You have on your timeline that you received your RFE June 23 and returned it the same day. So I'm just a bit curious, what day CSC accepted your RFE?

  5. I just spoke to a friend (who just recently got married after getting his fiance a K-1 visa earlier this month) and he's from Vermont. Needless to say, his K-1 package went through Vermont. He went to high school there and he told me he used to date a female that works at the USCIS. Actually, he used a more graphic word but...at any rate, he says that the female told him that they've been working a lot of overtime because they have been handling some of CSC's K-1 workload. She told him that they haven't advertised it, but they have been busy trying to pick up some of the slack and handle their own workload.

He also said he'll call her this week and get some more info from her. Just thought I'd pass this along. I used to be stationed with this guy, so I know him well. If anyone has any general info they'd like to know, maybe I can get him to ask a specific question or two. Any suggestions?

Maybe I can give him my case number and see if she can get it transferred to Vermont. :D

I'd love to find out WHEN the petitions were transferred and if the petitions transferred already had their RFE's sent and received at CSC, because we might be able to tell by touches if ours were transferred.

  6. Thanks! I should at least let them know the plight of our situations and not my particular case cuz the faster CSC approves everyone else... the faster they will get to my case. That works out for everyone and you know that strength comes in volume. The larger the voice... the more likely we are to be heard.

I'm in contact with my senator & a May NOA1. I agree, the louder, the better.

I agree too. I contacted my congresswoman not necessarily about my case although I did have to include that information, but about the non-movement and backlog at CSC. I asked since they had all this extra work with the IMBRA law and the transfers from the other service centers if they had added extra staff to accomodate the workload. I think bringing this information to their attention could only help all of us. Her aide (who is very nice and helpful)did look into it and while she didn't answer all my questions in part she did say this:

"Further info... The I-129-F petitions subject to IMBRA are those received March 6,2006 and later. They will be placed in line for processing as soon as responses to the RFEs are received. Processing expected to take 30 to 60 days after receipt of RFE response."

We can only hope that is true. But at least CSC knows there are people looking over their shoulders.

  7. Just wanted to share that I had contacted my senator and was referred to our congresswoman. Her aide checked with CSC and while I don't believe from her response that she understood exactly what I was writing about this is her response in part:

"Response from California Service Center is that this case was affected by IMBRA only because of the date it was filed. They acknowledge that the RFE has been received and state that the case will soon be pulled for processing -- although they can't give me a timeframe. I have been asked to check back in 30 days for status and will do just that. I will keep you informed.

Further info... The I-129-F petitions subject to IMBRA are those received March 6,2006 and later. They will be placed in line for processing as soon as responses to the RFEs are received. Processing expected to take 30 to 60 days after receipt of RFE response."

  8. For what it's worth I had written our Senator and asked if he could look into the situation of IMBRA implementation, if there were now guidelines to implement it, etc. and if they had hired extra staff to handle the backlog at the CSC. In part this is what he replied to me:

"Because your concerns fall under the jurisdiction of the federal government (U.S. Department of Homeland Security), I have forwarded your concern to your federal representative. I hope that you will be hearing from her soon.

Again, thank you for contacting me. If I can be of assistance to you at the state level of government, please feel free to contact me."

So I don't know if he was just passing the buck or our representatives are the ones who handle these kinds of matters. But at least I received a reply.

  9. I don't know ANYTHING about this so please be patient. I've heard somewhere that you can apply for a work permit when you get your K-1 visa from the consulate, is that true? Because with the K-1 visa if you have the work permit you can work during that 90 day period, married or not, right? What is the best way to go about getting a work permit and having it ready for when my fiancee can come here? Thanks for your help!!

  10. Hi everyone,

I got touched today and this is what it said:

"On July 5, 2006, we received your response to our request for evidence or information. However because preliminary processing was complete, the remaining processing time will be less than the maximum stated in this message. You will receive a written decision on this case. You can use our processing dates to estimate when this case will be done. Follow the the link below for current processing dates."

Anyone have any idea what this means. In particular what does "the remaining processing time will be less than the maximum stated in this message." I looked and looked, but there doesn't seem to be a time stated in the message.

At least it is moving along.

We received the same message today! The timeline that was given in our receipt letter referred us to the USCIS website: uscis.gov for processing times, which says they're processing K-1's received February 15, 2006. Oh well, at least somethings happening now!

  11. Just to share.....I phoned USCIS yesterday to ask about which mailing address to use, either the P.O. box one on the RFE or the overnight one. The lady, who was very nice, said that it should be sent back to the address listed on the RFE. Also according the USCIS website, it says to mail it in the envelope provided with the RFE or it could delay processing, well there wasn't one provided with mine, is that the case with everyone???? In regards to that, the woman checked with someone and told me to include a letter stating that an envelope was not provided for the return mail. Seems ridiculous but I did it, don't want anything to delay this.

  12. Do you guys think the petitioners will receive only these documents to provide their criminal records or a whole new I129F will be needed later on?

Actually it all seems to be an excercise performed by the goverenment without any direction. The form they are drawing up would seem t6o be unnessary since immigration does an FBI check on all US petitioners. They have the information already so why waste time on the form?

I may be wrong on this but I looked up the IMBRA law and what I think I understand :) is that it was made to protect women from violent men using Marriage Brokers. From what I understand men petitioners using a broker are the ones affected by this law. The official title is "To regulate international marriage broker activity in the United States, to provide for certain protections for individuals who utilize the services of international marriage brokers, and for other purposes."

I phoned USCIS and spoke with a officer who said that there are no new I129-f forms, so the ones I used off the USCIS website was good, the public would be notified when there were new forms. He also said that they do all their own background checks there, so there would be no need for a form to be filled out. After looking into this I felt better and don't feel that everyone will be affected by this other than in some extra time to fix the ones they need to.
