  1. Thanks! That is how I interpret this situation. I am also encouraged by the fact that USCIS informed me that no waiver would be required in my case. In any event, I plan on informing my fiance before the consulate interviews her. I don't want her to be blindsided and I want her to hear my side of the story. Additionally, my neighbor will be traveling to China and will meet with my fiance for the second time. He has first hand knowledge of what transpired and will vouch for my character. In the end, I think it will all work out. I just did not want and do not feel that it should be left to a third party to get into my personal business. This is something that I would have preferred to discuss with my fiance at a later date and in private. We have been together for almost two years now and have gone through a lot together. This is just another hurdle which we have to overcome.

    I believe a waiver is only needed if you also fall under the 'multiple petitions' categeory.

    i believe in this situation, no multiple petitions, the only action that occurs is the beneficary is informed at the interview.

  2. Afer my third attempt, I managed to get a live person at USCIS. I explained my situation and they told me that I would not need a waiver. I'll get the necessary documents and will subment them with my RFE. I'll keep everyone posted.

  3. This is my situation. In Feb 2003 I had an incident with my ex-wife which resulted in my being arrested to Assault/Domestic Violence. I know everyone says they are innocent and nobody wants to hear it, but it happens to be true. Anyway, it is something that I have to live with. In order not to go to trial and with my lawyers advice, I pleaded "No Contest". I paid my fine and did my community service. After completion of my probation and community service, the state of Texas dismissed my case which in essence means that I have "No Conviction".

    I received an RFE on Saturday and the questions was asked if I have ever been convicted by a court of law, etc. My lawyer says that I have no conviction, however today I went to a well respected immigration lawyer who says that the Federal Government still considers it a conviction.

    I have decided to check the block where it claims "Domestic Violence" and tomorrow I will get the necessary police reports and final judgements certified.

    My questions is, do I still need to request or seek a waiver?

    I've tried calling USCIS but got very frustrated with their electronic answering service.

    Any help would be appreciated.

    Question 1 on my RFE asks if I met my fiance through the services of an international marriage broker. I met Yang Bo via Cherry Blossoms. I emailed Cherry Blossoms a couple of months ago and their response to my question was somewhat vague. Any thoughts on how I should answer this question? :help:

    Did you pay $$ for Yang Bo's contact information (telephone#, address, email)? If YES, list Cherry Blossoms, check the YES box and give the address & telephone number to Cherry Blossoms. Sign the form, put the date, your email address and a daytime telephone number and return the IMBRA RFE.

    Cherry Blossoms is not free. If you're still "unsure", check yes, give the info and send in the RFE.

    That's the safest way.

    :( I wish we could get our RFE.......the e-mail notice came on the 16th saying they mailed it......and it's nowhere in sight!! I'm in Kentucky, but nothing in the history of the US postal service has ever taken this long to come from California. Well...it feels like it to me anyway :P
  6. Thanks for your response. She has told me that the father has not seen his daughter for more than seven months now. I think she has sole custody, but I will verify that information with her. Thanks again

    If your wife's daughter does not accompany her to the U.S., then the child's K-2 Visa must be obtained within one year of her mother's K-1 Visa. Then, once the K-2 Visa is issued, it is valid for 6 months.

    If she has sole custody of the child, then your wife does not need to have permission from the child's father. If she has joint custody, then a notarized letter from the child's father is necessary.

  7. RFE means Request for Evidence. In my case since I used the old I-129F form, they will probably want to ask me about potential criminal background. The RFE will specify what additional information they are seeking. The key is to get it back to them as soon as possible. Take care and good luck

    Just got touched again today :dance: Also received an email informing me that an RFE was mailed to me on 9/16. That was on a Saturday. Can't believe it! Mail has not yet arrived, but I'm hoping that I receive it today. :):whistle::D

    Well, at least getting a RFE lets you know they are doing something on your case, hopefully you can get it all cleared up quickly as soon as you get it and get it back to them. Good Luck to you and wishing you the best
  8. My finance is from China and she has a 4 year old daughter. I think that she is finally convinced that she should bring her daughter along when her visa is approved and not wait to bring her at a later date. I have already advised her that her daughter must leave China within the year after the K1 and her daughters K2 are approved. My question is regarding documentation for her daughter. Obviously she will have to obtain a birthcerticate along with the official translation as well as a passport, etc. She claims that she has legal custody so I assume she will have to present the custody papers along with an official translation. Does she still need permission of some sort from her former husband? :help:

    Today I got home from work and had 5 e-mails from USCIS all with this same message:

    On September 16, 2006, we mailed a notice requesting additional

    application during business hours.

    I assume this is probably for IMBRA, since they never sent me one. But I'm confused if this is for 5 different requests for different evidence, or if this is perhaps an e-mail program going for overkill :wacko:

    Has anybody else had this happen??

    Hey guys,

    I'm just here to gladly inform you guys that I finally got touched, after over 2 months waiting without any touches. I'm at work right now, and I decided to quickly check the uscis site to see if there were any changes, and I happened to see a change in the date from the last update, WOO HOO. I started jumping up and down, sorry guys but I'm soo happy to at least see that my petition hasn't been lost. WOO HOO CSC is finally doing something! Hopefully they do something about those petitions from Febuary through May that need to be approved. :D

  12. Wow! I am beside myself. Everyday I check USCIS online and I always see the same update status. Today I checked and I had to do a double take because I could not believe that some has finally looked at my package. Don't know what they did but it feels good to know that someone looked and that I am one step closer. :dance::lol::whistle: B) :blink: I'm going to call Yang bo tonight and give her the news

    OK! Its been a over a month since I last posted. I started a new job on 7/3 and I figured I would just try and be patient. Well, TCS received my package on 6/13, I received my NOA1 and when I checked online it indicated that my package had been forwarded to CSC and they received it on 6/30. Two months have passed since CSC received my package and not a word. I checked and it seems they are still working on cases from March 6th. Last update was 8/3. Is it me or is everyone else having this problem

    HELP!

    Would someone please explain to me how the hell do they go back from processing March 6th to Feb 23rd. What a bunch of pinheads. I we worked this way in my line of work, we would be out of business in a week. And to think that I have paid these people so that they can jerk me around. :angry::wacko:
