    My husband and I lived together for several years prior to getting married and since then (2012) we have had a joint account with 50% of each of our incomes being deposited into it. We used that account for all of our joint expenses (rent, groceries and other bills). We got married and didn't bother officially combining our incomes fully because we got lazy and our set up was working out fine for us. Anyway, late last year (after applying for ROC) we decided to buy a house and re-structured our finances - we combined our incomes 100% together, opened a new savings account where we put our down payment money, made a will and got pre-approved for our house.

    We got an RFE last month asking for more evidence - how do we explain our financial situation? Should we write an explanation letter? We are going to be sending in the new account statements, but I am worried that USCIS will think we were being shady by not combining our account fully until recently.

    Did you just combine your income 100% after applying for ROC? That's probably why you rec'd an RFE because they may be questioning why you're only putting 50% of your income in your joint account.

  2. Hi, friends. I really appreciate your thoughts on this. I have a very rare genetic metabolic disease. My husband's attorney told me that because of my illness, my husband has a good chance of being approved for I-601A. However, the lawyer would like for me to have 10 appointments with a mental health counselor, in order to increase my husband's chances of being approved (my disease can cause intermittent symptoms that not only affect my body, but also my mental health). I'm concerned because I can't afford this. Is there anyone else here who has a medical condition that was able to have the I-601A approved, due to the medical condition itself, without having to see a mental health counselor, as well? (I have no objection to seeing a mental health counselor, my concern is that it's going to cost $1,200--that's far more than I can afford right now, since the attorney is already so expensive). Also, in case you're wondering, I take medication to help lessen the severity of the symptoms of my metabolic disease, but I am not on any medication for mental health symptoms (which come and go anyway, so I'm not sure that medication would be warranted for the mental health symptoms in my case), and I have only seen a counselor once as a teenager, when I had a psychiatric evaluation, and was not diagnosed with a mental health illness at that time.

    I assume that it's going to cost you $120 per session? See if they can put you on a payment plan.

  3. Hi Everyone,

    I have a question about getting a K or other visa for my sister.

    My sister in the Philippines has been conversing with her boyfriend from the USA online for over 6 months. Just recently her boyfriend (an older gentleman) attempted to fly from the USA to the Philippines. However, he has a big fear of flying and while he made the first leg of the flight, when he boarded the second leg (LA to Japan) he had a panic attack and almost heart attack and had to get off the plain on the tarmac and was rushed to the emergency room. Now he is afraid to try and board a plane again and wants to know if there is any way my sister can visit him for their first one on one meeting.

    Is there any provision in K or other visa that would allow my sister to come to the USA under conditions etc...

    They do want to get married, but the fear of flying/health issue with the boyfriend is preventing the first meeting.

    Any thoughts or ideas on how to overcome this issue??

    I, too, have fear of flying. I met my fiancee and flew to the Philippines two months ago. The last time I flew was 33 yars ago. I asked my doctor for some anxiety pills and didn't even use them. I boarded a total of 10 planes and now I'm cured :). Maybe, meds may work for him. Good luck!

  4. Last month we got a "request for Evidence". I forgot to check two boxes. I filled it out and sent it back. When we check the site for the status of our I-129F now, we see this: "On April 4, 2016, we received your response to our Request for Evidence for your Form I-129F, Petition for Fiance(E), Receipt Number WAC_____. Our California Service Center office will begin working on your case again" Anybody have an idea how it will take before we get another response? Kevin

    From what I've seen, it can take from 5 days to several weeks.

  5. This is crazy. Now the US embassy in Ghana is denying people for being in longer relationships. Awful! It just doesn't make sense. Sorry about this. I guess maybe they expect you to marry and file Cr1 to prove he's not in this for visa as she suspects. How did you guys meet?

    Once you two are convinced that you know exactly why he was denied and can address that, then I will suggest you go ahead and marry immediately and file Cr1 when you get home.

    My suggestion also is to get married and file when you get back, but 3 weeks may not be enough. I'm not sure how it works in Ghana, but you may need time to file and the release of the marriage license. Also, I'm not sure if you need to obtain a legal capacity to marry at your embassy before you get married.

  6. Hey guys, is there any reason that on the k1 visa guide we are all told to send our I-129 packages to the Dallas Lockbox and not one of the other ones? Is it because they have a faster processing time? I live in Oregon so my I-129 will eventually be sent to California I believe and the lockbox in Phoenix is closer. Does it make a difference?

    I live in Florida and my package was transferred to California from Texas. Looks like California is ahead in processing time than Texas so it's better if your package gets transferred there IMO.

    I would go through the list in the GUIDE, collect everything you missed in preparation for an RFE so that you can handle it quickly.

    This petition process can be 5 months or so long, so be patient. ;)

    Yes, I'm starting to gather everything now so when the RFE comes in, I can reply right away.
