  5. Hello everyone!

I was off from the forum for a while, as now I am spending a month in the US with my handsome as a stress relief :)

very happy for all of your approvals, visas and reunions! I am planning to join your club soon!

The embassy finally received our case from NVC on Dec 16th - after 1.5 months it was sent out from NVC. So you can see that the timing varies from case to case.. I was about to freak out, but it seems it is moving again. Hope they have dates for interview avsilable in Jan-Feb..

Merry Christmas to all of us!!

  6. Hello all!

I am very glad some of you already got the visas!!

    Congrats to everyone!

My case got stuck somewhere... Called NVC and they said they have sent our case out on October 29th. I emailed the embassy again (3rd time already) and today they still don't have out papers yet. Nearly a month!!!! As I see most embassies got the case in 3-7 days, why ours takes ages? Rrr

So me and my fiance decided to leave it for now as we can't make it till Christmas with my schengen visa as well. Next week he is moving to Boston, and as soon as he is settled, I will arrive there to spend the holidays together :) Luckily my B1/B2 is still valid!!

And then back in January to finish the whole thing. Hopefully, the embassy will have my case by then, haha. NOA2 is valid till Jan 29th, we should be good.

Good luck to all of us still waiting for some stuff!

    xxx

  7. You may be one that "hiccuped" the status and it may be still at nvc or still in transit. Just as an example of what I mean, mine showed correctly from "at nvc" to "in transit" but then it went straight to "ready" the next day or so even though it had just been sent to the embassy. The tracker stayed showing "ready" even though it hadn't been received yet by the embassy. The only thing that changed is the status updated date and it went from the day they sent it out to today's date which is when we received packet 3.

Ours is also ready since even earlier. Today my fiancé called to the consulate in Warsaw and they also said they had not received it. I'm hoping it's just a glitch. On the up side, it looks like the wait for an interview is currently around 5 days.

My fiancé called NVC yesterday to ask. They said they have sent the case on October 29th already and advised to be patient, it should be on the way. The DHL website shows it was delivered on November 2 already, but apparently we shouldn't trust that.. Why to have all these stuff just to complicate people? Weird! Rrrrr

I decided to calm down and wait another week. No choice anyway.

5 days seems very good! Hope it will stay like that till Christmas!

Good luck and patience to everyone!

  8. Even if you owe zero taxes, one must still file something which proves that, unless he was under the minimum amount for which no filing is required.

Usually they suggest the past three years copies of the full return filing or the tax transcripts free from the IRS and proof of current income...the latter is the key.

Thanks a lot! Now we have something to do before the interview!

  9. Thanks, guys.

I have read your answers and checked a few more topics on VJ and see that my fiance needs to file the taxes.

Sometimes he was out of the country for the whole year (12 consecutive months) and should be exempted to pay, but I am not sure about his last year. I will pass the info to him.

Will you advise for how many years of his tax info we should have for K-1 and later for my AoS and so on? For 3 last will be enough?

Not sure about his "tax guy", but yeah, apparently he is no good :)

  10. Is he a US accountant familiar with US income tax laws? If he is a US accountant, then he sucks.

US citizens are required to file US tax returns on their worldwide income even if nothing is earned in the US.

The US tax return requirement is due regardless of whether a person owes taxes or not. Even if he doesn't have to pay, he still needs to file. To get the foreign income exemption, he would need to file.

He is familiar with tax laws, but apparently not much! He said Justin's case is something special he hasn't dealt before and he is not sure what has to be done.

Well, we will investigate ourselves then and sort it.

    Thank you!

  11. This is from the IRS website and may apply in your case.

However what I didn't investigate is whether or not you have some sort of annual filing requirement even if you fall within the exclusion requirements. That you'll have to investigate yourself. Don't forget that you may still have to pay some taxes, maybe just a reduced amount. And, if you find out you did owe some taxes for previous years, then contact the IRS and they will work with you to get those paid; they are ammendable to payment plans. Again, if you did owe some taxes, you must pay those. Ask Al Capone how it went for him when he didn't pay anything !

    Thank you for information!!

Not sure now whether he is exempted from paying the tax...

I will pass it to my fiancé, hope he will sort it out!

  12. Hello guys!

    Hope you can help.

I am waiting for the interview for K-1 visa and have a trouble with the financial paperwork from my US fiancé. The thing is that he is working on a cruise ship contracted by UK company and pays no taxes. His tax guy says that as far as he makes money from outside the country (the UK) and is out of the USA for the most of the year, he doesn't have to pay the taxes.

Any ideas what kind of paperwork we can submit at the interview instead of these tax papers (W2 and 1040)? I will have his bank statement, employment letter and Affidavit of support. Do we need anything else?

    Any advise will be appreciated!

  13. I'm so sorry to hear that! So frustrating. I think things will go quicker soon.

My fiancé was going to have her medical exam in Minsk and interview in Warsaw. She already has a Schengen Visa and I am thinking it might be easier and faster to do both in Warsaw. We have to decide soon as our case became ready at the consulate in Warsaw today. I hope things move smoothly in Warsaw.

    She sends love from Brest.

Thank you for support! The medical in Minsk is not too bad, I have done it already. The only problem for your fiancee would be that she will have to travel from Brest to Minsk, so its up to her where to have it done. If in Warsaw, just make sure she has all the vaccinations, in Minsk they asked me to do it (I had to renew one) asap and didnt give a certificate until I have done. So it took a few days for the whole thing.

Everything will be fine!! I try to keep positive :)

I am sorry!! But at least you're almost at the final stage!!!!!

    Congrats!!

Thats true! A few weeks is better than a few months anyway! When I think that my petition could have gone to Texas, I am grateful and happy :)

    Will sort it out!

  14. Got an e-mail today from the consulate in Moscow. They are transferring my papers from Moscow to Warsaw for interview. The thing is that for Belarusians is always everything complicated, as our Minsk consulate is not working on all types of visas. So you never know which other one will process it. NVC sent it to Moscow, but they don't do it for us((

Now it will much more time, as I need to get also schengen visa first just to be able to go to Poland, haha))

2 interviews for 2 visas, how nice is that? Rrrr, angry!!! :ranting:

  15. Oh, the 160 form online can be filled out no and saved? If you don't have your NOA2, can you still fill it out, or do you need to enter that in?

Is it the beneficiary who fills it out?

It is the beneficiary who feels it out, but there will be a few questions about the petitioner as well, like job and home address.

You will need your receipt number from USCIS, starting with WAC or smth like that. You should have it from your NOA1 - it says your receipt number! Its not the one from NVC.

You can save the form and use it again during 30 days, or make changes.

  16. Guyyssss!!! *_*

My interview is: November 18!!! I am so happy!!!

I wish you all the happiness of this world. You will be with your dear love soon. Keep faith!

Oh wow!! I am happy for you! :)

    Thats super great! Fingers crossed!

    You will be together soon!!

Question: did the embassy sent you an e-mail or letter to ask you for packet 3 or you sent it yourself when the status showed Ready?

Mine shows ready for a few days already and dhl says delivered, but no news. :(
