  1. Wishing you good luck the second time around. I think frontloading the I-129 was a smart idea. We did that as well. My husband is now here with me. Just curious because he also is from a remote area of Brasil. Which state does your fiance live in?

    my fiance is from Para.

    I am back in business - the first petition is reaffirmed and on the way back to the consulate. Does anyone know if it has to go thru NVC again.

    Yes, I know I have a second petition pending. We are currently trying to merge them

  2. The old petition has already expired. Trying to appeal a K1 can take months if not more then 1 year.

    I am aware of that he will get denied anyway since he was EWI but I want them to approve our relationship at this point so I can go ahead and file our waiver.

    Audy_Rob.. I dont appreciate your statements... why would you even say something like that.

    Ofcourse my evidence will show up in Brazil - I added it to the new petition. :bonk:

  3. Front loading for the interview does not work. You guys see what happend to me at the first interview. They did not look at anything.

    So I figured we put everyting in the packet so they have it infront if them - this was the advice from our attorney.

    And fyi Brazil does not sent out packet 3's.

  4. Yes we did talk about this.. but I decided to go the way that we started.

    My fiance lives at a very remote location in Brazil so getting there to get married right now would be very difficult. It would take 3 days for me just to get there.

    I just started a new job around Christmas and already took time off to be at the last interview.

    Since the old petition is now "expired" we decided to refile another K1.

    There should be no reason for them to deny him now, they have an entire suitcase of evidence in front of them.

    What if they refuse to look at the application ? Do they actually go thru the application at the interview ? I dont remember.

  5. my fiance said he !@#$ up the interview by talking to much. I told him to short and brief, dont be talking them an ear off. If they want to know more they will ask you another question.

    He pretty much said.. that I have my dual citizenshp.. that I cant not live in Brazil and thats the reason he wants to come to America. He just was not thinking before answering and wa just blabbering.

    I hope this is not marked in the records.

    So now I added ALL this evidence that they did not want to look at in the petition. That way they have it right infront of them.

  6. Believe me.. I had everything... From every call I made to Brazil, to boarding passes... to our checking account together, transactions in Brazil, lots of pictures, our life insurance policy. This is the proof I brought to the interview. They did not wanted to look at it.. saying we dont have a valid relationship.

  7. I was at the interview with my truckload of evidence that nobody wanted to look at.

    We been together going on 2 years. He lived here in America, until July 2009. I have been to Brazil 3 times since then and one trip lasting 2 months. His english is so so, enough for us to understand eachother..and I also attempted to take portuguese lesssons.

    The weakpoint was he talked to much.

  8. Since we got a denial at our first interview in Rio de Janeiro we refiled last week.

    Check has been cashed so NOA1 is on the way.

    What can I expect at the second interview ? We originally got slapped with a 212(A)5(A) supposedly our relationship is not valid but we been together going on 2 years.

    Will they ask him even more questions ? Will it be even more difficult ? Has anyone gone thru this ?

  9. FYI. My fiance just had his interview in Feb. and I went and paid his Visa Fee near the consulate at a Citibank.

    Its cash - and cash ONLY. I know is says on the instructions you can use your creditcard but you cant.

    I confimed this numerous times cause I was standing at the bank and I could use my ATM card to get my money out.. forgot my pin.. what a nightmare.

    So be prepared to have cash on you when you go to city bank.

  10. As of now, I still dont have my petition back here. The NVC has not gotten it, USCIS does not have it.... its out there somewhere. I called, nobody knows where it is.

    Now, my petition expires on April 11th. We have decided we want to refile. How soon can I do this ? Can I do this now, will it cause a confusion at VSC since in the computer I still have this one saying approved.

    This is what happend to me today when I called USCIS.. they are asking me.. Whyyy do you want to withdraw if you have an approved I-129F out there. They did not get the part where I explained, its being sent back and I said it twice.

    Anyway, is anyone out there experiencing the same situation. Did you refile, withdraw any tips I would appreciate.

  11. Here we go again, thought I was done with all these forms but now I may have to do a refile.

    I downloaded the new g325a from USCIS. The last time I had to submit 4 copies of this. Has this changed ?

    So I pretty much just hav eto sent the g325a to my fiance and the letter to intent. Thats all he needs to sign at this point ? Right ?
