  1. Welcome, my fiancee will also be going through Mexico which means she will have to go through the Ciudad Juarez consulate (the only one that does fiancee Visas in Mexico). Here is a link: http://ciudadjuarez.usconsulate.gov/wwwhivfi.html

Juarez is unique in that there is no interview "appointment" for fiancee Visas. Once your petition is approved and you are notified by the consulate, you are permitted to come to the consulate for the interview.

This is how I got started with this site, go to the top of the Visa Journey home page and click on the FAQ and guides tabs, they are very helpful. I know it can be overwhelming, but once you absorb some of this info you will have a better idea of what to do.

There is a regional forum also devoted to Latin America, but I have learned much more from the forum that we are using now.

  2. Well, I called the USCIS today to find out where my petition was. I informed them that both the NVC and the consulate said the USCIS had it. So the person on the line checked and said they received it on June 12th. It took 12 days to get from the consulate to the USCIS. YESSSSSSSSSSS, at least now I know where it is! Sad, I'm excited about this. She could not answer any specific questions about the process.

The person on the line could not tell me much more than just wait for the notice to come and she implied there will be some sort of order to this mess which hopefully means the receipt date will be taken into account in this process. Of course, it is all speculation at this point.

    ;)

  3. Caladan, I agree with your train of thought.

Quote "There's a lot of fear-mongering going around, and the fact is, until a court challenge or a USCIS directive, pretty much anyone's opinion is as good as another and those of us going through it soon get to be guinea pigs".

The implementation of IMBRA now begins. Hopefully, as the process moves on more info will be dispersed to aid us all in our process. A calm and logical approach is best.

Thanks for the concise analysis.

  4. One of the bottom lines of this law is that someone somewhere sometime will have to decide which companies are classified as marriage brokers and which are not according to their interpretation of this vague definition. I wonder if this list is available for public perusal or if it even exists. It will be disappointing if it will be left up to the applicant to determine whether or not they used a marriage broker according to this definition without any assistance from our government in interpreting this law.

  5. That would be incorrect... the CBP system accesses the USCIS database once the passport and visa is scanned into their system. Name, DOB and Country of Citizenship is enough to pull the file..

Since the CBP knows that you have a tie to the US that could affect your decision to stay past your period of stay, you need to provide evidence of factors that would require you to return back to Mexico before your period of stay expires. Examples given above can help but are no guarantee. The final decision rests with the CBP officer...

Thanks zyggy - good to know for future reference. So Lewis, if you are driving across, it's no big deal if they turn you away. But if you are flying (which it seems you are since you referred to plane tickets) you gotta be prepared.

    Thanks you two!

Well, I can only try and see what happens. I'm the USC and I'm flying to El Paso and going through to meet her at Juarez. She is flying in from Guadalajara and she is flying back there after the trip. Our possible trip to Juarez will be in a taxi, I assume. It's beginning to sound like it's more trouble than it is worth due to the new complications caused by IMBRA. This was supposed to be our interview trip!

oops, I meant our "possible trip to El Paso" in the last post

  6. We are considering a trip to a restaraunt in El Paso from Juarez, my fiancee has a B1/B2 VISA. Does anyone have any experiences in crossing while their K1 application was being reviewed? Will it affect the process in any way?

I assume all we have to do is show evidence of returning to Mexico, which we can do with her plane tickets.

  7. I'm going to Juarez at the end of this month by land through El Paso and I'm planning on giving my fiancee a ring worth over $1000. Does anyone have a similar experience they can share? I belive I could possibly face a flat duty/tax of 15%, I'm not sure about this though. I'm also wondering if I need to involve a customs broker or not.

Unfortunately, this was supposed to be our interview trip, our I129F was even approved and sent to Juarez, but it was sent back to the USCIS along with all of the other ones after March 6th. We decided to do the trip anyway and we also plan to do the medical this time to get it out of the way. We checked today, the medical is good for one year. We will be staying at the Holiday Lincoln.

    Thanks! ;)

  8. Sorry about the messed up reply, I'm still getting used to the system. I was trying to say I'm greatly offended by the quote by A Man of Action,

"These people always thinking about laws and laws. VAWA should be named the Retarded Woman's Act (RWA) *laugh*"

What people are you talking about? Every society on earth needs laws or a form of rules to function effectively, including this board. What is the point of slamming a whole sector of society just because you disagree with a law? You are demonstrating a extreme lack of sensitivity to the board and to the human population in general.

I really don't know why you joined up, but I was under the impression that this was a great environment to share info effectively, peacefully and truthfully in order to make the K1 process run smoothly.

  9. There is nothing IMBRA 2005 states that is worth reading or replying.

IMBRA2005 believes the "if we can save at least one..." b.s. well...all can be saved by shutting the whole immigration thing down in the US and lots and lots of people will be saved. sheeesh. Stupid do-gooders.

IMBRA2005 quit trying to be the sugar to make this bitter IMBRA stuff go down easier. IMBRA sux! Plain and Simple. It is ridiculous and epitomizes the brainless who typically hold their 19th Century noses up at the commoners by doing them some good.

These people always thinking about laws and laws. VAWA should be named the Retarded Woman's Act (RWA) *laugh* As a group of 80 - 90 year-old ladies playing cards told me - who are these stupid females getting themselves into such situations and not walking or running away? They have no excuse if they can walk or crawl - what they are invalids? *laugh*

They said the people in the capital of Germany made many laws that were Good For The People; eventually everyone did not want to be good anymore. The ladies laughed and went back to playing cards.

Then a couple of them started to think and talk about a way to bring my love to me - around the US checkpoints...er...passport control *laugh* They had to do that back then, too. Little old ladies. IMBRA gonna stop [fill in whatever perceived method here] to [whatever feared results here]. Unlikely. The old ladies are already thinking of ways around IMBRA. *laugh* Such a nice Sunday afternoon.

  10. Welcome, I just joined a few days ago myself. Yes, I have found this board to be treasure trove of good info. It also helps to see that there are people that are sustaining a positive attitude during these difficult times.

  11. Spoke to Vermont today I used Igor’s method it worked! They told me that my case is under security check and that they are still processing march 6th applications. He told me to call back in 30 days and just keep on checking online :(

Sorry about that lost post, I was trying to let you know that I also used the same method and it worked. I also received the same message from the person on the phone, "keep checking back, 2-3 weeks"

  12. Thanks everyone for the kind welcome! Yes, I have checked quite a bit lately, it helps that I have a short break from my job right now. It's interesting to see how fast thoughts are spread on this forum. I'm in the same boat with most of you and hopefully they will let us know soon what the next step will be.

  13. Hello, I want to thank the board for supplying information and vital communication to the K1 community. I have read a bit of the IMBRA posts and some of the Juarez stuff as it relates to my case. I believe I was one of the 1100 petitions recalled after March 6th. Our petition was actually approved on April 6th and the consulate in Juarez called my fiancee on May 31st to tell us that it was being sent back. Interesting, 2 days before that I had booked the trip to Juarez for both of us! Well, we are still going but it looks highly unlikley at this point that the petition will be ready for the dates of our trip. I have spoken to all of the agencies involved (NVC, USCIS, consulate) and they basically have said they do not know much but things will happen soon, keep checking. I look forward to learning more about these issues and I hope to contribute in a positive way to this group.

    Thanks,

    Lewis
