  1. Just curious, how long does it take after my wife's AOS approval does it take to get my 12 year old step-daughters AOS approved?

    It's impossible to say how long your daughter's AOS might take .. My son's AOS was approved the same day as mine, but my daughters wasn't .. It is all surrounded by so many sets of circumstances and paper pushing .. my daughter was approved today so lets hope this is a good sign and yours is coming soon !   2. YAY :dance: My daughter has been approved too .. no more waiting for all three of us !! Odd though that my son and i got the Current Status: Notice mailed welcoming the new permanent resident Email the other day .. And my daughter got the Current Status: Card production ordered Email today ... I wonder what exactly is the difference or if it's just a different person putting info into the computer or what .. Anyone know something i don't ??

  3. Just wanted to add a short note.

    I know this situation may sound a bit confusing to some, but make no mistake about it, errors by the USCIS are quite common. Our daughter, a K2, had her AOS denied only because we did not send an I-693 Medical Examination as requested in the RFE. The reason we didn't send it, is because it's not required to do so as per USCIS instructions; SEE THE QUOTE IN MY PREVIOUS POST.

    After the USCIS received our reply to the RFE, with a letter clearly articulating that our daughter is a K2, an officer denied her AOS simply because all items were not provided as per the RFE; Catch 22.

    Yes, piss on them and their ignorance and rude disregard of the emotional impact of their error, and the extra work created for us to correct it.

    It's baffeling the large number of USCIS employees that don't know the difference between a K1, K2, H1b, or any other visa type.

    I would make an INFO PASS Appointment As soon as possible !! I'm not sure exactly what can be done but maybe this can be fixed .. Good Luck :thumbs:

    It's impossible to estimate how many people get approved without an interview, every case is different. NOBODY gets approved without an FBI name check !! Again impossible to say how many people get a green card before they get an EAD because every case is different .. Getting a green card before EAD seems to be a trend .. but nun of us know for sure who that will happen for and who it won't , there are VJ's who have had to renew EAD's because they are still waiting for final approval for AOS .. You can find hints by watching what happens to other VJ'rs, but VJ only represents a small community of people .. you can also search the timelines for information

  5. What a way to wake up ! I crawled downstairs this morning to my computer to check my email ( because i broke my ankle on Wed. ) The entire time i was thinking i will have crawled all the way down here to read the same case status message .. But instead i found a big surprise :dance: I just wanted to say a HUGE THANK YOU !!!! to everyone for all of the support and help we have found on VJ over the last year ... My son and i have been approved .. now we just wait for my daughters approval. I wish everyone waiting the best of luck and our hopes that all will be approved soon !

    it's 2 weeks and half ago that our case Was transfered to California now and We did not hear anything Yet from them ...Juste We receive in the Email Saying that our case was transfered to CSC and We was Wondering Why We did not receive the notice of action in the mail and We was juste Wondering how much Time it Will Takes...

    Well it was about 7 days after the transfer Email that we got another case update saying our case was now pending @ CSC .. and about 10 / 14 days to get the NOA in the mail .. keep in mind though i have read about people waiting months to hear anything after getting the transfer email... I hope you hear again soon .. :thumbs:

We got an RFE for my daughter and they asked for pay stubs from my husband ( sponsor ) for the last 6 months .. and an employment letter ect ect ect ....... and his IRS transcipt / copy of his taxes we sent the first time showed he makes WELL over the amount needed .. So who knows what the ryme or reason to any of it is .. I think it's just random paper pushing Cr*p ! All we can do is give them what they are asking for ..

  8. On the affidavit of support form i had my wife file as the sponsor and my mother in law file as the joint sponsor....

    My wife is just finishing up with college and only does horse riding lessons on the weekend to give her a small income. She does not earn enough to file taxes and therefore we explained that the first time.

    Now the RFE's are back and they request fair ol' bit, including this years tax into (which we are waiting on coming back).

    The real tricky issue is that they want my wife tax info and evidence of self employment. Well my wife can get a letter from the lady whose children she gives horse riding lessons to, however she has never filed taxes and she has never made enough. Do we just sent a letter explaining that, anyone got any advice?

    Well .. the best i can say is send them all that they are asking you for in the RFE .. as not sending it can be grounds for denial .. I think if your wife doesn't file taxes you do need to write a letter explaining why that is .. An employment letter from the lady whose children she gives lessons too would be helpful as well i imagine .. I'm sure there are people who know more about this exact type of situation and maybe then can be of more help .. If you really are lost you can always make an info pass appointment and talk to someone about it. Good Luck

  9. Just a note. I did not complete section seven where you list assets if you fall below poverty guidelines. I was RFE'd for it even though I am well above the guidelines. I resubmitted my application and wrote not required in section seven and it was accepted.

    Hi Folks,

    My husband and I are currently in the process of filling out forms for submission of the AOS. I came on a K1 visa and we married more than a month ago.

    In the I-864 Affidavit of Support, which should we check? I am getting confused if it should be A or D although my Husband is above the 125% poverty level.

    a. I am the petitioner. I filed or am filing for the immigration of my relative.

    b. I filed an alien worker petition on behalf...

    c. I have an ownership interest of at least 5 percent in...

    d. I am the only joint sponsor.

    e. I am the first, second of 2 joint sponsors.

    f. The original petitioner is deceased. I am the substitute sponsor.

    From what i have always understood about USCIS forms they don't want you to leave any sections blank .. they want N/A or NONE in those spots so that they know you didn't miss it by accident .. This could be the reason for the RFE ( stupid reason! but since when do they need a good one )
