    Did you include what ever you made abroad and filed on the for 2555? did you insert 0 or checked that you were not required to file? if you were not required because you made lower than the IRS requirement, what proof did you include?

    Thank you. It is. One could have a million thought. I did know DCF was faster, but honestly it was fast to the point where we had to run around to complete all the necessary and I felt at some point I needed more time. I was ready to ask the consular section to postpone my interview if it were to be sooner than scheduled. Think we're all set now... hopefully things go well as we live in a super high fraud country with a tough embassy. But am not sure if suspicions should exist if we're both expats in that country.

    It sounds like you're pretty well sorted and your domicile proof sounds adequate to me.  What stage are you currently at?  You mentioned moving at the end of the year, just bear in mind its taking about a year at the moment (although DCF filing may save you some time)

    Actually my interview is in 2 weeks. The whole DCF process took us 4 months simce we submitted the i130.

    Yes correct, income would be zero, and he had to prove domicile also.  We've lived overseas since 2010.  We did so by explaining in a letter all the steps he had taken to keep connections there, and some evidence also. I don't want to post the letter on here for all to see, but if you want to see it please message me and I can remove the private info and send it to you. I think there might be one on the wiki also.  They look for how you've kept domicile (drivers licence, permanent address mail, bank acct still active, etc), and how you intend to re-establish (emails to real estate agents about housing, joint bank acct enquiries, email enquiries about schooling for child, etc). Also copies of any temporary visas, as these show that your living overseas is only intended as temporary. They were a big deal.


    For statements we downloaded the official ones from our internet banking, then did a screenshot of our current balance with recent transactions for our main account which we were still using day to day.  We didn't get them stamped or anything.

    We are doing exactly the same. Added a letter for domicile with all steps, accounts back in the usa active since 2011, bought a car there recently, insurance, voting records abroad, investment, 2555, taxes, real estate inquiries driver license, communication with uni for phd programs for my USC wife ect...

     

    for the affidavit we made 2 copies, one with 0 current and another with income, we are planning to move by December, therefore income for 2017 will be reported? Ill present the one with income, if asked ill hand out the one with 0. Both forms have the assets. We also have her parents as joint sponsors, just in case.

    Savings do count as assets.  In fact this is ALL we used.  There is a section for your savings and a section for her savings on the form, then a spot to add them together.  We just finished the process (got approved on thursday) using just assets of above the requirements (for us it was a household size of 3, so we needed $76,600K).  We had money in a US account under my husbands name for half, and the rest was in an account under my name but he had access, and 2 accounts with both our names on it.  No issues at all.  We are however from a low fraud country, I'm unsure of your embassy? 


    At our interview we were asked if we had jobs lined up. We advised not yet but that we are both from industries that are employable.  I (the beneficiary) mentioned I worked in the rail industry and have a past workmate living in the USA in the town we will be in... but that we plan to start our own business also.  He then asked "I see your AOS mentions you're petitioning based on assets. Tell me about them", so we explained we started saving in 2014 to ensure we had enough to cover our application, and allow us to setup our new life in the USA... and that although we could get a sponsor if needed we prefer to do everything off our own back.  


    So that's our experience, I hope that helps. 

    Now onto "proving" your assets.  They will want to see that you've had them in your possession for more than 12 months ... basically that you didn't just "come across" funds suddenly for your visa. We provided bank statements for 2 years for our savings account, 1 year for our transaction account which had just a small amount in, 1 year statements for the US account we have been transferring to, and the currency fair transaction summary to show the funds going from our AUS and NZ accounts to the US account.
    We also used the federal exchange rates as a "reputable" site. We printed out the latest and provided it along with a summary showing funds in current currency and the exchanged amount. Here's the link.

    Message me if you need more help with this :-)   PS; when you get to interview stage they'll want an updated form with updated statements (in my case just the statements and balance since the ones I sent to NVC)

    It is pretty much the same as we are doing, we are using assets as we both live abroad and we are DCFing.

     

    Seems your spouse also lives abroad? from your timeline it seems you filed at lockbox, so for the current individual income for the petitioner...did you insert 0? as the source of income will not continue? Did he need to prove domicile? 

    For the bank statements, did you have them stamped or attested? or did you just print out the online statements?

    U need to get that 2016 tax transcript they really need that.we have same situation before i had my husband 2013 2014 but we dont have the 2015 .my interview before was january 5 ,2017 and they put me into AP bc we cant provide the  2015 transcript that time thats why we passed the 1040a to the irs We waited 2months for the transcript my husband got the transcript march 15,2017and we got approved march 22,2017.dont forget also ur proof of domicile ur husband bank statement or his properties in the us just incase they ask it .

    Well reading your dates, if your interview was January 2017 as u said, then definitely you were late to provide transcript of 2015. Or was the 2016 transcript you mean they asked for?!

    If they want evidence from 2016, providing paperwork showing why you don't have a transcript won't be helpful. You should have a copy of your return just in case.

     

    If you filled it out all by hand and mailed it, then yes your 1044. I don't know if you mail a return if you get some sort of confirmation that it has been received, but if you have that then bring that also. When you do it electronically you do.

    Yeah I do have the copy generated from TurboTax. this is the document I will present along with employment letter, payslips, and the USPS receipt.

     

    Hopefully by June the transcript is available so its easier.

    That's why reaffirmed cases don't ask for new police report at NVC but the embassy will ask for a new one if it is over 6 months. 

    So in her case she needs a new one, at this will be at the embassy (Interview) stage.

    By 2016 tax return do you mean the 1040? 

     

     

    We do have a joint sponsor (my in-laws) filing jointly, so they filled both 864 and 864A, combined for the last 3 years they make over 100K yearly (household size of 3) 

     

    We are including our savings and checking accounts (about 80k US) and calculated current income from January to October (when we are planing on moving) and its above the guideline for a household of 2.

     

    We will also have a duplicate 864 ready with her current income NULL as the source of income will stop, if they ask for it we will hand them the 2nd copy.

    You should have for the last three years so if 2016 is not available when you go for your interview, then print out 2013, just to be safe.

     

     

    We did check on the IRS website online (Get transcript my email or mail) when we submit the request for 2016 it says it is not available yet. 

     

    We do have the US postal service receipt showing that we sent tax documents on April 3rd, should be a useful proof. Ill also print out the page that says the transcript is not available and might take up tp 8 weeks after sending in the documents to IRS. 

     

    If I take 2013 transcript along, then on the affidavits of support for the last 3 years, you think I should add 2013,14,15  or 14,15,16?

    Whatever documents she used to file tax should suffice.

    If you haven't already; order tax transcripts as soon as they are available. I am not sure whether tax transcripts are available as electronic copy, but you can explore that option, if it becomes available before interview.

    She did. we only used the payslips from her employer abroad.

    Tax transcript is not an absolute necessity.

    We do not have w2s or 1099s as we both live abroad and employed abroad. 

     

    instead we have a letter from employer and payslips.... hope that works with the embassy. 

  14. I was in the same shoes as you. Wife living abroad for many years not knowing the taxation law. 

     

    We back filed with IRS all previous years which was a fairly long process but we had it done. 

     

    I would suggest that your issue here after getting the tax docs done, is the proof of domicile, this is a major issue you need to look into. If you left the states long time ago you need to proof that you have maintained your domicile or intending to. Focus on domicile equally as for your tax back filing.

    My interview is scheduled in June, I was wondering about the tax transcript, we have the 2014, 2015 ready but the 2016 is still not available as my wife sent her tax docs to the IRS in April. Online it said it might take up to 8 weeks for the transcript to be available. 

     

    My question is do you think the CO will request for the 2016 transcript? or is the 2015 fine? 

     

    we have the 2016 transcript for our joint sponsor but not yet for my wife/petitioner. 

     

    Will a copy of the 1044 sent to IRS suffice?

  16. I have receiveid a police certificate that was valid for 3 months from a different country. When I asked the immigration office about the issue they said I must get a new valid one even if I did not visit the same country since the report was issued. 

     

    Your best bet is to wait until you get your interview date and then apply for all police reports. 

     

    As for a UN refugee in Lebanon I think he can still get a report using his refugee card. This being said, make sure if your spouse doesn't have a refugee card he must insist to get one from the UN. otherwise during his interview he might be considered defaulting a residence status or being illegal in Lebanon which might affect the outcome. Is he having his interview in Lebanon? if yes he must show his legal residence status there.

    Yes you can ad yours; keep in mind the CO may question why you do not have them in a joint account, and many embassies do not take foreign assets/ savings, only those in the USA, so if you can, transfer the savings to a US account.

    We do not have them in joint accounts but I actually have a supplement card to her account and she has one to my account. we have copies of cards in case CO asked.

    Yes assets can be used. We used pure assets in my name (beneficiary) and didn't have any issues, as has many others. With that said, you are going through the most difficult embassy and "normal" rules don't apply to you. 

     

    Since your wife's salary will stop, you need a joint sponsor.

    I couldn't find any thread that answered my question :D  what we intend to use is not assets like house or land or so, we just want to add our checking and savings accounts funds and show statements as proof. 

     

    We do have a joint sponsor. 

  19. Hello members, I kindly need your input, 

     

    We went through our process via DCF. Obviously my USC wife does not live in USA, we are good on the domicile proof part. 

     

    For the form i864, can we use her and MY savings on the form even though she makes above the poverty guideline? We do have a joint sponsor as her source of income will stop. but what she made last year and will be making this year before we depart is also above the 125%. So should we add the savings anyways? is it also advisable to add my savings?

    Is the embassy instruction to come in the morning and register so they prepare your letter. The letters are not prepared unless you go and register. You can't take your own instructions to the embassy but follow theirs. You don't do as they ask you to and they will push your data back to next 3 months again and give yours to someone. So please wait to you get the email and read the instructions before you advice on this issue. Most of us have received the instructions and know how it goes.

    The email I received had no instructions at all, they just asked me to appear at 2 PM for my letter. When I went the security asked if I registered earlier and i said NO. he then checked the email and let me in. 

     

    Once in I was asked again if I registered and I said I wasn't told to, so the lady said then it'll take about 30 mins and asked me to sit, 25 mins later she appeared with my package.

     

    My interview date was the same of all those who received their package that day, who were registered in the morning.
