If it takes 2 years to approve I130. How long will it then take to get the whole process done with? I have heard it takes less than 2 years for Nigerians in f2a category.

After approval for F2A category it may take 10 to 12 months before interview process. Therefore the whole process may take between 32 to 36 months to conclude the process except if the petitioner get naturalized and the case is upgraded then the process will speed up thereby reducing the waiting time

    Hello ALL,

I am a LPR who filed for my spouse in Nigeria.
The priority date is   January 16, 2019
When should I be expecting the I130 to be approved?
The field office is California service centre

At the moment they are just treating May 2017. Normally F2A takes 22 to 24 months to get approved, so probably u can be looking at getting approved December 2020

I just wished we knew what they needed. The funny thing is we used a lawyer for our processing just so we won't run into any issues. After he was told his visa is approved he bought a ticket 😟. This is just so frustrating!!!

This is really frustrating. The lawyer can help you check up on the case because I believe we use lawyers so he can guide us anywhere we seems to be going astray

  4. My wife filed my i130 on 29 Dec 2017 as a green card holder but became a US citizen in November 2018. We applied for upgrade and the case was finally upgraded in December 2018 and we are told within 5 months we should get approved. How realistic is this? and is it possible to have it approved earlier than this? If you have had such experience please share. This waiting is biting hard on me and our relationship👩

    Hey guys,

I have a quick question regarding USCIS status updates.

My fiancé received a physical NOA2 letter on 26th of January, we got approved on 18th. I checked our USCIS status, and it still shows the same information as it did after we got NOA1. It's been over 2 weeks now.

Should I care about this status update or it doesn't matter since we have an actual NOA2?

    Olga

You don't need to care, I got a lot of friends that had similar experiences. I think USCIS have not been updating approvals recently. I don't think it's anything to worry about, the letter and the mail is good enough evidence.

Thanks for your suggestions. I contacted his family already. The number they have for him is a non-working number. I think my best option is to contact a lawyer and go ahead with a divorce. It's been 7 months since I spoke with him so I highly doubt he would be interested to talk to me now. And I have till next month to reply to the RFE.

I can recommend a lawyer for you in NY he help my wife to handle removal condition case when her ex abandon her.

find below his contact and check him online too

I’d say it takes 18 months in average . So I guess in your case it would be sometime  in May-June of 2019? My PD is June 2017, still waiting . That for F2A.

Yes it is F2A since my spouse is a green card holder. But if she becomes citizen and upgrade the case does it speed up the case and would they move it to another service center?

No if it gets approved before becoming a US Citizen then You have to send and upgrade letter to USCIS or NVC who ever have your file send the upgrade letter with proof of your US certificate or US passport a photo copy. here is a sample letter for the upgrade.

Re: Upgrading a Petition to Immediate Relative

    Dear Sir/Madam:

When I filed Form I-130, Petition for Alien Relative, on behalf of my spouse, I was a lawful permanent resident. Since filing the petition, I naturalized as a U.S. citizen.

My spouse is now an immediate relative. I am requesting that you upgrade my petition from family first preference category F2A to immediate relative.

    Case Details Below

    Case Number:  [CASE NUMBER]

    Petitioner:  [PETITIONER NAME]

    Beneficiary:  [BENEFICIARY NAME]

Enclosed is a copy of my naturalization certificate and a copy of I-797, Notice of Action for approval of I-130 petition.

    Sincerely,

    [PETITIONER’S SIGNATURE]

    [PETITIONER NAME]

    Thank you

  9. My PD is 29 December 2017 and service center is California and am still waiting. But I want to ask that if the petitioner is a green card holder and he files i130  for the beneficiary . But the petitioner has applied for his citizenship. If the beneficiary gets it i130 approved before the petitioner gets his citizenship. Then the beneficiary will have to wait for the F2A category to be current before moving to NVC and I learnt the current waiting time is two years.

    Is this true??

  10. My spouse has applied for my CR 1/IR 1 for the past 6 months and we still waiting for the approval of my i130. I know that as soon as its approved, it will move to NVC and we shall need to file the affidavit of support among other documents.

she has filed for her tax return for this year and it's very good and I believe that is what we shall use for the affidavit of support. My questions are

    1. Is she going to send the tax return to me as part of the documents I will take along for my interview?

    2. And if so and It happened I don't get interview date before the next tax return which will be April 2019, will I still go with the former one used to file for the affidavit of support or the new one for the year of the interview?

    Thanks
