  1. I so feel you pain. It's all BS that they suddenly lose your docs. When we called this morning to confirm if they got round 2 of my BC, we got rep Joanie; so rude and unfriendly! Did you get an email after you were told about your checklist? NVC issued our checklist on March 3 and still no sign of email or regular mail. She had the audacity to be annoyed with us emailing the doc when they still haven't, until today, emailed us and she admitted to it. Don't wait for the letter. Mail your docs asap.

    My wife got through to Joanie too. I don't know if she's stupid or rude. She kept telling my wife to send court records even though I've never been to court, even when my wife explained there is no court records. Anyway, my new scan date is today.
  2. Oh no!..... I thought we will be riding together.... and NVC could not have got the check-list out any sooner. What a waste of time. Just go get a letter from the nearest Police station.

    I hope we don't get a check-list neither. My nerves are cracking rite now...

    You'll be fine buddy. I thought you only needed court records if you'd actually been to court, not proof you hadn't been to court. Just a tiny thing and means we will have to wait about 30 days. We are both gutted. My wife sent off my subject access report to them already though. I didn't think they needed that until the interview. Also, they didn't send us a checklist, my wife phoned them today and they told her.

  3. Hi mate, I don't have as many things on my record as you. I have one caution for theft and arrest for a fight. Both in the same week when I was 18. I have obsessively researched this, and here's what I've found... f#ck all. It's such a grey area.

    I used to think that moral turpitude was that smelly ####### that was used to clean paint brushes. And to be honest, I still haven't got the foggiest what it means.

    I know if you have one minor conviction, that can be waived under the petty crime rule. After that... who knows. And it's unfortunate that you can't find out whether something will make you inadmissible before applying.

    Get some legal advice.

  4. my spouse has not recieved anything from the nvc, no forms or affidavit to fill out, is that because i have not submitted the "DS-261" yet?

    Fill out the ds261. Don't wait for NVC for anything. It's Upto you now. After you've filled in the ds261, call nvc and ask them to process it over the phone. Pay your fees, send the aos and iv package to them. Once the payments say "paid" in the online portal, then it will open up the ds260 for you to fill in. NVC will email you when they have received the documents. Then... You wait for them to review everything and schedule your interview.

    just came across your post and thought i would reply to you on my experience with this.

    I have no live trace on my police certificate too from a shoplifting incident when i was 14 years old. I ticked yes on the DS-160 to 'have you ever been arrested?' because i was, even though it was a reprimand, it was still an arrest. As you were possibly a minor at the time you shouldn't have any problems and also since it was so long ago!

    Though, I would recommend getting a Subject Access Report which shows exactly what the crimes were and the actions that were taken. I feel like this helped my situation to show the age, the crime and the action that was taken. They can take about 40 days to arrive so would move quickly if your interview is coming up shortly!

    I know that one crime of moral turpitude as a minor falls under the exception - which still makes you eligible for a visa. So the stealing of the books won't be an issue and your arrest doesn't sound like a mortal turpitude crime.

    The best thing to do is be honest about the incidents. I even wrote some additional comments explaining how i was an impressionable teenager and it was so out of character for me to do such thing. Although this wasn't needed at the interview, i think it's something to have at hand if things turn sour.

    Maybe prepare yourself for ESTA questions but you should be fine.

    Thank you so much Charlotte. That helps tons. I think in situations like this, where it means alot, the natural thing is to worry that even the smallest thing could ruin it.

    Thankfully I was honest on the Ds260 and admitted to the arrests and such. I doubt they will be an issue. Now I'm just waiting for nvc to complete my case.

  6. Hello all. I just read that if you have been convicted of a crime then you need all the court records about the incident to bring to interview. I've only ever been convicted one time of a minor offence. But I was given a police caution and never went to court. Do I still need to get a record of the crime from the police station, or is the subject access report enough along with police certificate. Police certificate says no Live Trace by the way.

  7. Is the child a US citizen? I feel like there are some details missing with regards to that.

    Does your wife have sole custody without visitation rights? If so, you can get an American passport without the other parent's consent. I've done it myself.

    Yes the child, she is a U.S. citizen. She hasn't been back to the UK since leaving as a toddler. I hope she still qualifies for UK citizenship as she did have a uk passport. I know you don't automatically get British citizenship these days by being born in the UK. Not even having a British father is enough especially as my wife wasn't married to him when she was born too.

    She has contacted the UK passport office so we will see.

  8. Hello, I know this is US immigration forum. However, I felt you might be able to help with this one. It's a tad complicated.

    My wife's daughter was born in the UK. British Dad. But she left with her mum when she was 2 years old due to him being abusive. Her mum is obviously an American citizen. My step daughter did have a British passport as a baby but it expired when she was 5. Unfortunately, he is very bad. He hasn't seen her since she was a toddler and is using the need for him to sign as a power game and he wont sign the passport renewal. So I believe she can't get either an American passport or a British passport. Is this correct? Is there anything we can do here? We have looked at stripping his parental rights and me adopting her but it's a long long process and extremely difficult to do.

  9. After you come here and receive SSN - refile an amended tax return as married filing jointly. In most cases a sizable refund will be the end result.

    Thank you Cyclone. That's good to hear. Filing married separate she has $960 to pay. If we'd have filed together, she'd have got 5k back.

    So, would you mind advising what documentation I need to bring when I move to USA to adjust to married jointly? My employment in 2015 was all over the place - I was made redundanct twice and did a ton of ####### jobs to keep things ticking over.

  10. Our wiki is pretty well maintained by experienced members on this website. The USCIS and sometimes the NVC, especially the phone lines, are often known for the misinformation they give.

    Agree with that. I've been given much more accurate and better advice from members on here and the wiki than from the nvc call centre. One time, the guy at nvc told us to call back after 3 weeks to get our case number. We ignored him, called back the next day and they had the number.

  11. I think you might be psychic nich nick. That was the problem, she couldn't enter letters on the ssn part.

    I'm not really understanding how you're working without either a SSN or a ITIN in the first place. It's outright illegal, even if you have your work authorization card, to work without registering and paying your state, local, and federal taxes on your wages.
