  1. Hello there.

My wife is just filing her 2015 returns as married seperate. On the NVC wiki, it says:

"Filing MFS (married filing separate) will probably be the easiest for most people as it doesn't require any extra documents from the foreign spouse, nor does it require their signature. On the tax return, where it asks for the spouse's SSN, you would put 'NRA' for Non-Resident Alien. Continue filling out the rest of the return as normal. That is all you have to do."

However on the IRS website,it says we must apply for a tax code instead of a social security number...

"If your spouse is a nonresident alien and you file a joint or separate return, your spouse must have either a Social Security Number (SSN) or an Individual Taxpayer Identification Number (ITIN). To get an SSN for your spouse, apply at a social security office or U.S. consulate. You must complete Form SS-5. You must also provide original or certified copies of documents to verify your spouse's age, identity, and citizenship. If your spouse is not eligible to get an SSN, he or she can file Form W-7 with the IRS to apply for an ITIN. Refer to Taxpayer Identification Numbers (TIN) for more information."

Can anyone shed some light on this?

  2. I haven't seen her since November. It's very hard. I can't imagine how you all feel when it's been a year apart. I think it's especially harder at USCIS stage as it's a long time of not hearing anything. At least with NVC (if it all goes smooth) you're updated more and little milestones (payments, send packets, go for medical, interview, wait for passport) are all much closer together.

  3. No live trace means there are offences on record but they've been downgraded. Call NVC and see what they can do for you. They're (usually) very helpful. If you don't get anywhere with one agent - just hang up and speak to a different one.

Also, as you have No Live Trace on your certificate, you'll need to order a subject access report to show the officer at your interview. It's £10 from the ACRO website. Good luck mate!

  4. Counting down the days to my interview on the 19th February, just lots of checking and rechecking to make sure I've got everything I need. Got my train booked for the night before, and am staying at the Belgrave House Hotel, not bad for £32!

You must be well excited. I'm bad enough just seeing that one of my fees at nvc has been processed. Good luck!!!!

  5. is it possible that you're a victim of identity theft in the UK ?

i suggest you review your work history report and your tax filing reports (whatever these are called in the UK) plus any council flat engagements/records and health service records.

Hi Darnell, how's life in Houston? I'm.moving there myself. Do you have a truck? I did all that after you mentioned it, I hadn't thought of that. But its all fine, it's a weird admin error.

Email below I got from them though, check this out. But if they can't change it, I'll just take this email to the interview as Nich Nick suggested.

  6. I am from the UK and got married on ESTA. Came back and filed i-130. It takes about a year (although mine seems to be going much quicker). I was totally honest with them at the border about my intention.

Maybe just take a letter when you enter USA confirming you're doing a degree, just as proof you are returning to the UK. Although I was never asked for anything like that.

Oh and good luck, very exciting time in your life.

  7. Hello. We are just at NVC now awaiting the IV fee to be made payable. Things have really moved forward to last few days, but the more they do, the more I'm worried about things going wrong.

I'm getting worried about a couple of incidents 11 years ago when I was 18. It asks on the Ds260 if I have ever been arrested/convicted. Obviously I will answer yes.

I have one caution and one arrest. The caution was for stealing a couple of books from the bookshop I worked at. The second time was related to this, I was arrested for defending myself against my uncle who was annoyed at me getting arrested for stealing the books.

Could these really effect the process? They were so long ago I'd more or less forgotten about them.

    Thanks. Ian.

  8. I know how you feel mate.... i cant wait for us to equally get our Case# & IIN. Cant wait to Live England (cold weather) and be with my Wife in Texas (Sunny weather). Hopefully NVC goes a lot quicker

I wasn't expecting the case number either. On Friday, The guy told us to call back in two weeks. We ignored him, called today and they had the number. Really you need to persist with NVC rather than wait for them.

Nice to see another English guy moving to Texas. We are off to Houston once it comes through. Good luck mate, looking forward to see how you get on.

  9. Well. Today things seem like they're moving along at last. My wife called NVC on Friday and he told her to call back in two weeks minimum. Well, we are impatient people so just called today not expecting anything at all. Turns out they gave her the case number! Thank God we ignored the guy. So we filled out the ds261 and paid the aos fee just now . I haven't seen her since November 21. Tough. But exciting times. And as if today couldn't get any better, I saw gardening legend Alan Titchmarsh in M&S simply food. He was buying yogurt.

  10. My subject access report has come back saying I was born in Cape town. I have never been there, why would it say cape town? I was born and raised in Yorkshire. I watch emmerdale. I drink Yorkshire tea. I moan about everything. I am from Yorkshire.

Adding to this my fellow immigrants...

I have two previous convictions, nothing major. One time I stole a couple of yoga books from a bookshop I worked at and was cautioned. I hid them in my trousers and they were so heavy that my pants fell down in the high street. Just my luck, two plain clothed coppers were stood behind me when I pulled them back up. The price one pays for not having a belt eh.

The next day, I got into a fight with my uncle because of this. Although in reality, it was more because he was pissed about getting fired as an extra on ITV's Heartbeat. They charged him cause he is a fat drunken pig, but released me without charge. So that's one caution and one arrest 11 years ago when I was 18.

    So two things bothering me.

How do I change my place of birth? I have contacted acro and west Yorkshire police and the police keep forwarding me to this other department and they won't respond. Acro have gone as far as asking me to stop contacting them.

Secondly, will these two offences (despite being minor and 11 years ago) effect the process?

I'm just worried something is going to come and ruin everything. I have a job in USA from the second I am legally allowed to work there, everything seems to be falling into place. I want to move to Houston with my wife.

    I want a family.

    I want the American dream.

But most of all, I want unlimited drink refills in restaurants.

    Thanks for your help.

    Ian.

  11. I have recently been reading the forums and have heard this maybe a problem?

Right now, my petition has been accepted and we are at NVC. We really front loaded the petition with evidence. We are similar cultures and background. The biggest difference is music tastes to be perfectly honest!

Will this cause much of a problem at the interview, will the officer need more proof?
