Filing taxes as married is just one way to show evidence of co-mingling of finances for evidence of a bona fide marriage. It's fine for him to have filed as HOH as long as it is legal (as you say, he fulfills the criteria). There are other ways you as a couple can show such evidence. Focus on the evidence you do have and you should be fine. Get it filed! the wait will be looonngg
