    Actually I just googled it again and found this regarding the use of the intending immigrants income:
    Use of Intending Immigrant’s Income. If the sponsor does not meet the income requirement on the basis of his or her own income and/or assets, the sponsor may also count the intending immigrant’s income if (1)(a) the intending immigrant is either the sponsor’s spouse or (b) has the same principal residence as the sponsor, and (2) the preponderance of the evidence shows that the intending immigrant’s income results from the intending immigrant’s lawful employment in the United States or from some other lawful source that will continue to be available to the intending immigrant after he or she acquires permanent resident status. The prospect of employment in the United States that has not yet actually begun does not count toward meeting this requirement.

     

    So, this makes me think whether the RFE is simply just for the missing sum in the box?! But then why are they asking for a sponsor?!

    I was wondering that too but then why are they even asking for that in part 6 No. 8?

    Do you really think it's just the sum that made them send the RFE requesting a sponsor? From the other RFEs for I-864 that I saw here on VJ who were just missing supporting documents or missed a field, they never asked for a sponsor in the RFE. I wonder whether USCIS thinks that his VA Disability is too close to the poverty guidelines. $24,650 poverty guideline vs $28k in VA Disability (sorry, I wrote 26k before, it is $28k). 

     

    If we respond to the RFE and it is wrong again, are we risking a NOID?

  3. Hello,

     

    I helped a friend file her AOS papers adjusting from a Student Visa (F1). She received an RFE for their I-864 and we are struggling to figure out A) what was wrong and B) have questions on how to respond. I attached the RFE. Any help/insight is greatly appreciated! 

     

    About the situation:

    - Petitioner (US Citizen) is a military veteran looking for a job. He receives 26k/year for disability. Since these are tax-exempt, they do not show on his tax return. So we had to put a reported annual federal income of just $5k down, that showed on his tax returns (previous years are similar). Because of this considerable discrepancy, we added a letter of explanation that talked about where his money is coming from and why it is not showing on his tax returns

    - Beneficiary (Immigrant) is on OPT and makes $44k a year, so also well above the 125% poverty guidelines. 

     

    These are the documents we provided:

    • Letter of Explanation for I-864

    • Copy of U.S citizen birth certificate

    • Transcript of federal income tax return of most recent year

    • Petitioner VA Letter of disability

    • Petitioner Copy of GI bill pay stubs from the past year

    • DD-214

    • Past 12 months of Bank Statements from the Account that receives the Direct Deposits

    • VA ID Card

    • Beneficiary employment letter 

    • Beneficiary Copy of most recent pay stubs

     

    Now they received an RFE and we are not sure what is wrong. We did notice that we forgot to enter a sum in Part 6.

    Do they want them to get a sponsor? Or is just the sum that is missing and that is what the RFE is for?

    Thank you! I realized the check was in the correct amount. Just had a slight heart attack when I saw the amount of the first post in this forum but I think that was adjusting from a K1. She’s adjusting from an F1-Student Visa so she had to pay for both I-130 and I-485 so her check was $1760 🙂

They stipulate that they ONLY waive fees for any errors made on THEIR end in regards to the physical green card. It's also fairly well-known that it's nearly impossible to get USCIS' attention during a pending application to notify them of changes or edits. And with COVID, it's probably gotten even more impossible. Best bet is to wait for RoC to be approved and file an I-90 for a name change (which you'll have to pay for). Or more likely, RoC will take so long that you can just file N400 and put your correct name on the N400 application.

    I’m not filing for N400, unfortunately, because I would lose my German citizenship if I gain another citizenship. You can apply to be allowed to keep your German citizenship but it is only granted in extraordinary circumstances and according to my research it is very unlikely that I fall under those. Besides that it currently takes 18 months to get that permit (if approved) by the German foreign ministry and with everything being closed due to Covid I feel like it would probably be more like 2 years to get it so I would probably have my naturalization with name change in like 4 years 😂

    If your ROC is approved before change, you'll be back to dealing with USCIS again. I don't know if it's possible to address it before ROC is complete. If it is, I'd do it and kill 2 birds 🐦 with the same stone. 

    The charging would make sense to me if they would have to pick up my application again and process a new card. If they are working on my ROC anyways and see a name change as part of the application I feel like it should be different.
    I wouldn’t be charged for the name change on top of my ROC if I had submitted these documents with my ROC application so I am hoping someone knows how to add my documents to the current application that is being processed. 
     

     

  7. Hi everyone,

    I changed my name back to my maiden name a little while back (so not fun during Covid) but am now struggling to figure out what to do about my greencard that I don’t physically have yet. 
    Whenever I use that stupid automated USCIS phone system it tells me that I have to use the I-90 form to change the name on my greencard. That costs over $500 and I don’t even have my greencard yet so I was hoping I wouldn’t have to pay for it. Does anyone know what to do or has done this before? My case was just moved from the CA processing center back to Nebraska bc of the volume of applications. 
    I’m guessing I can’t just a copy of my name change court records together with a copy of my extension letter (NOA) to the Nebraska center and have them put it to my current application?! That would be too easy😂

     

    Edit: I didn’t get a divorce, just decided for a couple reasons both personal as well as bureaucratic issues back in Germany that I prefer my maiden name.

    Same. My case was also transferred to the National benefits Center “as part of standard processing”. I currently have the extension too with 3 months left and was told that if I haven’t received a new extension letter a month before my current one expires that I should give USCIS a call. 🤷🏻‍♀️

    I filed early Oct 2019 and just received that letter about biometrics being waived recently. I heard they sometimes don’t even send it at all.

    WAC (California). They also wrote in that letter that the biometrics fee won’t be refunded even if they didn’t take new biometrics. I didn’t expect them anyways to refund it but I still think it doesn’t make sense that we had to pay for it.

  12. Files early October and was never invited to do biometrics. Finally received a letter today to inform me that they will be reusing my previously captured fingerprints and other biometrics. Super bummed that it took them 9 months just to let me know about something that should’ve happened 7 months ago... that makes me think I will have to wait a good amount of time for them to actually look at my case now if they just now checked for biometrics 😭

    WRC and it’s been 8 months for me. 
    No background check for my job, there was one for my lease but they didn’t take fingerprints or anything, just the simple check. No global entry application or anything besides that. 🙄

  14. My case was received beginning of October. I was never even asked to come in for biometrics so I haven’t heard from them since submitting my documents and receiving the extension letter. I know I likely won’t be asked for biometrics at all anymore since this happens to a few cases just don’t understand why they made me pay for biometrics it they never even take mine.

     

    Just crossing my fingers that everything is okay because I feel like I belong to the very few who haven’t had biometrics.

    Nah, MSC is a service center just like the others. Has nothing to do with getting an interview or not. If you are adjusting from a K1 or CR1 and had a greencard Interview before it seems like ROC interview is less likely. All service center have the same chances of getting an interview though so WAC doesn’t automatically mean you won’t have one.

    Honestly, I wouldn’t postpone any plans for a potential biometrics appointment. From what I’ve seen now in the other threads you can have your biometrics appointment anywhere from a month after you submitted your documents to 3 or 4 months after. You can’t just keep on surrounding your life around unreliable USCIS again. Also if you’ve had biometrics for AOS there seems to be a 50/50 chance you will never have another biometrics appointment. 
    You can always reschedule your biometrics and it won’t affect your timeline much anyways if at all. I wouldn’t stress about it.

    @Elethiomel you might want to also download the “case tracker for uscis” if you have an iPhone. Just add your cases and it shows status. Also provides links for I-94, uscis Office locators, aos filing charts etc. Makes life a lot simpler than logging into MyUscis every time :)

    Oh that makes sense! CR1 all have to have biometrics because you haven’t had one in the U.S. yet. If I don’t get a letter about one being scheduled within the next 2 weeks I will just assume I won’t have a biometrics appointment.

    Oh wow, that’s interesting. I think it changed when I was going through AOS... I’m also surprised how little notice they are giving you. I think my biometrics for AOS was at least like 3 weeks in advance scheduled.

    I was wondering when the first ones on here are getting their biometrics appointments. My NOA date is a week before yours and I haven’t received a biometrics letter yet. Did your status online change to biometrics appointment scheduled?

    It took like a week after they received my package. But it depends where you file and when you file. This literally varies almost by week according to past threads and obviously also by address where you live and where you file. 
     

    I can’t tell you whether you will receive yours on time without knowing your ROC filing office and most importantly when you send your package. If you send your package next week you’d be fine. If you send your package end of November or beginning December then it would be a complete different story 🤷🏻‍♀️
