  1. My husband is in the same boat but we are on day 152. We are on service request number 2 now... first 1 went full 30 days with no updates and we have contacted our local congressman. It has been a full week since we got them involved and there is still no movement.

     

    We are trying to schedule an info pass appointment but the website currently seems bugged.... at a loss of what else we can do.

     

    My husband does have a job offer, but the company doesn't put them in writing (to my knowledge we will double check as it is a national chain store). They asked him to go for drug testing. Is he able to complete that step without EAD in hand?

  2. So another update finally! After our initial rejection notice fiasco, we finally got our EAD and AP acceptance notices this morning!!!

     

    Now we are just holding tight for what we assume will be the inevitable RFE for the AOS as they don't have my original I-864 as it was lost in the mail.  We will have delays, but at least we are moving forward!!!

     

    For those of you who have done Biometrics, was your sponsor required to be there or were you able to go yourself. I don't have the luxury of a lot of time of, so if I am not required to go with Jon that would be best.

    That envelope is mainly for making sure your RFE is returned to the correct mailing address. You don't need to put your papers in it at all. In fact most people don't. Just make sure you have your cover sheet that was sent back on top of everything you send back and that you send it to the correct address on the RFE and you are good to go!

  4. So sorry I haven't posted any further updates on our fiasco, but here is our latest update.

     

    When we called USCIS way back on May 8th they told us that one of two things would happen after half our rejection packet was lost in the mail: 1- they would send another rejection notice and we can send the whole thing again at once. 2- they would accept the I-485 sent by itself and eventually send us an RFE for the rest of the information.

     

    This morning 05/26/17 Jon finally got a ONE text and email for his AOS and nothing with regard to EAD or AP (which makes sense since we got this back 3 days later with no instructions on what to do). Now Jon is calling USCIS again today to see what we do... hopefully we don't have to file for them separately and pay the fees for those.... keep your fingers crossed for us.

     

    At least his Green Card is being processed... I am just waiting for the inevitable RFE that at least we have everything ready to send back.

     

    Pray for us please! ><

  5. Congrats to everyone moving forward!!!

     

    We found out last night that half of our rejection notice got lost in the mail and we just got the rest back today AFTER we already sent back all we thought we had too....

     

    I am calling them this morning to see what we should do and we already have a new fully completed packet ready to resend...we just dont have the huge green sheet to put on it since we already sent that back!!!

     

    Fingers crossed it's an easy fix, but I somehow doubt i!

  6. We regretfully got an I-797C rejection because I forgot to check our I-485 form before sending and I sent out the old form ><. We did mail it back on Tuesday with the correct form and saw that it was available for pick up to the PO Box that was on our rejection notice.

     

    I feel so silly making such a simple mistake. Here is to hoping we are only a week behind everyone else for my silly mistake O.O

    5-) is there any sample i 131 for k1?  I have  seen on visa journey but it is confusing. What should I say to day to intent to departure. I am not planning to send my wife to Turkey before we get the green card but just in case if there is an emergency. What should I do?

    You don't have to put any dates if you don't have any plans, but most people just put a random travel date in. They don't follow up on if you go since things do come up that could cause travel plans to cancel.

     

     

    Also, as long as you are married in 90 days you do not need to file i 130 right?

    Correct! Just make sure to file BEFORE your 90 days are up as well!

    Hey guys.

     

    I am sending the docs next week.  I have some questions to ask.

     

    1-) Did you guys sent any photos or proof of evidence of the marriage. I have heard some folks send the photos with them.

    2-) Is there any 2016 cover letter. I am using this cover letter. Is this okay?

    3-) I am sending the ds 3025 vaccination form that we got the copy of at the U.S embassy. ( No need to do medical and pay the fee as far as I know.)

    4-) What is the process times of k1 to aos? I have seen 12 months or so. Is that normal.

     

    1. I didn't send any photos from the marriage because we hadn't gotten them back from the photographer yet. If you think it will help I would send them, but per the instructions they are not required.

    2. That cover letter is just fine. Just make any adjustments you need for any documents you add (like photos)

    3. All I sent was the DS 3025 so we shall both see if they RFE us, but a lot of recent users have had no issue with sending just the 3025 as long as your medical was within a year.

    4. The times seem to be anywhere from 6 months to a year based off the other filing progress chains, but I would review those to get a better idea or the timelines available on the forum.

  9. I just updated my name after our marriage. I know that ours was here in the states, but the Social Security Office has the same rules. You need to bring your old Social Security Card with your original name on it, a  copy of your marriage certificate (which you have), the application for a new social security card found here: https://www.ssa.gov/forms/ss-5.pdf  and they asked me for one other identity item so I just gave them my passport which had my old name in it.

     

    I do know that you MUST change your name with the SSA BEFORE you change your driver's license. It takes 24 to 48 hours to update in the system before you can get your Driver's License. If you can make an appointment because the wait can be bad. I also heard that Mondays tend to be the worst for the SSA office wait times so I would go a different day if possible!

     

    Hope this helps! Good luck and I hope you don't have a long wait! Also, that link I gave to the form shows what is required for the name change on it so make sure you have that. It was pretty easy!

  10. The DS 3025 is the form the people at Knightsbridge hand back to you once your medical is completed. It is imperative for your AOS that you get BOTH pages back from them before you leave. The added a second page that has a statement that basically says you got your immunizations needed for immigration. 

     

    If you don't get this back there is a possibility that you will have a headache when filing for AOS later on. The DS 3025 can be used in place of the I 693 as long as you file for AOS within 1 year of your medical (which most of us do), but a lot of UK filers have had issues with RFE's for their DS 3025 from Knightsbridge without that second page. (some have still had it even with the second page... it seems to depend on the adjudicator you get)

    Jon lands on Tuesday... I am a bit nervous with the immigration climate we have going on, but we did everything the right way so I know I don't need to worry... but part of me still worries a bit!!! Fingers crossed he has an easy time going through customs on Tuesday!!!

    I am again very sorry to hear about the denial. I read a bit more about what you sent and what happened in the separate post you made. My best guess as to what may have been missing was more evidence of your INITIAL meeting while you worked in the US. It is much harder to prove this as you were here and he was here already so you would not have things like boarding passes or passport stamps for the initial meeting.

     

    If/When you decide to reapply I would recommend writing them out a timeline that they can easily follow. This is something that I did and I think they found it very helpful. An example of what to write could be like this:

     

    We first met while I was working in the US as a nanny for (family's name) on (date you first met) at (place you first met). We talked a few times and decided to make our relationship official on (date). At this point we had had many dates together at (list some places you have receipts for) on (dates). After my work for the (family's name) was completed I returned home to England on (date). At this point (fiance's name) flew over to spend time with me and meet my family on (date). 

     

    This is just an example from your side as the beneficiary which you can provide, but what may be better would be to provide the statement from his side as he is the petitioner with an example like this:

     

    We first met while (your name) was working in the US as a nanny for (family's name) on (date you first met) at (place you first met). We talked a few times and decided to make our relationship official on (date). At this point we had many dates together at (list some places you have receipts for) on (dates). After her work for the (family's name) was completed she returned to her home in England on (date). At this point I went to visit (fiance's name) in England to spend time with her and meet her family on (date).

     

    These are just examples. I would make sure to include the cities where you were at and went. The more information you can provide in this statement the better as well as the more information you can provide to prove it the better! I am so sorry I didn't more information about your RFE when you received it. I would have provided you all this then to try and help. It has worked for many others in the past.

    That is the automatic notice that they send. The RFE reply goes back with the Blue paper which tells you exactly what they want back. If the additional evidence was not requested on the official RFE paper that gets sent back with your reply, then it is not needed. It is a bit confusing, but you can always call USCIS just to confirm. They can look up the RFE and clarify for you!

     

    Edit: No you do not have to send a police record for the US citizen. They will verify when your petition enters the vetting process. The only time you need a police certificate is for the foreign fiance for both the Medical and Interview that are overseas.

  14. Yeah I would go ahead and try having David give his local congressman a call to see if they can help find more answers. They should have responded to your RFE a long time ago. The average wait on an RFE is 2 weeks. They do have 90 days like I stated, but they are now over that as well. Usually having the congressman's office call them helps give the USCIS the kick in the pants it needs.

    I could answer more accurately if you filled out your timeline, but yes you can look at their website to see which month they are currently working.

     

    There is a time frame of 5 months that CSC puts for completing K-1 Visas. The website states they are currently working on cases from August 16, 2016. They are usually well beyond this as you can tell from our progress report forums here, but this does give you an indication of when you can get your local congressman involved in your case.

     

    If you received your original NOA1 before this date then I would give your congressman a call and speak to their immigration services to see if they can get you a more clear answer if you don't hear soon.
