    it could be time needed for additional background checks or ongoing background check. that what i've read on i_m_m_i_h_e_l_p forum as i myself also assumed that the background check would be completed prior to the interview. i don't think acceptance is guaranteed unless approved on the spot at the time of the interview. the wait is definitely something that takes toll on the applicants throughout the whole aos period.

    from what i remember the questions were: what do i do for living, if im single (F2B category), if i ever left US since entering and then yes/no questions from i485 form. interview lasted probably 20 mins and for the most part IO was looking through my file.

     

    it's the standard letter for people who don't get approved on the spot. it says that the'll make a decision within 120 days and if not you need to call them. IO said they need this time to perform more background checks. almost 3 weeks after my interview. still waiting.

    it didn't state that  in the email or NOA. i just assumed i might get asked or RFEd after interview for an updated one. i also believe the gonorrhea  and updated forms were release after my medical exam date (9/30/2016). so i'm thinking about just doing another one to be on the safe side. i'd hate to do it and not being asked for it just as much as getting RFEd for it.

    im F2B category with PD SEP29 2010 which became current about 60 days ago, however i filed early on 11/17/2016. Does my wait time start from the filing or PD becoming current ? Basically NBC should send it to local office as soon as it is current since I already got EAD/AP?

    I filed on 11/17/2016 PACKET recieved on 11/21/2016 by USCIS.

    My PD is SEPTEMBER 29,2010 so filed early based on the early filing dates.

    Filing from NY (field office is Federal Plaza).

    Per my sig i already received the EAD/AP but I have not heard anything on I-485 progress, still saying fingerprint fee received (191 days from early filing - around 60+ from PD becoming current)

    Reading this thread this means that my I-485 didn't leave the NBC yet for my local field office.

    Do processing time counter start from PD or from the time I filed?

     

  7. i only have a copy of the visa page in my passport, not the bio page. will that be enough + valid US ID (NY DL)? i can also take copy of birth cert and translation if necessary. The Polish consulate said it should take 3 weeks to get the new passport. I went to get the replacement on 12/2. 3 weeks from that is exactly 12/23 which is my bio appt date. but with xmas break it may get delayed. hopefully not. if they tell me at the appt time that the visa copy and BC is not enough can i reschedule on the spot ? or do i have to do it now and follow the instruction on the NOA ?

    i received biometrics notice today and it's scheduled for 12/23/2016. The notice says to bring ID, passport . Last week I went to Polish consulate to get my passport renewed. They took the old one and said the new one will be delivered in about 3 weeks. I hope to get it before the bio date. If that's not the case should i call to reschedule or just take a copy of my passport visa page and NY DL and hope that's enough ? I don't want to get turned away. Thanks

    i already started few threads but have a couple additional questions.

    i was finally able to get all the required documentation for a complete (i hope) AOS packet.

    since i will be filing all these form concurrently with I-485 supplement A (245i as a grandfathered beneficiary of father's LC filed before april 2001) do i need to include the supporting documentation (fathers original approved LC) with every form ? since they will be in the same packet i'm not sure if i should include 3 copies of the same document. i'm asking becuase I wonder if the whole packet will be inspected by one officer or if it'll be split up and send somewhere else where I guess the supporting doc would be very helpful.

    this bring me to my next question if i should include a small one page letter with every application explaining the circumstances of my case and if this also should be attached to every application. I485, 765 and 131

    as far as form 765 (EAD) in Q11 it asks if I ever filed for EAD. my father when he initially filed AOS for me (which was denied due to age out) also filed for EAD which i received and it was valid for one year. I will make a copy of both side and include that and answer yes to that question , however i'm not sure in which office it was applied for. can i leave that blank ?

    lastly do i need to include a index page listing all the documents included in the whole packet for easier packet searching ? also is there anything specific i need to write on the envelope when mailing the AOS packet out besides FROM/TO? Anything specific as far as the kind of enveloped to use ? and should i use tracking #, signature confirmation when mailing out ?

    since i'm filing based on approved I-130 is this the correct mailing address ?

    i did incur overstay time and unsure if i'd like to risk flying out even with AP in hand. there's a couple threads here and there with successful travel even in my situation but most advise against it. thanks for everyone's help and i will post any additional questions.

    so where it says income for three years on I-864 for primary sponsor (father LPR) enter 0 or the #s from joint tax return? since the tax return #s will have to be re-entered on co-sponsor I-864A, i don't want them to add them up and come up with 2x figure.

    also can i enter optional house value since they own their house with no mortgage (provide zillow estimated value page)? or is this unnecessary ? sorry for all these questions but i see few threads with USCIS going back and forth with with petitioners regarding missing information in affidavit of support forms.

    I'm sponsored by my father with I-130 approved getting ready to file i-485 packet. however i have few questions as a couple unexpected surprises arose.

    LPR father filed jointly for in 2014 and 2015 with USC mother but listed his occupation as UNEMPLOYED. Mother made enough money to meet the 864 guidelines.

    do I need to fill out I-684 for both parents combined or one for father and additional for mother as a joint sponsor? will i submit the same tax return with both applications ?

    he said he filed in 2013 too but doesn't have the tax return for that year, do i leave the box where it asks if last 3 years were filed blank? will that trigger application rejection ?

    TL;DR FATHER LPR MOTHER USC filed taxes jointly with father (main i130 petitioner) UNEMPLOYED but still meeting requirements based on mother's income. how to handle I-864?

    whole process seems like the odds are always against me :/

  14. thanks again for the info Hypnos. I do have additional questions about the I-864 Affidavit of Support.

    18a asks if petitioner/sponsor (my father) filed taxes for the last three years. He did and i have copies but only for 2015 and 2014. Can i safely check that box off ?

    Now in 18b it says if i can provide copies of the returns for all three years. Since i only have two do i check it and provide just two years or don't check it and provide just 2015?

    then 19abc asks for years and income for last three years. i can provide #s for 2015 and 2014, he did file in 2013 but can't locate the return for that. Do i have to fill out 19c? Can i just put 2013 in and his "guesstimated" income which is similar to the years i have ? or would i be better off leaving it blank. Wouldn't that contradict the answer in 18a though ? Should i leave it blank and attach explanation?

  15. Yes it does look like i'll be able to file the AOS packet in october since they're using "dates for filing" as you stated and i fall under "All Chargeability Areas Except Those Listed".

    I will fill out EAD application. Am I correctly assuming this should be the ©(9) category ? Also i'm not sure if AP will do me anything good as ive read that most people advise to be cautious about using it when I485 is pending.

    I did my medical exam today and will pick it up on Tuesday 4/10/16 and will try to assemble the packet by Friday. Is there any info as to what office supplies should be used / envelope to put together the applications? Cover letter with index of the documents/applications ? Also anything special written on the envelope besides mine/USCIS address ? also what type of postage? signature confirmation? thanks for the continuous help!

    I guess the confusion can be cleared by little backstory.

    Father filed for LC before 4/30/2001 and then I-140 with my family and myself as immediate relatives. However due to lawyers late filing USCIS denied just me because of "age out". Brother and mother obtained GCs.

    245i allows me to be grandfathered so I'm hoping to AOS under it.

    So my PD is 9/10 (I-130 RECEIPT NOTICE) which means I can file now since DATES FOR FILING is 08FEB11?

    Also if filed what happens after that? Does it get approved but notification not sent until F2B FINAL ACTION date is met ? Is it sitting in the queue until the FA date ? I'm getting I-693 (Medical Exam) done today which is only good for 1 year ? I don't want it to expire by the time they get to my application.

    Also would I be able to file for EAD under the circumstances of my application ? that I can include in AOS packet, which I'm still putting together?

    The reason I asked about the copy of I-130 APPROVAL NOTICE is because i visited this website which says it's needed

    i filed I-130 under 245i in F2B category. I-130 was received on 09/10 approved 4/11.

    Is PD based on receipt notice or approval notice date ? it's 7 months apart but i'd like to know which date to use as PD for filing (dates for filing). i don't want it to get denied if i file based on receipt notice.

    I-485 requires I-130 APPROVAL notice. I can not find it and only have I-130 RECEIPT notice. Would that be sufficient for AOS packet ? I could include the uscis EAD case # screenshot that shows that the application was approved as well (i've read on some forums that this could work). I did send FOIA request email but that could take months to receive.

    another question i have is since i'm filing under 245i can i also apply for EAD?
