  1. Hi guys! My husband is going home to the Philippines this week. He's a conditional green card holder, we arrived here October 2016. His father has stage 4 lung ca and he would like to visit him for 2-3 weeks. Will there be any problems when he goes back to the US? Does he need to file anything to make sure that he can get in again and if he's a conditional green card holder, can he leave the country for 2-4 weeks or do we have to wait for his conditions to be removed before he can travel? Thank you for any input!

  2. Hi everyone! My husband and kids moved here in the US last October, my kids and I are USC and my husband is a conditional green cad holder, my kids and I might move back to Manila because I want to study again and my kids will be studying there too. When my husband has the conditions of his green card removed, will it be affected by the fact that i am in Manila? Even if he will be visiting us frequently?

  4. What exactly did you send the first time?

I sent in my CRBA, US Passport, Driver's license, marriage certificate.

I sent in their passport with the stamp, their state ID, birth certificates and their social security cards..

Did you submit your original CRBA certificate or just a copy? Seems to me they want the original document plus a black and white photocopy.

I submitted just the copy. Could that have been the problem?

  5. ~~moved to US citizenship discussion from general immigration~~

You are the USC? Did you send their birth certificates? Are you all in the USA now? Are they LPRs?

Hi! Yes I am the USC mother. My husband is also here in the USA with them and they are all LPRs. I just dont know what to do from here. It's frustrating :(

  6. Hi everyone! I have petitioned my kids aged 2 and 4 and they are now here with me in the US with their Dad (my husband). During the interview we were told that they are automatically US citizens under the child citiEnship act. I applied for their US passport but I got a letter after a month asking me for more documents. I have attached a copy of the letter here. When I submitted the form I included my CRBA, US passport, driver's license and all other documents that show my US citizenship. Now Im torn on what to do. Any advice would be greatly appreciated!

  7. Hi everyone! I petitioned my kids and they're currently here with me in the US already. They didn't automatically get citizenship thru me because of some residency requirements. However, I was told that they are covered by the child citizenship act whic automaticall makes them a citizen once they get here, this is why I didn't pay the green card fee anymore. They live with me and their dad, which is my husband. All requirements are met so I thought everything was okay. Today, I got mail that says something about notice of action, I thought I didn't need to pay for the green card since they are automatically citizens already. I applied for their US passports already although I am still waiting for it. I don't know what to do now.

Do I still need to pay the fee? I'm just worried that they won't fix the papers unless I pay the green card fee but I also don't want to shell out $300++ if it isn't needed,

  8. USCIS does not adjudicate passports -- that's done by the Department of State through one of the passport agencies. They aremuch more familar with the requirements of the Child Citizenship Act. Apply for the passports. Be sure to include copies of their green cards or I-551 stamps.

Thank you very much! Will do that instead!

If they arrived on immigrant visas and are in the custody of their USC parent then they are USCs now.

    Apply for their passports.

Thank you! Is that the rule even if I wasn't able to stay in the US for a year continuously?

Is the man you married, the biological father of your kids? And is he the US Citizen, or are you?

Yes he is the biological father. I am the US citizen. They're here under the Cr1 and cr2 visa.

  9. Hi everyone! I have a question, my biological kids aged 4 and 2 arrived in the US last week. I want to file a US passport for them but accdg to the person in USCIS said they don'5 qualify for that because I wasn'5 able to stay in the US for a year continuously so even upon their arrival, they won't qualify on the Child Citizenship Act of 2000. Upon their interview, I was asked to fill out the I-864W checking that they automatically become citizen thru that act. I am now so lost on what to do :(

  10. Hi everyone! My child will be going back to the US with me and I was just wondering if I still need to file for the certificate of citizenship for them or if I can just go ahead and apply for their US passport? The fee for the certificate is a bit high which is why I'' wondering if I still need to file that. They didn't automatically become US citizens because of my residency issues but they are US citizens once they enter the US because of the child citizenship act. So what's the best way to go once they arrive in the US?:)

  11. hi

yes, that's incorrect, unless it was your child from a previous marriage and was his stepchild and not a biological child

the petitions should have been separate, and as a minor child of a USC he should have been given the first category

now if he was a biological child of a USC, why was he petitioned in the first place, why wasn't he automatically a USC?

I wasn't able to meet the residency requirement that's why they didn't automatically become a USC. What should I do to have it corrected? Their visas are already with me. Would it matter if they're IR2 or CR2 when I'm applying for their US passport? Now I'm really confused on what to do.

  12. hi

the certificate is optional, a lot of people just get the children their US passport as they are deriving your citizenship

but if you want, you can file the N600 for each of them

now why did he get a CR2 if he is a child under 21 of a USC, he should have gotten IR2, not a conditional card

I was actually thinking the same thing. They originally got the IR2 but the pre-screener changed it to CR2 during the interview because my marriage was less than 2 years accdg to her. Does their visa classification change anything?

  13. Hi everyone! I have a question regarding my son's visa. He has a Cr-2 visa and we were required to file the I-864W stating:

1.b. I am under 18 years of age, unmarried, immigrating as the child of a U.S. citizen, and will automatically become a U.S. citizen under the Child Citizenship Act of 2000 upon my admission to the United States.

So what forms do we need to fill out once we get there for me to file for their citizenship? And what documents should I bring?

I'm just preparing whatever requirements they'll need to avoid delays. Thank you everyone!

  14. Yes. Same case sakin. I was 13 when my dad passed away, my Mom filed for the CRBA for us. she just needs proof of her Dad's residency in the US, citizenship and kailangan iprove nya na anak talaga sya. Kailangan din may proof na magkasama parents nya nung nabuo sya. Nung nagfile kami we submitted around 20 binders of evidence kasi mas mahirap iprove pag wala na yung tao.

For the child I don't think mapapasa nya ang citizenship dahil nung nangnak sya di pa sya US Citizen.

Gaano katagal nagstay ang Dad nya sa US?
