    After waiting 3 years being denied at interview (twice) wife finally made it here in 2007 today she is a U.S Citizen my questions

    She want to go to Australia, first flight to visit family from U.S.A. to Australia, does she need a visit to enter Australia from U.S.?

    Then leave from Australia to Vietnam to visit friends and family there Q: does she need a visa to enter vietnam?

    been so many years away... I've asked for help then, and need answers now =-)

    I'm about to retire, wife been here since 2007, done all (thanks to you all) today she a USA citizen, last week she got here U.S. passport and heading to VN next month.

    My problem, we have petition (STARTED 3 YEARS AGO) for her son to come over. It's about to come true, as we are at the NVC, D-260 stage and appears they are requiring another AOS I-864, (we did I-864 way back) I'm going to retire in a month or so...our combined yearly income will be about $34,000 (PROBLEM) I won't have 3 MONTHS of pay stubs to attach to this new AOS, the NVC 260 steps may be requesting

    Need comments!!

    NVC is hitting us up for another $325.00 fee to do a six step tasks now.. something AND also a $88.00 D-261 fee... all paid..

    I'm concerned about my not having a full time job now but did when we intial filed the I-130 for the her son to come over 3 years ago.

  3. The age thing will be a problem... Dig in, and prepare for everything. Just because you are approved with USCIS the consulate and the officers inside will be the judge(s) if it is a true relationship... hang in there!

    We started in 2004 and Phuong touched U.S. soil on June 10, 2007... never quit if you truely love her... I mean never! I heard the Consulate in HCMC was closing?

    anyway, been out of the loop for a while.... Phuong wanted a house.... so I've been outside cleaning, planting, digging out moss, yes dear, yes dear... Would I go throught it again?

    In a heart beat!!!!

    As I've always said, (If you love them) you will put up with all the setbacks, heartaches and disapointments.

    Yeah ok.

    Now don’t get your panties all bunched up… I appreciate all in information but I wanted to wait and read all responses which did generate wide discussions on this matter. Now, I am writing for a friend who tells me her daughter boyfriend told her (Mom) that he had no interest in living with the daughter but wanted to marry her daughter... what would you conclude?

  5. Does anyone know of a statue of limitation regarding visa denials? Whereas, The Consulate denies a visa (same couple) began with K-1 – K-3 currently and being denied year after year after year. The interviewing spouse has a slight sensory (memory) problem but their love is strong and everlasting. They refuse to stop until united here. One works here and supports the other there. During interviews she forget simple, yet basic, important dates, places and times... which, again gets denied as a sham relationship.

    He went back and married her four years ago thinking might improve their odds! :wacko: lol!

  6. Today we appeared for photo and fingerprints aka (bio) at USCIS Seattle, Tukwila. They had seen us one hour before our scheduled time. In fact, it took longer to park the car, get passed security before all was over inside. Now, we must wait for another letter, which states, all went ok? Or, come back later and bring more document(s) and/or appear again to a personal interview.

    Now, if there is a problem with USCIS fingerprint scanner/fingerprint technician when you appear for you’re (bio) they will ask you to go to your local police station and get a “Certified” Letter, 35-40 dollars, Stating; There are no current or pending criminal charges on your loved one.

    Now, We wait for a letter from today’s adventure with USCIS that all is ok, (approved) or, come back again with more docs or perhaps a face-to-face interview. I‘ll keep ya posted as things change.

    I read an article here on VJ yesterday and I seriously think my case is sitting on some COs desk...:P

    From the time I first filed for K-129 to the day my Fiancée touched U.S. soil was about 2.5 years that’s, two point five years. During that period of time people pass away, holiday seasons come and go. However, I “dug in” for the long haul. I purchased a computer for my future wife so she did not have to walk to net café in the rain. We chatted via yahoo messenger and web cam daily this was a normal part of our accepted relationship (being apart) I’ve dealt with unreasonable consulate officers findings and overturned them because I was committed to bring my loved one home. I stayed the course and NEVER gave up, never. Once you finally get the pink you suddenly forget all the time that passed and see thing totally different. I was still a bit gun shy that something was going to cause more delays… I changed my mind set when she was at Tan Son Nhat ready to board the plane. This will happen to all of you who are still waiting. If you truly love you’re Fiancée/Wife you will dig in and do the waiting games and know that some day soon you will be together. I did, and we are now preparing for our ten-year green card (Bio) this Friday.

  8. NOA I-797C, arrived today 9-18-09 Biometric Processing forcoming so they can capture fingerprints, photo, and signature. My wifes fingerprints are so delicate the scanner can't read them. I think we will have to get another letter from the local police stating she has no crimial charges pending. I'd like to get on the list but my old... I mean very old, mac computer can't/won't perform the task.

    Well, I didn't think I'd get this far but we did=-) I still remember the burn out years (3) of waiting to bring my Love Vo home. 2 years have now passed and we are as gitty as to old folks can be.

    I sent in the I-751 and most of the documents they asked for. I included the DECISION letter from 2006 where USCIS reaffirmed our application and sent it back to HCMC where my fiancee forgot the year I asked her to marry me and they blue sheeted her again... another 6 month wait, anyway. They cashed our check on 9-11-09 now I need to check online to see if anything has been going on but I don't know the USCIS website nor do I know how to check on the status???

    Can someone post the website CHIS? and do I just enter her A# to get some results?

Write up a signature petition (with a header statement) like, We the undersigned, having knowledge that a true and sincere marriage exists between… and have all neighbors, brothers and sister, co-workers, mom and dad Priests, Rabi and anyone else who can hold a pen… It worked for me to reaffirm my K-1 application before USCIS Service Center Nebraska, which HCMC sent back. a couple years ago.

    Has anyone clicked on the link below and DID follow the steps to file their I-751 to (remove the conditional “2 year green card” basis of an alien’s permanent resident status) for the “10 year green card” and had no problems filing this way and also, how do you submit the fees and or required documents?

  12. My wife renewed her Vietnamese passport while she is currently visiting family in Bien Hoa, Vietnam. She renewed it in her maiden name. Will she have any problems coming back in to USA? Her 2-year green card is in her married name along with her Washington State ID card. Any foreseeable problems when she returns May 31, 2009?

    ChuckandKim, I did review the post before I posted my question here. That being said, I still have concerns as follows:

    My wife “renewed” her passport in Vietnam and used her maiden name on the new and renewed passport unlike the (post next to mine) “This is not her legal name at the time of renewal.

    The renewed passport Name NOW does not match her Green Card or her Washington State I.D. card.

    Why did she choose her maiden name? Heaven only knows, perhaps cheaper? Perhaps the Vietnamese Government could have made it harder for those seeking to renew passports to Vietnamese citizens married to American Man living in USA Who knows?

    This I do know,

    She had no problems entering back into USA in 2008 using her old passport (then it had one year before it expired) in her maiden name, along with her Washington State ID card and her Green Card in her married last name.

    Now, IS there a requirement or regulation stating: (I’m speculating here)

    Upon the next expiration of one’s passport then the RENEWED passport MUST list the full and legal name of the person whom is renewing same passport?

    In this case, her true and legal name is changed through marriage and because of the expiration of her passport she choose to have it done in Vietnam rather than we sending it to Washington D.C. where the Vietnamese Embassy is located and along with $100.00 USD they will renew it.

    This is my concern as she enters the USA soon, “will we have a problem?”

  14. i dont htink shes doing any drugs and i dont t hink she thinks she did anything wrong other then what she did when she called the police. im still not sure if this is my fault or all part of plan of hers.she just says she wants to be friend to all people . but the dish washer would give her 200 dollars just to send her a western union or some thing . and then when she started going gambling on weekends and get 300 dollars handed to her everytime she would go i felt like i lost her . shes would come home at 6 am and give me a100 dollar bill. i liked the money but i felt like a pimp.i didnt like the guys calling and didnt like her going out with them but i wanted her happy and wanted to trust her , i didnt think it was right but she says she didnt do anything wrong and has a right to do what she want. shes stuborn . i dont know what to do

    You need to make a firm decision. Did you expect this behavior from her when she arrived? When children are in the mix the first priority is to them. Mom coming home from work at 6 a.m. is fine, coming in at 6 a.m. from a night out with the boys in not. Are you accepting her action with common sense rational? or are you blinded by the facts and willing to accept this way of life… because she’s stubborn? If so, what are you willing to accept next?

    If I did this my Vo, (wife) would raise the roof! She’d throw that 100 dollars right back at me. The more you accept this from you’re wife, the harder it will be later for you and the child. Where’s the love, commitment & responsibility to this marriage.

  15. Get a temporary order of custody of child(s) based on the conduct, or lack of involvement of the mother with child. Document, document, document, all interactions between mother and child, her physical condition while with child, does she place child at risk? is she drunk, high, or fails to show up on time. Demonstrate/show a better living environment for child is with you. Until this matter is resolved, show the court you’re primary concern is for the total well being of the child

    Listen to Todd! You do make weird uncalled for comments toward people (americans and vietnamese alike on this particular board). Maybe unlike you, we don't get that sense of humor. Did uncle Ho or Nguyen Tien Dung hurt you in someway? Remember this and it makes you feel a whole lot better: if it wasn't for Uncle Ho, you would be here in America!!!! If you don't understand where I'm going with this... make sure you ask! Thank you Ho Chi Minh! :thumbs: About the hairs part, just answer it with constructive advise.

    Remember, there is no stupid question regarding HCM Consulate, just dumb answer.

    What if the CO suspects an Identical twin sister… what am I saying!!! CO’s are rational sound thinking people.

  17. Wow, If this is true and "you can prove it..." you'd win in appeal should the case be sent back to the service center that approved the application. Also the CO would lose his job.

  18. Man, Never say die!... only say this, I just need to vent a little before getting back into this BS game. I will never give in... never...never... never I fight mai mai... then one day, after feeling like a ping pong ball... all will be fine, because she is home... and after some time passes you will forget the details of the fight,... "You will never forget the fight," just the details and most paperwork associated with the process.

    Stay strong, stay in the game until you die... if not, you never REALLY love this person. I started in 2004 She, (my then fiancee) touched U.S. soil on June 1, 2007 tomorrow evening she will begin her second journey to visit home. We are very happy together and very much in love.

    I can say to you the truth... I would still be fighting to this day... will you?

  19. Sadly, A few hours ago, my wife’s long-time friend, husband passed away in Saigon. He was over sixty years old and they married about 1 year ago in Saigon. They have lived together in Saigon even since.

    He is originally from Texas and lived there all of his adult life until he arrived in Saigon and married (2007) and he choose to stay in Saigon to this present day.

    We are trying to help my wife’s friend whom is in Saigon "in shock."

    My questions: Does anyone know what to do in the event of death of an American Citizen whom married in Vietnam and have been living together over the past year in Saigon/HCMC ?

    They never got a chance to travel back to USA together. It appears to be due to heart failure. We don’t know to much more other then He did complain about not feeling well before going to bed… but did share with his wife, he’d felt this way before and for her not to worry AND he won’t go to hospital.

    How does/would the U.S. Government "ie" Homeland security or USCIS view a situation such as this? What to do about his body?

    Any advice will help.
