  1. Hello folks, I had a question that I am seeking legal assistance with but wanted to know if there is anyone else here who has gone thru a similar situation.

     

    Here is my story. I am a naturalized US Citizen of Indian origin. I have applied for family based immigration for my sister (F4 category for India) in March 2008. The NVC is currently processing thru December 1, 2005 for India. Best case scenario, I am assuming my sister's file would become current in about 2 years and 3 months if everything does back to normal processing post covid. Worst case scenario, this delays even further if the NVC/embassy are unable to process family based immigration cases due to covid related slowdown. 

    To make things worst, we lost my brother in law in May of this year after a long battle with covid. He was the sole bread earner for my sisters family and have been financially impacted by his loss. I am thinking of consulting with an immigration attorney to see if there is a way to write to the USCIS and see if they can give any special consideration for my sisters immigration case; to expedite it maybe based on humanitarian grounds?  

    Does anyone here know of anyone who had similar situation like above? And does anyone have any recommendation for an immigration attorney that I can consult with?

  2. My wife had her medical done at Breach Candy Hospital on 21st Feb. She didn't have any old vaccination records with her. This is perfectly OK. She was given MMR vaccine/shots and she cleared the medical checkup without any problems.

    7:30am - Went to Breach Candy Hospital

    8:00 am - registeration

    9:00 am - blood test, vaccinations, x-ray

    10:30am - medical checkup

    3:00pm - reports given.

  3. Congratulations! May I know why you filed for a K-3 if you did DCF?

    I filed K3 at that time i thought K3 would be faster but K3 was approved earlier in Nov but I 130 was approved in october itself. Now Im just waiting for NVC to send the File to New Delhi......Does anyone has idea that how soon they will send the file to consulate.

    Its taking around 9-12 days after the case completes for the NVC to send the app to the US consulate overseas.

    Do you know if the Delhi/Mumbai consulates are 'current' in scheduling IR1/CR1 interviews or is there a backlog of a few months before they schedule the interview?

  4. Doing DCF in Delhi is intended only for US Citizens who are permanent residents of India. It is no longer as easy as simply going to Delhi and filing the applications. They require you to show extended employment in India; income tax filings in India; foreign registration FRRO documents, etc. The 60 day rule is no longer in effect.

    The best/fastest option for you would be to do a K1, come to the US [takes about 5months], get married in US and then do an adjustment of status I-485; If you do want to get married in India, then you can do conventional IR1/CR1 [8 months] or a K3 [6 months].

  5. Our K3 app has reached the Mumbai Consulate. Our I-130 [iV app] is at its final stage at NVC. We have decided to go the greencard route and abandon the K3. So the question is, do I need to do anything to cancel the K3 application? or is it Ok if we stop responding to any K3 related receipts/notifications sent by the mumbai consulate?

  6. My case has been xfered to NVC and they claim to have sent the AOS fee bill couple of weeks ago but I have not received anything from them yet.

    I already know what my case number is and I got that by calling their automated response line.

    The question I have is if the NVC actually sends a physical notification with the NVC case number when they receive the application from the USCIS. I have not gotten anything from NVC yet.
