  1. Hi i applied for f1 visa , while my i-130 is still pending (filed by my sister on my behalf), and got denied. Any suggestions will be appreciated.

    Vo: why do you want to go to US ?

    me: to earn my masters degree in computer science.

    vo: did you applied to other schools ?

    me: no i did't , but i have researched few schools like Princeton university and university of san-fransisco.

    vo: why did you selected this university ?

    me: this program is unique as its mixture of theory and practical, also block system is very unique as i will have to study only one course in a month.

    vo: why not doing ms form your home country ?

    me: the programs offered here are reasearch oriented, but this program is unique in a sense that it focuses on practica aspects of computer science.

    vo: i am sorry i can't issue your visa today, you are disqualified under section 214(b)

    (hands me over yellow paper describing 214-b, he didn't even asked for any document)

    Do you want to know why they refused you ? There is a straight red flag in your case. one can't file for a non immigrant visa while a petition for an immigrant visa is pending.Now, were you know aware of this when you filed DS-160 ?

  2. you need to official change your address with the USPS, you can do it online. cost like 2 bucks.even though USPS suggests to change your address with any govt. entities you have been expecting mail from. they will still forward your mail once you have changed the address. by the way, do change it officially with USCIS as well

  3. i got mine in a week.i had to fill a form at 1441 Rue Saint-Urbain, Montréal, QC H2X 2M6, Canada. it was quick and easy and says the police record do not have any adverse info about the person. hope it will help

  4. Hi everyone,

    My mom recently was denied for a B2 tourist visa the third time. She's currently 57yo living with my dad and my younger brother in Vietnam.

    5 years ago, she applied tourist visa to attend my graduation in the U.S and was denied twice (once with my dad and brother; once on her own).

    She applied again last week to visit me and my husband alone (as I am having our first child soon) and was denied again but not very clear reason.

    She already retired but have saving, some retirement money, houses and some money from house-renters. The interview was easy and she was not asked to show any documents.

    There are 2 things I am not sure if that affect the denial decision. Last month, my brother was applying for a student visa to study English during summer and was also denied.

    Also, my 2 year green card is expiring in July (same time as she plans to visit before my delivery), and I am applying to remove my condition on green card. I think that would lead to her visa denial.

    Do you think she would have a better chance to get visa in about 6 months after I receive a new green card.

    I hope someone can help me what we should do for her next attempt in 6-7 months.

    This is how her interview went:

    Interviewer: Why do you want to come to the U.S?

    My mom: I would like to visit my daughter and her husband. (She didn't mention about my pregnancy - although I did send her letter of invitation saying about that and my doctor's letter)

    I: How long will you stay in the U.S?

    M: I'll stay about 3-4 months.

    I: What's your job?

    M: I used to work as... but now I am retired.

    I: What does your daughter do in the U.S?

    M: She works for... as...

    I: When did she come to the U.S?

    M: She came there in 2009 to study.

    I: What does your son-in-law do?

    M: He does ...

    I: What does your husband do?

    M: He was... but he's now also retired.

    I: Did you travel to any foreign country?

    M: Yes, I traveled to Thailand last year.

    I: Who will pay for your trip?

    M: I will pay for my trip (although I put me as the person to pay - as I'd like to pay for her).

    I: How will you be able to pay for you trip?

    M: Both husband and I have retirement salary, we also have saving account, and income from renting one of our house.

    I: Do you have 2 children? One in the U.S and one in Vietnam?

    M: Yes, I do.

    I: I am sorry we cannot approve your visa this time. Thank you for coming.

    M: Thank you!

    Please help! Any opinions would be appreciated!

  5. Hello everyone, I registered here because I red online that this is the best place to get honest information about all kind of immigration cases.

    I will try to write my story in short text and my main question is do I need to get a attorney/lawyer for my case?

    I came to USA in 2010 with ESTA waiver from Lithuania. My father lives illegally here since 2000. My waiver was only for 90 days and I overstayed my visa.

    A year ago I got married to an US Citizen. I'm 24 years old she is 23 years old. We want to get me a green card. I went to couple places and one place wants to charge me $3000 for filling everything+coming to interview and another guy ask $1900 but he isn't even attorney he just has an agency that does lots of stuff.

    By looking online and emailing these two persons I collected a lot of information and we got almost all papers ready. We brought all papers to one of them but then decided to take it back thinking that we might try by ourselves.

    Please if someone were in the same boat as me and did everything by themselves please share the information with me and help me out. I live in Hamptons NY thats why all legal services are sky rocked in pricing. I understand that doing everything by ourselves will take more time but hey I've been illegal here for 5 years. I can wait another few months or more. My main question would be if we make a mistake somewhere or we miss our on a document how complicated situation could get? And if we messed everything up could we just get a lawyer then to help us out? Again, I came here under ESTA Waiver for 90 days. My wife don't make enough so we will have a joint sponsor. Which exact forms I would need to fill? I would really appreciate some feedback on procedures and step-by-step information on how we could work it out by ourselves.

  6. We just received our ROC approval today, and we (my wife is green card holder) are moving to this forum for the citizenship process. We can't apply until end of September this year but my first question is: does citizenship approval process also require all the same type of evidences as the ROC process did such as: financial comingling etc? Just want to know if we have to continue to be so thorough and vigilant with all these financial documents, or does the agency finally believe that we are a real couple lol?

    yeah, a little less. i always say a ROC is usually the final hurdle. N400 usually goes smooth. btw you guys are not new to the process. you are almost there

  7. Ah yes of course i understand now.

    In my mind i was thinking if my case is fine my i-94 is taken because i wont need it anymore as i would have a grencard no reason for it.

    But if my case could not be approved shouldnt i have been left with the i-94 as i will need it to proove my legal status as a F1 student

    Valid I-94 does not solely prove legal status for someone on F1. Valid F1 and SEVIS does.

  8. Hi everyone,

    Im just curious when a IO takes your i-94 at a greencard interview does it mean anything imparticular?

    Im in limbo right now as im atill waiting for my infopass apt. I made a topic of my situation already.

    Basically i applied for AOS on a F-1 , did fingerprints, interview went well the IO said everything was fine, no flaws no discripancys. And i should get a decision within 90days.

    My PD was not current at the time of interview but it is now( i filed due to the new filing dates in october 2015)

    Few days later i got a denial notice and it had no reason as to why i was denied i believe it to be in error and spoke with two lawyers who believe the same.

    Made 2 service requests on NVCS and still havent heard anything.

    But any input would be great, will i recieve back my i-94 since the application was denied?

    They cancel your B2 (if that is the one you used to enter) which ultimately voids the I-94.

  9. Hello, to whom have been through the Naturalization process.

    I am wondering whether one can get the naturalization certificate on the day of Oath, or this certificate will be mailed to you later?

    Also, it is true you can apply for US passport at the spot of the Oath ceremony?

    I am also wondering whether different field office treat cases differently, could you kindly leave your field office info?

  10. My B2 visa application denied because of my previous fiancee visa question i mistakenly answered incorrect because i forgotten already.

    Call me Khandy my nickname. I am working in Malaysia and i tried to apply aUS tourist visa but i was denied. My interview was yesterday only dated 27th April 2016. I was not late but many applicants on ques that day. I was confidently i can answer all the questions. And yes, i answered everything except for the last question :(

    The questions are:

    Where are you going to US? I answered accordingly

    What will you do at US? I answered accordingly

    Who you are going to meet? I am going to meet my friend

    How did you meet your friend? I met him in Malaysia

    I answered all with confidently and i smiled.

    Okay good. Last question.

    Who is Richard? I was shocked like i had slip of memory and questioned myself who is Richard? lol then in myself i remembered he was my ex-bf Chinese American who was applied a K! visa for me but i did not pursued the application. He visited me in Philippines that i forgotten already for 8 years. And now it was like a ghost coming back in my mind. We had no communications after we had broke up since that time he was going to marry someone else after our relationship.

    Consul asked me if someone applied a US visa for me and i plainly answered it NO. But he asked me again and then i just told him Oh i thought that was expired or cancelled because that was Richard had told me before. Then the consul said "yeah, i am asking if he applied a visa for you? I don't know what to say, i can't explained everything to him. I was trying to remember him just to answer the question. And the consul told me "Okay, i will give you a second chance, Is he applied a visa for you? I was ###### up answered him NO still. :( and then finally he told me I am sorry your application is denied. I replied "Oh". I felt sad taking my passport and i even hardly took my passport in the window because of my wrong answer. Then i say Thank you to the consul and went out in that window. Sigh...i messed up. I was thought i can get that visa.

    Now, i want to re-apply again this coming month of May. Please i hope you will help me about my case. That K1 visa that was applied from my ex-bf in US embassy, i did not pursued after i received the letter from US embassy in Philippines. We had misunderstanding and we broke up.

    Sorry to break this but you will not get a B2 in the future after looking at the sequence of events.try to look other legal ways to migrate if interested.

  11. significant amount of money , i do not think so dear. i do not know a lot about greece and how its administrative services work.assuming there is not a lot of red tape involved in the process, it can be done fairly simply without spending chunks. Your representative does not need to be a lawyer. it could be anyone designated by you to speak on your behalf to the local police station.you two might have to prove to the police that you are the people you are actually claiming. i come from a third world country which US recognizes as a high fraud country.if i needed this, there is a lot of red tape, harassment and corruption involved. assuming it will be little less in greece (even though greece's economy is falling down exponentially,which encourages corruption), you will be able to do this fairly easily.

    I am a Spanish highly educated executive with 15 years of experience that want to work at USA but I have some doubts about the procedure, I hope someone could advise me.

    I have been looking for the visa that best fits my profile and I think that H1b temporal visa is one option, and EB2 permanent one is the other option.

    But in order to obtain any of them I need a job offer first, so, the employer ask on my behalf for the permission.

    So my question is: what should I do first? Look for a job or try to get a visa?

    Assuming answer is look for a job, that really means look for a sponsor, how realistic is to really get that someone “wait for you” and “make all the paperwork” for you instead hire a visa holder person.

    Finally my question would be, do you think is better or not to hire a immigrant attorney?
