  1. Here are the quick facts...

    Husband is US Citizen

    Wife is Canadian Citizen

    We married in 1996 in Canada

    Have 3 US Citizen children born in USA (wife flew over to USA for each delivery and did not overstay)

    Filed for I-130 which is approved.

    Filed for K3 visa which is also approved and passed interview and have valid K3 visa in passport.

    Wife moved over to Florida from Canada and is living here with husband and 3 kids.

    We thought it would be quicker and cheaper to file for immigrant visa in Montreal instead of doing AOS in Florida so we filed immigrant visa and it is in process still at the NVC

    We have now realized that our city is doing AOS very quickly and we don't want all of the extra expense and travel back and forth to Canada for medicals and interviews etc. (It is very tough and costly with 3 infant\toddler children)

    We would now like to STRONGLY consider just filing the AOS here locally in Florida and waiting it out in the US rather than back to Montreal for immigrant visa.

    Can we do this?

    Would we just go ahead and mail in the I-485 paperwork and fees and wait until we get a NOA for it and then call the NVC up and tell them to cancel the immigrant visa processing as we have decided to go the AOS route ?

    I know it would mean that we would loose all our immigrant visa fees we paid and that we would need to pay new AOS fees but TRUST ME, that will be cheaper than us flying around with all the kids and the hassle involved would be crazy.

    It seems too straight forward and easy from our research and we just wanted to running by everyone on the forums to see if we are missing out something or if there is anything of importance we should carefully consider before moving forward and mailing in the I-485 stuff.

    Thats a lotta information .. The part i do know is that if your wife is in the USA with a valid K3 visa she can do AOS .. you should read the guides they are a big help ..

Each person ( Adult & Child ) need seperate I-485 packages .. but Children under 14 don't need to include G-325A and with the childrens application a copy of the I-864 ( filled out for the spouse with the children listed ) is all thats needed. As far as interviews i have no idea .. as we are not there yet ! but a few days ago we got letters for our biometrics appointments for the same date and time for all three of us ( children go only for pictures ) good luck ! :thumbs:

    as for you taxes, you can file your taxes as married filing separate and this way you would not have to wait on his SSN

    I'm almost 100% sure that even if you do married filing seperate the spouses SSN# is still needed ... on the other hand you don't 'have' to wait .. you can fill out form W7 to get an Individual Taxpayer Identification Number (ITIN) for the spouse or dependants without a SSN# and attatch it to your return .. You can't e-file though .. you have to send it in the mail ... The IRS was really helpful on the phone answering questions for us.

  4. Vancouver is a beautiful city ! You should go check out Granville island and Gastown (The Old Spaghetti Factory) .. there is so much to see it's hard to think of just a few things. The aquarium is kewl if your into that ... a hike up Grouse Mountain ( or a skyride ) .....an IMAX @ Canada place and next door @ the Pan Pacific the resturaunts have killer food and a beautiful view of the water .. The Capilano Suspension Bridge is awesome and the art gallery .. ect ect ect .. Great place to explore ! Good luck @ the interview .. :thumbs:

  5. I have signed up for a belly dancing class :dance: as well as a jewelry making class ;) . I have always been curious about glass blowing , hey, maybe I will try that B) . I wil need to load up with lots of activities. :whistle:

    If you like making jewelry .. and your interested in glass blowing you should investigate Lampworking ! It's a way to make glass beads by hand with a special torch.. I have been a lampwork artisit for years and years .. there are lots of kinds of glass but my Fav. is Murano (Moretti) You can also learn to blow glass with the same torch and a few other tools .. As far as the constant case checking ..... i think we are all guilty ! Hang in there ... :thumbs: ...... I think i might have to try belly dancing !!

    Oohh, I wish I was, um, sufficiently artistically inclined for that kind of thing. I adore glass, and Murano glass in particular. I'm worrying about how I'm going to get the stuff I have (not much of it, but bought when I reallllly couldn't afford it) over to the States... lampworking sounds great, I'd love to learn how to do something like that! :)

    You really can get started and learn the basics of lampworking for fairly cheap .. the glass is not expensive @ all .. and you can get a torch ( hot head ) for pretty cheap and usually a few lessons or else a good book .. or a dvd ( visuals help me ) of course you need a few other things as well But all in all it's not too bad ... If a person was to get more serious there are way fancier torches and tools .. and of course a kiln to anneal the beads .. but if your just learning it can be a pretty thrifty hobby !

    I'm really tempted to find out more now... I always had glass work down as a very expensive hobby (and I'm trying to save money... then again, I never go out, so...!), but I might well look into it now. Thank you! Did you make the beads in your avatar pic?? If so, I'm very impressed! :)

You don't really have an " actual interview " .. you get called to the window to give them your paperwork .. they take it and you go pay the fee ( down the hall ) then you sit back down .. they call you back to the window and take your fingerprints .. then you wait .. ( i assume @ this point they are looking over all your paperwork ) they call you back to the window for your " interview " .. they ask a few questions ( or a lot of questions depending on the circumstances ) , ask to see some pictures ( or other proof of relashionship if they want it ) ect ect .. everyone can hear everything they are saying to you and everything you say to them ... it's all fairly odd ! But it's no big deal in the end .. Good Luck :thumbs:

  9. When they took my paperwork from me in Vancouver they asked specifically for the most recent tax return , work letter and bank letter .. When you get there they give you a handout .. it's an order they want your paperwork in before they call you to the window. Keep in mind that one of the Emails Vancouver sent to me told me to bring 3 years tax returns along with the affidavit ... BUT @ the actual interview they only took one .. and when i asked why i was asked to bring 3 and they only took one .. the lady said it's up to the caseworker if they want to see the others ... Best of Luck @ the interview

  10. I actived my Visa in Blaine .. They were super nice, they just took our envelopes ( mine and my kids ) chatted a bit .. the two guys @ the counter made jokes and laughed with the kids .. They took my fingerprints .. put my I-94 in my passport .. payed the fee ( i can't rem how much ! but cheap .. less then 10$ ) They didn't ask about our stuff in the car or look .. they didn't take us to a room to wait .. like i have read happens @ some POE's .. we just stood @ the counter and that was it !
