It would be very sensible for him to, there's no problem having two in the system at the same time from different people. Yes, F3's that were filed 14.5 years ago only now have a visa available to them. But again, that's not linear so I'd expect that to take longer if you're just filing one now. 

     

    Put bluntly, through either you or your father, your brother is probably at least 15 years away from a visa. So if there is any other route available to him, i.e. employment, I'd suggest you explores that if he wants to move sooner rather than later.

  2. Hi.. I filed with a receipt date of July 5, 2016 for my brother and his wife. They are both over 21 and they are both in the UK.  My parents were not citizens yet, and my mother has since died.  My father did gain his citizenship in 2022 though.  When I filed, I thought it was 7-9 years or so until processing was complete.  Turns out I was wrong. In all my years of submitting paperwork for visas, I did not know about the visa bulletins (my K1, AOS and then citizenship and then my parents I-130 visas and father's citizenship )- I always came here for timeline discussions.  Now I'm hearing that it takes more like 15-20 years.  The bulletin that someone linked to, sates that as of September 2023, they are completing F4 I-130 petitions from April of 2007 - so a 16 year wait, which would mean that if all things stay the same, then my petition for my brother won't see the light of day until at least 2032. 

     

    Would it be better to have my father send in a new petition for my brother instead?  Do I have to repeal my I-130 in order to do that or can I just change the category (F4 to F3)?  And I don't mean to sound morbid, but what if my father dies before my brother's I-130 gets approved? 

     

    I can't seem to find processing times for any of these things on the USCIS processing times website/page.  It all says "See Notes". And if I enter the receipt date on the USCIS processing times page under "When can I ask about my case?", the message that pops up is that I can't ask before July 14, 2029. So is that their anticipated processing date for the F4 I-130?  I think that is a parent filing for a married child is a F3 visa.   3. Well, after a rather long process, we got the emails on November 17 that NVC has finally finished the pre-processing for my parents and their files are being sent to the embassy in Trinidad. Their interview has been set for November 12.



    Now, according to the local instructions, my parents have to go online, and create an account to sign up for the courier service for their passports. Unfortunately, they are not in the system and their appointment isn't showing up. I'm guessing that it's simply too soon to do this but my question is, for those of you who had to do this, how long from getting that email from NVC do you have to wait in order to be able to create an account with the local embassy. Or.. how long does it take for the embassy to receive the file?

  6. Okay.. question about the IV documents. As the petitioner they are asking for certified or original copies of my birth certificate and marriage certificates. Do we get these documents back? I am only allowed to have one certified copy of my birth certificate at any given time (I'm Canadian born). If I order an additional copy, it will invalidate the one that I'm currently holding. And I don't even have a copy of my first marriage certificate - I'm divorced from my first husband. Hmmm...

    Computer generated, bar coded Document Cover Sheet

    I-864 from me (primary sponsor)

    I-864 from husband (only joint sponsor)

    I-864A from both of us

    One set of tax returns from 2011, 2012, 2013

    Copies of our passports to prove US citizenship

    Correct?

    Also, on the very first page of the I-864 it asks the person completing the form to check off the criteria being used to submit the form. I would check "1.a I am the petitioner. I filed or am filing for the immigration of my relative." and my husband would check "1.d I am the only joint sponsor." Correct?

    Submitting these darn forms always turn my brain to mush.

  8. Question for you guys .. the petitions for my parents are finally at NVC and we are just about to file the AOS forms. And though I've done tons of these forms for me, of course, I'm doubting myself.

    I will submit all the forms in one envelope.

    There will be one cover letter from me to detail everything that's being included.

    I know I have to submit the two (2) electronically generated Document Cover Sheets (one for each parent).

    I will submit two (2) I-864 forms (one for each parent).

    Do I need an I-864A for each parent or will one cover both parents?

    Do I need to print the tax transcripts out over and over again for each of the I-864 and I-864A forms? Or will one copy suffice for the package?

    Am I missing anything else?

I have an early September 2013 filing date for my parents and yesterday and today I got two updates: the first that the files were going to be transferred to another office for processing and the second that they were transferred to my local office for processing. I know from reading all of your timelines that things should start moving soon(ish) but I an still a little muddled on the next steps. I'll spend some time reading through the posts and looking up others' experiences, but this is just an apology in advance for any asinine questions that I may ask, lol.

  11. No, they called me at the start of the week to ask if I could attend a ceremony that week. I said yes, I was free. I was told not to wait for the letter, but it came the morning of anyway.

    Wait.. are you saying that your NOA1 date is 12/28/12? If so, the processing timeframe for Santa Ana is 5 months. You are way out of processing time.

  12. It looks to me like you have JUST passed the 5 month processing time mark. Today in fact, if your NOA date is April 20th. Before getting your congressman involved, call your local office and politely let them know that you are now outside processing and ask if they can give you more information or an oath date. Your brother's timeline has nothing to do with yours. Each case is different. Some people get through very quickly while other take a while.

    Only involve your congressman if you have exhausted all channels that you can independently use.

If you fill in your timeline, people could help you better (plus it helps others that come before you), but basically, they will probably start to pay attention to your file once you come close to being outside of the processing time and until the, there is little you can do. What was your initial NOA date/filing date? If you are already outside of processing, I would call and say so. If that gets you nowhere, then call and politely but firmly ask to speak to a tier 2 agent.

    I will tell you that they needed more time on my file which they told me about at my interview. I wasn't worried because it was a routine thing that needed to be done (an additional name check) but the officer did tell me that I should hear something in a couple of weeks. It took almost three months. And then, the week I would have been out of the processing time, I got a call from USCIS scheduling me for my oath that same week. I got the letter the morning of the ceremony.

  14. There seems to be some confusion .. here is what you need to send if you are filing independently (under the 5-year rule):

    All applicants MUST send the following 3 items with their N-400 application:

    1. A photocopy of both sides of your Permanent Resident Card
    2. Two identical color photographs, with your name and Alien Registration Number (A-Number) written lightly in pencil on the back of each photo.
    3. A check or money order for the application fee and the biometrics services fee.

    Send copies of the following documents IF THEY APPLY TO YOU:

    1. If an attorney is filing on your behalf, send a completed original Form G-28, Notice of Entry of Appearance as Attorney or Representative.​
    2. If your current legal name is different from the name on your Permanent Resident Card, send: The document(s) that legally changed your name (marriage certificate, divorce decree, or court document).
    3. If you were married before, send: Proof that all earlier marriages ended (divorce decree(s), annulment(s), or death certificates(s)).
    4. If you are currently in the U.S. military service and are seeking citizenship based on that service, send: A completed original Form N-426, Request for Certification of Military or Naval Service.
    5. If you have taken any trip outside the United States that lasted 6 months or more since becoming a Lawful Permanent Resident, send evidence that you (and your family) continued to live, work and/or keep ties to the United States, such as: An IRS tax return “transcript” or an IRS-certified tax return listing tax information for the last 5 years (or for the last 3 years if you are applying on the basis of marriage to a U.S. citizen), rent or mortgage payments and pay stubs.
    6. If you have a dependent spouse or child(ren) who do not live with you, send: Any court or government order to provide financial support; and Evidence of your financial support (including evidence that you have complied with any court or government order), such as: a. Cancelled checks; b. Money and receipts; c. A court or agency printout of child support payments; d. Evidence of wage garnishments; e. A letter from the parent or guardian who cares for your child(ren).
    7. If you have ever been arrested or detained by any law enforcement officer for any reason, and no charges were filed, send: An original official statement by the arresting agency or applicant court confirming that no charges were filed.
    8. If you have ever been arrested or detained by any law enforcement officer for any reason, and charges were filed, send: An original or court-certified copy of the complete arrest record and disposition for each incident (dismissal order, conviction record or acquittal order).
    9. If you have ever been convicted or placed in an alternative sentencing program or rehabilitative program (such as a drug treatment or community service program), send: An original or court-certified copy of the sentencing record for each incident; and Evidence that you completed your sentence: a. An original or certified copy of your probation or parole record; or b. Evidence that you completed an alternative sentencing program or rehabilitative program.
    10. If you have ever had any arrest or conviction vacated, set aside, sealed, expunged or otherwise removed from your record, send: An original or court-certified copy of the court order vacating, setting aside, sealing, expunging or otherwise removing the arrest or conviction, or an original statement from the court that no record exists of your arrest or conviction. NOTE: If you have been arrested or convicted of a crime, you may send any countervailing evidence or evidence in your favor concerning the circumstances of your arrest and/or conviction that you would like U.S. Citizenship and Immigration Services to consider.
    11. If you have ever failed to file an income tax return since you became a Lawful Permanent Resident, send: All correspondence with the IRS regarding your failure to file.
    12. If you have any Federal, state or local taxes that are overdue, send: A signed agreement from the IRS or state or local tax office showing that you have filed a tax return and arranged to pay the taxes you owe; and Documentation from the IRS or state or local tax office showing the current status of your repayment program.
    13. If you are applying for a disability exception to the testing requirement, send: An original Form N-648, Medical Certification for Disability Exceptions, completed less than 6 months ago by a licensed medical or osteopathic doctor or licensed clinical psychologist.
    14. If you did not register with the Selective Service and you (1) are male, (2) are 26 years old or older, and (3) lived in the United States in a status other than as a lawful nonimmigrant between the ages of 18 and 26, send: A “Status Information Letter” from the Selective Service (Call 1-847-688-8888 for more information).

    You do not need to send copies of your passport pages (they will want to see them at the interview) copies of your SSN card, selective service registration card or driver's license (though you can also take them to the interview). Because you are filing under the 5 year rule, you don't need your tax transcripts (though take them to the interview just in case).

    Basically, don't put too much paperwork into the N-400. Send ONLY what has been requested and gather everything but the kitchen sink as further evidence IF they request it. If you are eligible for citizenship, you'll get it. This isn't as complicated as some of the other steps.
