Hi,
The NVC have informed us my wife's US birth certificate was invalid because it did not contain all pages. When we go to this link https://travel.state.gov/content/travel/en/us-visas/Visa-Reciprocity-and-Civil-Documents-by-Country/UnitedStatesofAmerica.html the page is blank - helpful.
Select the country in which your wife was born. The page will be more helpful

What is the 1099 form?
For self-employed income. If you worked for a company and relying on this income to qualify as a sponsor then the W2 is what you'll need. A copy should be fine.

The problem with turbo tax is that it keeps asking for my wife SSN and obviously she does not have one. I was suggested to input and dummy SSN to allow me to continue and at the end choose file by mail, print the forms, erase the dummy SSN and write "NRA" and mail it in. So at the end im able to print a 1040 form with all the info so my question was would my wife be able to take this to the interview in case they need the 2017 taxes?
Yes, you can take the signed copy along with any W2s and 1099s to the interview.
And as you said, you cannot efile without a valid SSN or ITIN for your wife even if you are filing as Married Filing Separately

Are these cover sheets the one you obtain by clicking "Print Cover Sheet" on the website?
There is a very nice cover sheet that is included in the NVC Welcome Letter that they email to you. It includes a checklist where you can indicate which documents you included in the package. There is a section for the supporting documents and a section for the AOS. Note that not all documents are applicable to every application so you can select the appropriate box to tick off. This is the only cover sheet that is needed as it has all the case number barcode that the version you obtain by clicking "Print Cover Sheet"

Your responses are very reassuring. I was almost in tears to be quite honest. Especially since I thought the request was a step in the right direction. Luckily, we received our marriage license in the mail very quickly, and it has been sent off to where it needs to go.
I sure hope we’re at the top of the pile!
Hi Angelica,
Just wanted to clarify one thing. You keep writing 'license' and not 'certificate'. USCIS needs the long form, large size, frame size 'certificate' (exact name of the document depends on the province in which you got married).
I know that in Ontario, you need to obtain a marriage license before you to get married. And then after marriage, you can apply to get the certificate which proves you are married.

Not necessary. IRS has provided us CAA ( Certified Acceptance Agent) new guidance on how to conduct the interviews (reference: https://www.irs.gov/individuals/new-itin-acceptance-agent-program-changes). The applicant does not need to be present in our office to authenticate, as per IRS, "...As a reminder, AAs and CAAs must conduct an in person interview with each applicant (primary, secondary and dependent) in order to complete the application. Video conferencing (i.e. SKYPE) can be used if the CAA has the original identification documents or certified copies from the agency that issued them in their possession during the interview..."
Ameribrazil is exactly right here.
It took me a lot of digging to find this information so that we could get my wife an ITIN to file as MFJ. Had to courier her original documents here as getting certified copies from the agency issuing them was next to impossible in our case and then courier them back. Finding a CAA familiar with the procedure to verify her identity also proved to be difficult. In the end, it took about 4 weeks to get the ITIN issued.

@pson99
NVC is asking for the beneficiary to bring a current and original copy of the his/her police certificate to the interview. You may have sent it with the IV package but the beneficiary should bring originals of all the IV documents to the interview.
You can double confirm by calling NVC and make sure that you have a case complete. If you do then you just have to wait for the interview to be scheduled.

Yes. Blank for Parts 7 and 8.

I'm trying to file out an I-130 application and the G325A form has expired. Is it still a required part of the application ? Someone mentioned that it is no longer part of the application but I want to confirm.
Thanks
G325A is no longer needed but I130A is needed for a spouse beneficiary.
Make sure you have the latest I130 dated 2/27/17.

@SusieQQQ
Just curious, did you drive across the Mexican or Canadian border?

Regardless, it's helpful to call to review the DS261 as the DS261 does in some way gate the process.
Btw, I received the AOS bill as soon as I received the welcome letter and before submitting the DS261.
-
Did you call NVC to get them to review your DS261? If not, give them a call. It'll help unlock your IV fee payment sooner.
-
Good news, G-325A is no longer needed. Bad news is that she now needs to fill in and sign the I-I30A.
Make sure you use the new I-130 form dated 02/27/17.

My in laws have overnighted me my wife papers i think.
Only photocopies. Don't include originals. Your wife will need to bring the originals to the interview.

Here's what I did. I think whether you can do upload, email or mail processing, the sequence won't be much different in terms of getting to the point where you are waiting for your CC/interview date.
1. You can call NVC to see if you can get your case and Invoice numbers before you get the welcome letter from NVC so you can log into the CEAC system. In my case, I got my case and invoice numbers from the welcome letter.
2. AOS fee was paid and DS261 were filed
3. I called NVC after submitting the DS261 and asked the person on the phone to 'review' the DS261
4. IV fee should become payable after the DS261 is reviewed
5. After IV fee cleared, DS260 was available
6. Sent AOS and IV packages as soon as AOS/IV fee cleared (before filling in DS260)
Process is still quite sequential as one step unlocks the next. But you can shave a few days off here or there with step 3 and step 6 above being the most impactful.
One other thing, the NVC payment system is very clunky, prone to errors and slow to clear payments. If you are lucky and don't face these issues, you should be able to get from welcome letter to 'scan date' in 7-10 business days.

@Loray
That's a long time for the Texas Service Center. I don't know if it's because there are a lot of petitions for spouses in Nigeria.
I noticed that TSC is processing Jan 24, 2017 petitions as of Aug. 30 according to the USCIS website. If the next update shows a date later than your NOA1 date, I would definitely call them.
At that time you can also try to enlist the help of your Senator. I've heard that they have people in their office that can find out what is going on or help nudge the process.
-
I recommend that you fill in your timeline. If you do, you get an estimate of when your petition will be processed. I have found it to be a good estimate (within one month).
Alternatively, you can click on the immigration timeline link above and it will show you the NOA1 dates that are being processed at each service center.
I have found the dates provided with either of the above methods to be far more reliable than the dates UCSIS publishes.
-
Some people recommend putting N/A instead of leaving blanks even if it needs to be handwritten on the premise that it reduces your chances of an RFE. The USCIS personnel who review the petitions probably have to go through huge stacks of them. By the end of the day, they see a blank section in a petition and just issue and RFE so they can move onto the next file. Just speculation of course.
Based on a sample size of one (me), I left any fields that were not applicable blank in both the I130 petition package and NVC packages and did not receive an RFE or checklist. As always, YMMV.
Key is to make sure a field that you think is not applicable is really not applicable. Check, check and triple check. Leave the forms for a few days and check again. At the end of the day, humans are involved and human errors are made.
-
Did you fill in the DS261 form? If so, call NVC for them to 'review' it. After it has been reviewed, you should be able to pay your IV fee.
This is assuming you are not using an attorney.
-
Do you mean that the IRS won't allow you to obtain your transcripts online? Or by mail as well? What is the reason they are saying that you can't obtain your transcript?

Does anyone know if since my lawyer is the agent by default and I have no DS-261 to complete, if I can just get my case # on the phone and be able to pay right away from there?
I believe the DS261 still has to be completed. Whether your lawyer fills it out or you fill it out, it still has to be done.
Let me retract this... It appears if a lawyer filed your petition then he/she should have filed the necessary forms so that you won't need to submit the DS261 when the petition is sent to NVC.

I did that yesterday, that's when I received the welcome letter and AOS became payable
Should I have received the IV first?
From here it looks like AOS comes first.
If I recall correctly, AOS fee is payable when you get your case number and welcome letter and IV fee comes after the DS261 is reviewed. If you already reviewed your DS261 with NVC, your IV fee will become payable within the next couple of days.

It shows pay now already but just takes me to the same page as the AOS and has no fee to pay.
I'm sure I'll have some time to wait with the weekend ahead of me, who knows if they even submit it for payment today.
IV fee becomes payable after NVC reviews your DS261. You can speed this step up by calling NVC and asking them to review over the phone. Once reviewed, the IV fee should become payable within a couple of days.
-
If you search on the NVC forum on VJ you'll find others who have experienced extended wait times for their payment status to change to paid. The payment system eventually catches up. I can picture one of the old vacuum tube systems where the paid invoice gets sent from Treasury to State and somebody punches a datacard which eventually gets loaded into a hopper where it gets read into the mainframe during the wee hours off the morning.
To cover all your bases, you should keep calling NVC and email them your proof of payment. It could be that you'll reach someone who knows which server they should reboot
File 2017 Taxes Married or Single? [split topic]
in Tax & Finances During US Immigration
Posted · Edited by SAJourney
To clarify, your filing status on your IRS income tax return is determined by your marital status on Dec. 31 of the tax year. If you were single on Dec. 30, 2017 but got married on Dec. 31, 2017, you would have to file as married (filing jointly or separately) for tax year 2017.
