  1. So what happens if Im not approved for the K1 visa by our wedding date (May 4th, 07) My American fiance is sponsoring me (Canadian) Our package was recieved on October 3rd, 06. Should we start making other arrangements for the wedding? It is to take place in NJ where she lives. Thanks. (The Vermont office is processing cases from 7 months ago right now.. and our wedding is just over 6 months away)

    What happens? You have to postpone it, just like we had to :(

  2. The best evidence is the person applying for a visa or for entry, how they present themself and how they present the reason for their visit. If things get to the point of examining documentary evidence of ties to home, the 'battle' is already lost.

    Yodrak

    I know it's possible for my fiance to come visit me here in the U.S. while our visa is processing. And i know what type of info. to bring to show ties to his country. But he does not own a house or pay any utility bills. He can bring paystubs from work, bank statements, and a letter from his employer stating when he will be returning back to work. Plus he'll have his return ticket for like a week later. Anything else that could be helpful?? I don't know if just that alone is going to work. We're gonna give it a try and hope we didn't waste a couple hundred dollars for no reason. Do u guys think we have a chance?

    :yes: Totally agree. I've visited th US a few times during the K1 process, and the only time I got denied- the first time- was the only time I was asked for that kind of documents

  3. I totally agree with you Ucla_cutie :yes:

    Waiting, if you can only afford one trip in the next couple of months - because of time, money, etc.- I would make it the trip for the interview. Just thinking about the interview makes me nervous, and I know I'll need all the support my fiancee can give at that time. And even if he can't be next to me, just knowing that he's close by will make me feel much better :)

    BUT, you can always ask your novio what he feels it's best for you guys. Maybe he'll feel better seeing you before the interview :)

  4. So here's a dance for every month we had to wait:

    :dance::dance::dance::dance::dance::dance::dance:

    OMG!!! Its about G-D time!!

    You guys have been the poster child of getting shafted in this unfair process. We're very very happy that you are finally getting free of the CSC black hole.

    Call the NVC at 603-334-0700 first thing in the morning and choose option 5 to speak to a person. You MUST speak to a live human! Maybe you will be luckier in the next step!

    We wish you many celebrations and happy dances in the future! :star::dance::dance::star:

    Thank you all!!! I've already asked my fiance to call NVC as soon as possible to know if they have our case already :yes:

    Thanks for the tip :thumbs:

  5. and that you may have to pay (for what, i don't know). can anyone who has been through it confirm?

    Hi,

    I haven't been through it, but from what I've been reading and from border-crossing experience, I can tell you that if your POE is a Mexico-US bridge you have to pay $6 USD for the processing of the I-94. They charge this fee for everybody that applies for one :yes:

    I hope somebody else who experienced crossing with a K1 can answer your other questions :)

  6. Ucla_cutie, I don't want to be an "aguafiestas" but... shoud we worry about USCIS not updating their system with our NOA2's? Are we supposed to follow up with them to make sure they do it?

    I would hate it if we had problems or delays down the K1 or AOS road just because these "sonsos" didn't fix their system :angry:

  7. Remember that the processing time is an estimate based on an average from people's data, and highly dependent on who fills out their timeline, subject to variation by outliers, and overall is just a rough guideline. With the latest batch of CSC-USCIS update problems and people only getting things snail mail (and hence not updating right away to balance 224 day outliers), it gets even more complicated.

    A jump of processing time in one day is not a trend.

    That's true :yes:

    You also have to keep in mind that 120 out of those 224 days the application was just "gathering dust" in the corner of somebody's desk due to the IMBRA law that took effect 3 days before USCIS received it. I don't think your cases are going to go through the same wait- I hope! - since they already have a system and the forms required to comply with the new law. We've seen this already with the quick 2-3 month approvals coming from CSC. So please don't get discouraged by what the timelines say, hey I had mine saying that our case could be approved as soon as July for 3 months!

  8. We FINALLY got the approval letter from CSC on today's mail - No on-line status change or e-mail but....We don't care!!!!! We are sooooo happy we would take the paper approval only to celebrate :dance::dance::dance::dance:

    I'd like to thank all of the VJ members- you know who you are- who gave us their support, advice, and words of encouragement during these last seven and a half months; it wouldn't have been the same withouth you (F)

    I'm crossing my fingers and hoping that the wait for our fellow Post-IMBRA filers who are still in CSC hell is not so long anymore, specially for Hornet and MrLonely (L) BTW, Sorry Hornet :innocent:

    So here's a dance for every month we had to wait:

    :dance::dance::dance::dance::dance::dance::dance:
