  1. There is no way your friend can adjust status to lawful permanent residency in the U.S. since she entered without inspection by a CBP officer. She must seek an immigrant visa overseas. Her option is to apply for an unlawful presence waiver in the U.S. first and if approved, she can leave to go seek an immigrant visa overseas at a U.S. consulate in her country. This is not a do your own thing as waivers are complicated. She will need an immigration attorney that specializes in waivers for her best chances of approval. If she leaves the U.S. without one she will trigger a 10 year bar (assuming she's now over 18 and has been unlawfully present for over a year). With an approved waiver, she can safely seek out the immigrant visa without fear of the bar. Caution, USCIS could seek removal proceedings against her though if waiver is denied. It's all up to their discretion. That's why it's best to be handled by an immigration attorney.

    I don't believe she has. She just hired an attorney (we just realized today how crappy an attorney he is) a few months back, and finally heard back from him today about her case. He said she needs to go to Juarez, but had no idea for how long, when, or what she needed to do before then. He admitted he wasn't sure as he "didn't take very good notes" and would call her back in a couple of days if he found anything else out. Family and Friends suggested to her that she get another attorney ASAP, so just wanted to see what would be the best path for her so we can compare information with what the new attorney says.

  3. Hello everyone,here looking for advise and/or suggestions for our case.....

    My wife (US Citizen) and I went to the interview early June,the interview last almost 3 hours,yes 3 damn HOURS.

    Well,long story short,there's an ongoing investigation outside Immigration matters for something that I did few months ago and USCIS found out. <<--- If you are still hoping to be found innocent, you shouldn't confess on a public forum that can be monitored.

    80% of the questions were related to the criminal investigation and 20% of our marriage,they don't even bothered to look for our marriage evidence (photos,bills,bank statements,etc etc)

    Now,like I said,it's an investigation going on,I haven't been convicted or arrested,so I don't know if USCIS can rely on that. After a confession, it may very well be a strong case against you now. Make sure you definitely follow up with a lawyer.

    Also,we went to our interview without lawyer because I wasn't prepared for this,so I don't know if people whose attend these interviews has rights,constitutional rights

    Those interviews are recorded??

    Do they suppose tell people about their rights before starts the interview???

    I really hope that you don't perceive my comments too harsh, just trying to make you aware of how some information you posted could come back and tank your case if eyes from the other side come across this forum.

  4. If you are using W2's, the entire tax return must be included. If you an at all get the transcripts, do that ASAP and fax them, or something. That is the safest route that I can think of. If this info is incorrect, I'm sure a more experienced user will chime in and offer a better solution.

    Are you serious? You are concerned about the lack of periods in the OP's posts? Not everyone who comes to the US from another country is an English whiz, and I feel your post was not only very rude, but also very unnecessary.

    OP, you are in a terrible situation. Please take the advice of those who are actually here to help, get all your important documents and belongings to a safe place. Know that your status will be safe, and although you are in fear of losing your schooling and job, you can overcome those obstacles. I wish you all the best.

Send in the complete I-485 with medical...do not worry about the overstay now...but try to do it asap...look for some Civil Surgeons in your area and try to find the one which does not rip you off.Be ready for the Interview and explain the Officer since she came to see you,I think she didn't mention that she is going to see her fiance or boyfriend during her Visa Interview or POE,otherwise she wouldn't be here.So be prepared to answer all the questions as well.

    Not always true. My now husband (was boyfriend when he first entered US on VWP) was honest and admitted entrance when he told agents he was visiting me, as his girlfriend. We married the first time he visited and when he departed and came back for more visits, he always told agents that he was visiting me, his wife and never had a problem. At our interview we never had to explain why he decided to stay and adjust, or why we married here in the states while he was visiting.

  7. Race, Gender, Marital Status do not matter when applying for Food Stamps or any other means tested benefit. Any USC is eligible to apply and receive assistance if they meet the criteria. All members of the household including non citizens must be on the case so all income is reported, but as stated above, non citizens do not receive benefits. Only eligible household members will receive benefits. Good luck, and I hope that helps.

  8. As stated by other posters above, have your spouse file the I-130 and you file the I-485 together. Have your medical done before sending it off so it is included in your package as well as with all the other necessary documents. Read the guides provided to prevent leaving anything out and having your case stalled.

    You do not need to leave the country, although you were given incorrect information about how to properly AOS, you are here now and you can do the concurrent filing. Yes others will call fraud, but they aren't USCIS, and border control are the ones that have to deny entry if they feel you were committing fraud. Your AOS can not be denied on your intentions when you entered. Do not leave the USA until you have properly filed your forms, and apply for AP (advance parole) if you plan on traveling while your AOS is pending.

I went on interview yesterday and it was a one tough interview than i expecting.It took us 60 mins for the interview the Iso didnt take any i94 or ny work permit that worried me alot.I check on my status perhaps every hours after the interview since some ppl got approved just a few hour after.I just got approved this morning at 10:30am such a relief so now i can rest from the whole uscis thing for a while.

  10. My husband entered on VWP multiple times from England to the US, we married our very first visit and he continued to come for visits after. On his last visit, I had some medical conditions worsen and we decided he would need to stay. We went the AOS route without any problems. If you follow the guides provided on this site, you will be fine. Just know that as stated before, he will need to remain in the US while your case is pending, so I strongly suggest also applying for EAD and AP which will allow him to work and travel while you wait for the actual interview for Green Card. As of today, my husband is a 10 year GC holder, and never were we slapped with any accusations of committing fraud by USCIS.

  11. So we actually received a text and email that the case was updated today. That's two days after we received the notice by mail that we have an interview. So definitely don't take the case updates online to heart when there could very well be something in your postal future!

    I'm starting to get very nervous about the fact we fly back to see my family the day after our scheduled interview (my sister is due to give birth and it's also my mum's 50th birthday, hence why the flights were booked). We've already had to pay $500 to move them around, because we were advised by a lawyer we consulted with that the process should be done and dusted in 3/4 months. Stupid for him to have given us that advice really, but it was his experience with the clients he'd finished packages for and sent of for them. We just consulted with him on our situation and did the paperwork ourselves.

    Anyway, now I'm just worried because I've heard that as soon as you get approved for the I-485 that your Advance Parole becomes invalid and if you try to re-enter the country with it that you might not be let back in. This really makes me freak out, because I can't wait around for the Green Card to come in the mail as we'll actually be getting on a bus to head down to LA (where the flights to the UK are direct and cheaper) at 10pm on the interview day. I've heard that you can get a temporary I-551 stamp in your passport, but all the cases I've read are from people who already have the welcome letter and have shown it at an infopass appointment. );

    As for the traveling dilemma, don't worry about it. When we were approved on the spot, the officer took my husband's EAD card away and stamped the I-551 stamp in his UK passport. That stamp works EXACTLY like a green card, it will allow you to travel, and proves that you will now be an official permanent resident.

    I am sorry that your husband has been having a hard time establishing credit. Before my husband received a GC, (his AOS was still pending) I was able to add him to bank account without any trouble, and since he is now a PR with a social security number, I have the option to add him to one of my long standing credit card accounts with Capital One. We also went into a car dealership that specializes in helping people with NO/BAD credit, and they approved him for a vehicle. Maybe that is an option for you to try.

  13. So went today and provided a copy of my i94 and also gave them my passport, plus provided some mail with my name and address on it.

    They let me take the written test, and then when I passed they allowed me to take the driving test. I also passed that with flying colours.

    They gave me a Lic, although it's a temporary paper one they said that my full Lic will be mailed and I should receive it in the next couple weeks.

    So when it arrives I will check the expiration date and let everyone know. But from today it sounds like everything is good and I should have no issues going forward.

    Funny part is they didn't even care about my Ontario Lic today and didn't even take it from me.

    A huge Congratulations to you! My husband (from UK) just passed his driving tests and got his licence a couple of days ago :)
