    I got my interview letter for ROC in March 2018, and my interview is in End of April. I Got married in Jan 2014. Got my GC in Aug 2014. My Spouse filled the divorce in Nov 2014, I have tried everything in my power to understand her concerns and make it a happy life with no luck. We got divorce in March 2015. It was a no contest divorce. For i751 ROC I have submitted the affidavit from my family and her family members total 3. Pictures, Joint account and all the relevant details. My packet was almost 200 plus pages. The marriage was bona fide, I was living a very successful life back in my country. I am still doing good and no criminal history. I have few questions below;

    - I just wanted to know if anyone can help me with some VDO clip which may guide the kind of questions I should expect or help me with my preparation.

    - Tentative list of question I should expect? 

    - What additional documents/ supporting material I should carry with me?

    - Also am I allowed to bring my mobile with me to the USCIS office ?

    - The day of interview what I need to do? Any do n dont's ??

    Every story is different. If yours is a bonafide marriage, you should be ok.

     

    They will allow your cellphone, but you cannot use during interview.

     

    Just prepare you story well, When you met, how you met, daily chores you guys did etc.

    Just submitted mine for the 3rd time! :wacko:  First time (sent March 7th, delivered 9th) I had downloaded the form beginning of December and then didn't even think to check again before filing in March and the form expired in mid December!  Sent the whole package back all pulled apart.   Resent it on March 19th (same day I got it back from USCIS) and was delivered on 21st, I received it back today 4/2 saying I need to include a copy of I-551 which is my green card and was ALREADY INCLUDED IN THE PACKAGE!  It was still in there when they returned it to me so they must be buying time or something?!  Resent today...third time lucky hopefully!  My green card expired on March 21st and I'm due to leave the country on vacation in 2 weeks....if anyone has any ideas how to speed this up..........????  Or whether it would be too risky to leave the country if I haven't received my NOA yet?   I can have my family post it to me once it comes for returning to USA....comments?  

    Is there a spreadsheet started for April filers?

     

    without NOA1 you should not leave.

Our California Service Center office will begin working on your case again. We will mail you a decision or notify you if we need something from you. If you move, go to www.uscis.gov/addresschange to give us your new mailing address. 
     

    You will get an update within 90 days.

    But yes, you are correct. He was married up to 2016, but did not tell me and I did not know. 

     

    Here is the correct sequence of events.

     

    • We met in 2008 in Thailand.

    • Decided to get married in and had a wedding in 2009 (Thailand), but did not do the legal paperwork (did not think too much at the time because we had no desire to go to USA even though he is USC).

    • Had our son in 2011.

    • 2015, I decide I want to go to USA for better life... I find out my husband still married

    • Summer 2016, he finalizes divorce with now ex-wife.

    • Nov 2016, we married officially in Thailand and do the paperwork to make legal.

    • July 2017, we ready and file with USCIS.

    • Sept 2017, I get green card and come to USA .

     

    We have been living together ever since we marry in 2009, to be clear so people don’t have to wonder if Bona Fide or not. Photos, financial stuff and of course our son, who is a USC because of my husband.

     

    I am not sure how you guys applied in 2017?

     

    Look like you are already married for a long time by that time. So, if marriage is more than 2 years old, you should have gotten a permanent green card.

     

    Anyways, I believe you only have 2 yr green card, be safe and apply for ROC yourself.

    Do I have to tell USCIS anything while divorce is happening? What if I move to somewhere else without him (should I update USCIS)?

     

    I have no friend or family here and have job, but not a lot of money for the lawyer I think. that why I ask online first. I know I need help so everything thank you. but do the divorce I think I need the lawyer and the I-751 too.

    Yes, it is the correct order as you have enough time till your Conditional GC expires.

     

    You dont need to update USCIS. But as soon as you change the address fill AR-11 online to update the address.

     

    For divorce, if its no fault and no much finances involved, you can just apply yourself by going to family court. There will be self help centers.

    For Green card, if you have all the proofs, it is very simple. You can apply your own. This form has lot of information.

    You should have many evidences as marriage lasted quiet a few years.

    No RFE's or anything like that. I did get the case transferred to local office Feb 25, Feb 26 then finally changed to Mar 5th. I also got a notice on Mar 9th saying my name and DOB were updated. This information is all from the my.uscis.gov website.

    You are correct. Even I heard VAWA rules apply for cruelty Waiver.

     

    Lot of people got approved, with short marriages if they have credible evidences.

     

    I am also in the same boat, waiting for the interview. Fingers crossed!

    thank you in advance for the support. I just signed up and I have to say there are a lot of interesting treads on here.

    I wanted to ask for some opinion about my ROC case through an I-751 waiver. I am currently being assisted by an immigration attorney. Below some details:

    - Same sex couple (two girls).

    - I am from France (I am the beneficiary). Living in LA 

    - Came to the US in 2014 with a F1 visa.

    - Met my wife in March 2015

    - Got married in January 2016.

    - Moved in together in February 2016

    - AOS interview / approval in September 2016

    - My wife (USC) moved out in October 2016.

    - I am seeing a psychologist once a week since September 2016

    - I am seeing a psychiatrist once every three months since January 2017.

    - Psychiatrist prescribed me antidepressant (SSRI) to treat my major depression since January 2017.

    - Family doctor gave me prescription to treat anxiety, panic disorder, and other depression/stress related symptoms.

    - I have about 5 people that will write affidavits declaring they witnessed the abusive behavior.

    - Other 5 witnesses will write affidavits only about the good faith of the marriage and confirming that we were living together.

     

    I have the following documents: joint bank account, joint debit card statements, joint phone plans, joint bills, both names on life insurance, joint lease agreement with both names and signatures, other documents like pay stubs and emergency contact from work stating married status and both our names, direct deposit for about half of the salary on our joint account. I have text messages, confirming abuse pattern. I have pictures with her and her parents and other family members. 2-3 trips in the US together. Chat history between me and her family.

     

    However I have no evidences (besides affidavits) for the courtship period. My divorce was finalized two months ago, so my lawyer is advising to check both boxes, divorce waiver and extreme cruelty waiver. This is because she thinks that with the luck of evidences for the courtship, I would have problem showing the good faith of my marriage. While with the extreme cruelty waiver, the evidentiary standard is different, because they would have to take into account "any credible evidence" for this kind of waiver. And the abuse would also justify the fact that we separated right after I was granted CR status.

     

    What is your opinion about this? Anyone went though the same process and had a short marriage like mine?

    Just my opinion.

    Considering very short time marriage, you need to be prepared for the worst.

    You need to justify abuse is really extreme cruelty.

     

    I have did lot of research,  and found sometimes in interview, officer will consider its just a 'mean' behavior, rather really abuse.

    I saw 2 cases like that.

     

    But just my 2 cents. I would just follow whatever lawyer suggested.

    Yes.

     

    Number on NOA1 should be on the Bio apt letter.

     

    Bio apt letter should have Bio receipt number - NOA1 receipt number.

     

    Its very strange you have 3 different numbers. There should be only two.

     

    I don't want to make you panic, but please check with USCIS.

    Look to the left under Case Type on the bio letter, and it shows I-751 - CRI-89 . . . right ?

    Then the two case numbers are listed a little  further over to the right.  The first is for the I-751 (which should be exactly the same as on your extension letter which is related to the I-751) and the second is for the CRI-89.

     

    That is correct for me.
