    Please advise.I am in a complicated situation.

    I applied for I 751 waiver (abuse). Divorce is in process.
    I believe I have a case with all proofs like, TRO, photos of injuries, stitches, abusive emails from my spouse, Phy evaluation, proof of medication etc.

    Honestly, I and my spouse loved each other, but things changed after marriage.


    Now, we are almost at the end of divorce process, my spouse keep calling me everyday to cancel the divorce.
    She keeps crying and convinced me that she realized her mistakes, she has changed after we separated.
    She do not want to miss me etc. She literally came to my work place and begging me to come back.

    I do not know what to do. Obviously, my therapist friends and family do not want me to get back.
    But, I want to give a second chance. 

     

    What should I do with my I 751? she is saying to file a joint application now (I am 2 months away from LPR expiration)
    Can I ask my atty to cancel existing waiver and can I apply a new Joint I 751 on my own?

    Or can I ask my atty to convert the existing waiver one into joint application?

    As It is a VAWA, only my atty can place a request to USCIS, I cannot do on my own.

    (I really dont want to take help of my atty, he did nothing for my waiver app, just submitted whatever I gave and changed me 5K)

    -Better to put Tax transcripts, you can get it downloaded from IRS website.

    -You can get affidavits form family members, not a problem.

    I am in a very complicated situation.

    I applied for abuse waiver. Biometrics done.

    My spouse already applied for divorce

    Now my spouse want to reconcile. Spouse is saying, she realised her mistakes and work out together.

    We were truly in love for 2 years, even I liked her very much and misses her.

     

    Now my question is, if we reconcile, how to handle my immigration status?

    Do, I need to withdraw my I 751 and file a joint one later? or  can I leave it as it is?

After that i got letter from them asking me to do my biometrics as previous one expired. Finished my 2nd biometrics on aug 10th. Now waiting for interview letter. Anyone knows how long it takes after the 2nd biometrics is done to the actual letter for interview? Thanks.

    Don't feel anxious. You should be ok.

     

    Just be prepare for an interview.

    - Spouse came to India, was physically and verbally abusive to me at my parents place in front of them

    - Underwent treatment for 3 months and was decided to come back to USA and give a try to removal of conditions

    - June 2016 I was back in USA with just 2 bags of my luggage standing at the airport with nowhere to go

    - Found a job, accommodation and a lawyer to help me with i751

    - Gathered all documentation required for ROC with my lawyer's support and gods grace

    - Filed i751 in Aug 2016 under extreme cruelty

    - Stabilized emotionally and physically

    - i751 approved in Aug 2017 without any RFE / interview

     

    All I want to say is life is unplanned, but as human beings all we can do is try. God is great and will make ways for us but the first step needs to be taken by us.

    - All your communications from USCIS will go to your attorney ONLY, until you change the attorney and notify USCIS 

    - All Abuse Waivers case are marked as sensitive case and thus no information about them is shared on phone call

    - It is your attorney's job to inform you of any communication from USCIS

    - The whole purpose of hiring an attorney is to have a professional trustworthy support system in this journey

  7. Any abuse/extreme cruelty waivers in this thread?

     

    I have a question.

    I applied for abuse waiver

    I never received my NOA1 or Bio metrics (ASC) appointment letter to me.

    Only my attorney recieved those 2 letters even I gave my personal address on I 751 application.

     

    I contacted Tier 2 reps via phone, they say I only need to mail the request to VSC, they cannot help me via phone.

    Is that normal that applicant will not get any notifications form USCIS, only Attorney does?

    How can I also get notified along with my attorney?

     

    Can someone please confirm.
