After this we showed her some picture books from when we were dating and from our wedding ceremony.  We brought around 8 but she only looked at 2.  We told her who people in the pictures were but other than that she didn't really ask any questions about them.  The only other "question" she asked was "Tell me something to make me feel warm and fuzzy about your relationship".  My husband and I just used this opportunity to talk about how we bonded over facetime relationship for a year before we physically met and how we have been adjusting to married life with him in the states.  We also talked about his relationship with my daughter and how he has adjusted very well to the parenting role he has taken on.  Then she asked us to supply any additional evidence that we had to show a bonafida relationship.  We gave her bank statements, health insurance information, car insurance information, life insurance information, receipts from the DMV from my name change and getting his license, and our booking agreement for our ceremony and reception in 2018.  She stated that we had way more than she expected from being married for 4 months and that she appreciated us bringing all of it.  After that she stated that she was going to run a final background check and that she saw nothing to indicate that we were not a happy in love couple and would be approving him.  He should get his approval notice in the mail in 1-2 business days and his green card should arrive in 4-6 weeks. 
     
    We are very pleased with the how the process and interview went and look forward to getting him working and not having to file paperwork for the next 2 years!  Haha.  Just wanted to share our experience for anyone who may have their interview coming up.  Good luck to those still waiting.  Fingers crossed for quick approvals for all!
