  1. No,  you are correct.  Since there were so many people coming from the Philippines marrying US citizens, I imagined there were many who were also doing the Visa in the Philippines in order to have extended stays vs. a tourist visa.  I'll wait to hear back from the Embassy.  Thanks Lil bear. 

  2. I hope this is the correct forum for this post.

     

    I reviewed some sites that said it was possible to submit a 13A visa application form on the Embassy to the Philippines site.  My embassy would be the one located in Washington, DC.  I see an Immigrant Visa form but very little instructions.  On the Los Angeles Embassy site, they have an entire page with instructions specific to 13A.  So my questions are: 

     

    1. Can you submit a 13A form in the US to a US Embassy (vs. having to be in the Philippines)?
    2. Is there a reason why the Washington DC Embassy does not offer that information?

     

    I've reached out to the embassy directly as well, but thought I would ask this audience, which always seems to have the answers.

  3. Hi All, 

    My stepson's I-751 (Removal of Conditions) was delayed because of covid.  His 18 month extension expired but that was extended.  We moved to a new home and I made address changes on our applications, but apparently it never made it to his I-751 application.  It looks like the USPS tried to deliver it to our old address and then finally it was destroyed.  The notice stated: 

    - Change Address, which I did again

    - Request a replacement card.  I wanted to verify that would be form I-90.  It looks like there is a fee as well, $455? Do I really need to pay another $455?

     

    I just wanted to make sure I was using the right form (and the right price)

  4. Hi All, 

    We submitted an I751 for my stepson back in 2020.  We received a letter extending his stay 18 months as the process was taking a long time.  However, the extension is due to expire in September and he is scheduled to visit the Philippines in October.  Is there a way to request another extension or do I need to wait for immigration to send it to us the way the sent the first one?

    We are having a debate and hoping someone can help. You are all so helpful so I know you can. 🙂 

     

    My wife is a Green Card holder and we are waiting for removal of conditions (slow process).  We have 1 of her children with us (under 21 and came over on a K2).  She has two other children over 21 and single in the Philippines.  Is she considered a Legal Permanent Resident (LPR) or does she have to wait for removal of conditions to be considered an LPR?  If she is an LPR, than based on my reading of the I-130 instructions, she could petition her two other children over 21 (we thought we she had to wait to be a citizen).

  6. Hi All, 

    I was looking for some clarification on when my wife can file for citizenship. 

     

    She came over on a K1 Visa and now has a Green Card (received in July 2016).  We have filed for removal of conditions in 2018 and as it is for everyone else, the process has been delayed up to 18 months.  We have received the letter so we are patiently waiting. No issues there.

     

    However, my wife will have her Green Card 3 years as of July 2019 at which time the conditions will not have been removed.  We are expecting the conditions to be removed near the end of 2019 based on the extension letter.  

     

    My question is: Can we file for citizenship after she has been here 3 years or do we have to wait for the conditions to be removed before we apply?

  7. My stepson has an interview next week and we had all of his medical info, but we just realized that the I-693 is needed and the sealed results provided.  

     

    My question is, should we cancel the interview and reschedule or go to the interview and send the results once we have them?

  8. Hi All, 

    I just received my stepson's I-797-C (it took a year). We moved back in July from AZ to IL and I updated my address on the USCIS website with the new information.  Apparently it was ignored because the I-797C was sent to the old address and then forwarded to my current address.  However, the Interview is scheduled back in AZ.  I just tried calling USCIS but looks like their day is over so I will have to attempt tomorrow.  Any idea 1.) if they will reschedule here in Chicago and 2.) how long of a delay would it add?

  9. Hi All, 

    I have a question related to filing taxes.  My wife came over on a K-1 and we have since been married.  Her two boys came over in November.  We have just submitted the AOS/EAD paperwork (2 weeks back) but I know it will take a few months before that process is complete.  When filing taxes, I put the two boys down as dependents which requires a SS# or a ITIN #.  So, since they cannot get the SS# until their EAD is approved, I completed the ITIN forms.  However, after reading, the ITIN forms say only to fill out if the person is not SS# eligible.  The two boys will be, so I'm a bit confused.  

     

    Should I wait for the AOS/EAD process to complete, which could be March or April and if needed, file an extension to wait for the EAD approval (and then get a SS#) or should I be submitting a request for an ITIN #?

    I am reading a document called "The K-2 Visa Adjustment of Status (AOS) Application Process.

    There is a section called Older K-2 Visa Adjustments and a line that says: The Child Status Protection Act protects them from "aging out" as long as their AOS petition is accepted by USCIS before their 21st birthday. However, the CSPA only applies to K2's if the K1 marries the US citizent petitioner before the K2 turns 18. If the marriage occurs after the K2 is 18 then their AOS must be approved before the K2 turns 21.

    My scenario:

    - My wife came over on a K1

    - We married within the 90 days

    - her two boys came over in September, within the time allowed (within a year)

    - One of her boys turned 21 on 12/8

    - We have not filed the AOS yet, but are in the process

    My understanding was that as long as he came over before he turned 21, we were OK. His Visa states it expires on 1/22/2017. Did we mess up? Is he no longer eligible for applying for the AOS?

    I am pretty sure I know the answer, but I just wanted to confirm. Here is the scenario:

    - My stepson arrived from the Philippines last month

    - His K2 Visa expires on 1/22/2017

    - His 21st birthday is this week

    Since he has already arrived in the US before his 21st birthday, I believe there are no issues at this time as long as we have his AOS, AP and EAD submitted prior to 1/22/2017.

    My wife, a Filipina, had her AOS approved a few months back. Her children (16 and 19) just arrived in the US. One will be a student in the 9th grade and another will be looking for employment as he is a college graduate. We are applying for SS Cards now for both. My question is primarily for the 19 year old:

    Q. He wants to look for work as soon as possible. Since his mom, the K1 visa, has been given a temporary green card (AOS approved), should he file for the AOS only, or should he submit the EAD first?

  13. Hi All, I'm sure this question has been answered on here somewhere, but I just could not find it. I am trying to set up the CFO session for my 2 step children coming over from the Philippines to the US on a K2 Visa which was just issued. When I start filling out the questions, the first one asks: How are you related to your petitioner/sponsor? how do I respond, as there is no option for step-parent?

    This is probably obvious to most of you, but I am a little confused.

    My wife just received her EAD and AP card, so now she can work and travel :-)

    For the I-485, I didn't realize she opted to have her vaccinations done in the US (because she could not find her immunization records). She has been asked to have the DS-3025 (List of immunizations) and 4 pages of the I-693 completed by a Civil Surgeon. So, my question is: What is the definiition of a Civil Surgeon? Is it as simple as making an appointment with a doctor for the vaccinations?

    My wife came over on a K1 and we married. We are in the process of waiting for our Adjustment, EAD and AP docs, but want to get things rolling for her 2 children. I am completing the appointment schedule on St. Luke's for their Medical exam and it is asking for the Petitioner's relationship. Since they were included on the I-129F doc, do I put Fiance even if we are married, or do I make my wife the petitioner?
