  1. So you are saying that we have to wait a year even though we're married? This whole process is ridiculous, I mean she's my wife and it feels like we have to jump through so many hoops just to be together. There are no other alternatives to this 10 - 12 month timeline? That seems like such a bleak outlook for anyone going through this sort of thing, an almost helplessness it imposes on you. I thought the K - 3 Visa was something you could file to help the process, I remember seeing something about receiving an i-17something form after you send in and they receive your i-130 and you send that in with the i-129. Or is that just something that applies to no married couples? I dont know, this all gives me a headache when I try to figure it out and all I want, all we want, is to be together.

    This "ridiculous process" is what many ppl globally have to endure (me included) to be with their spouses permanently. I got married in April of last year, my husband filed for me and my kids at the end of May and through all the waiting, we have finally reached the stage where our docs were submitted to the NVC for review before sending to my consulate.

    I have only been able to visit my husband 4 times and these were only 2 or 3 weeks at most. It IS tough having to spend time away from the person you love but this is the sacrifice of waiting so that you both can enjoy a wonderful life together.

    Word of advice: START FILING FOR CR-1 VISA FOR YOUR WIFE NOW!

    Just got off the phone with Ellie of NVC. They got our docs yesterday and scanned them too. She said we'll get the email by Fri and we can call them back on Fri if no email was rec'd. She was very pleasant and patient with me and answered all my questions without sounding frustrated (lol). Essentially, she stated that NVC has increased their review period to the 45 days due to the high influx of cases being received daily. She also mentioned that, should a checklist be given, another wait of 30 days is mandated to be given to the client....although it will NOT take that long to review 1-2 docs. That is a protocol that they must adhere to when they are on calls.

    Overall, I am happy that we finally had our docs rec'd by the NVC...the countdown to 45 days has begun :clock::clock::clock:

  3. You're so lucky you got to spend 6 months with your husband, for me, it's always just a few weeks then back to responsibilities for both of us. He called the NVC tonight and they told him 40 days, we are now at day 33 and these 7 days will seem like FOREVER. Our first anniversary is in March and we really want to be together for that I just hope this is all finished because I feel like I am on the verge of a nervous breakdown. I try to focus on work but even that isn't working anymore. I just want it to be done with and to just get on with all the plans we have.

    Look at the upside...you waited 5 months or so for USCIS process to be done....10 days seems trivial compared to that but (just like me lol) I guess waiting even as much as a DAY seems like a lifetime!!

    I also try to make trips to visit my husband and vice versa and just like you, I only get to stay 2-3 weeks because of my job and family commitments....the kicker is the way we're asked by the CBP Officers each time "How do you handle a long distance relationship??" A Simple answer really.....I know the day will be soon for when we're together for eternity (L)

    I understand that calling NVC and not really getting positive feedback ultimately results in a stress level that only God can understand :cry: but think positive and you will see that those 10 days will be done before you know it ;)

  4. First off, my advice....GET ANOTHER LAWYER! :wow:

    If this person is giving you grossly inaccurate information during your filing/petitioning stage, what else would go wrong?? I'm doing the CR=1 visa and the G-325 was required for me AND each of my 2 kids.

    Secondly, your husband should put the last 5 places of employment within the 5yr period. Should the question arise during the interview stage, then he can honestly answer and explain in detail to the IO.

  7. You say Police certificate, but they are country specific, I was about to make a new thread and pose a similar question, but maybe my question can also help the OP as well. We had to get police certificates from 3 countries, 2 of which we were required to send to NVC in original form, the 3rd is a chinese certificate which they accepted only a copy of, Now this chinese police certificate has only a creation date of Sept 23,2015 and not an expiry date. My questions is : Does the US gov, have a stipulation about when these expire, assuming the beneficiary has not returned to said country since the issuance.

    Police certs are valid for the visa process for 1 year from the date stamped on it.

  8. First, you should be aware that no one is getting CC in 30 days. NVC is saying 30-45 days. I got CC on day 40 after our scan datte,even though we were placed on Supervisor Review. We won't required to correct or send in any new or missing paperwork. We were on review because they didn't review our DS260.

    My docs were mailed today to NVC but no email rec'd from them as yet...maybe tomorrow...hopefully. :clock:

    My husband filled out my son's DS 260 incorrectly by saying he didn't have a US visa so I emailed NVC through their website "Contact us" page but I have not gotten any response from them. Hopefully they can fix it or possibly allow me to fix it when I get the interview.....

    Anyways, saw your interview date is next month....lemme know how that goes! :)

  9. Is there an average currently on how long case complete is since this year has started? I wanted to get an idea since my scan date was January 13... Or should I just assume the 45 days to be on the safe side.

    Many cases are different so I'd say just hold out until 30 days has past and then contact NVC to get feedback on your case. This might help to ensure you don't get a checklist ?

  10. As the Title suggested, the Bio Father of the minor daughter will not give permission for the daughter to immigrate. Let me break this down and please if anyone out there knows of any options we may have at our disposal, please don't be shy, please let me know.

    Fiancee is Mexican National living in Mexico.

    Minor daughter is dual citizen with Spain and Mexico, lives with her mother in Mexico.

    Bio father is a Spanish citizen living in Spain, with no Mexican nationality.

    Bio Mother has Custody and Guardianship. Bio Father still has parental rights.

    Minor Daughter has European Passport from Spain and can pretty much travel freely to the US without the need for a Visa and has done so several times to visit her Uncle and cousins in the USA.

    Since Bio Father won't give permission, does anyone out there know what path we can take here?

    Here are my thoughts, and clearly, I'm just throwing out some ideas, I don't know if they are viable, the legality of it, and or if these ideas will work or not.

    Option 1: Proceed with the K1 Consulate Interview. If they don't give permission for the daughter to come, can we then tell the Consulate the daughter will follow later? Will that work? Then because the daughter has a Spanish Passport, we can just have the daughter come up for 90 days at a time to "Visit us", then we can send her back to grandma and grandpa for a weekend, then have her come back to the states on the tourist visa for 90 days, and just keep repeating this process until she turns 18, then we can file for her citizenship immigration or whatever you call it. Does anyone see a problem or legal issue with this?

    Option 2: If the consulate will not allow the minor daughter to come over on the K visa, have the minor daughter apply for a Visa Waiver to study in America for school. that way she can stay with us for longer periods of time before we need to send her home in-between school or however long a visa waiver is good for.

    Option 3: If Bio Mom is living here in the states with me as my wife, and she is supposed to have custody of her minor daughter, after the daughter comes to the states to visit us, can the daughter stay here past her 90 Visa entry and can we apply for a hardship exemption to keep the daughter here in the states with us? Does anything like that exist in the annals of our immigration system?

    Option 4: Can anyone out there give me a 4th option that is viable?

    I know there will be some comments about fraud etc...- this is not my intention. We are not trying to fraud the immigration system. My intention is to find out of anyone knows of ways to circumnavigate the need for the bio fathers permission and just get my family over here to live with me so we can begin our new life together.

    I was in a similar situation with my ex-husband and getting his permission for my kids to migrate with me to Florida. We divorced and I got care and control of the kids while he was granted liberal access. That being said, he rarely utilized this access but when I mentioned to him that my husband would be filing for us, he gave all assurance that he would grant me the permission to take them with me....yeaah riightt! I ended up putting him through Family Court to vary the order that was given at the time of our divorce.

    End Result: He voluntarily terminated his parental rights for the kids and the judge stated that she will draft the court order in such a way so that I would have zero issues when crossing borders with my babies in the event that CBP Officials queried the consent letter to travel from the bio-dad. :D

    Your fiancee will have to show the court that she has been there for them (financially, emotionally, etc) and he has not impacted positively on their lives. The court usually makes a decision based on the best outcome for the kids' sake.

    If you are petitioning for your wife, then it is your wife's passport info you need to put.

  12. That is a very good question. I believe is worth to take the chance with a check list and gamble because you are gaining time by sending your package with out the police certificate.

    If I was in your shoes, I would do it because if I get a checklist that will buy me time while I obtain the police certificate, if I do not get the checklist great, I will be ahead time wise and present it at the interview.

    Just wanted clarity on this info you shared to another Trinidadian on New Year's Day: Trinidad & Tobago has 7 cases, one took too long, so eliminating that one your interview date should be about 54 days after CC.

    Is the 7 you're referring to on the spreadsheet? If that's the case, then it's less than 7 since the dates are far back as 2013 and 2014. The only Trinis who I've seen that have used VJ and kept up-to-date so that we're all aware are ShirazMoe, Stone23, cokelili, Trini_manage and myself. Also, based on the NVC case # assigned to me and my kids, there are 2 persons in front of us for our embassy in Port of Spain....I'm taking a shot in the dark here but I'm guessing that the 2 ahead of us would be Trini-manage's spouse and daughter....maybe.

    In any event, we are nearing the end of this long and stressful road on our Visa Journey :clock:

    I´m here just to say Hi to everybody and tell you that today I picked up my passport with the visa !

    Thank God !!!

    And I want to thank to all the people who helped me here. I could not have done it without you !!!!

    I pray for all of you that are still waiting their CC, interviews, approvals and to have the visa in hand !

    This is a matter of time and patience. Don´t lose hope.

  13. Had the same problem in Arima. I posted it so that the folks behind us could get theirs beforehand. I'm sorry you didn't see my post, so you could of avoided the wait. Ended up waiting about 4 weeks in total. You'll probably just get a checklist. Make sure you go to the police station every Monday or so to check. Sometimes they wait till they have a few before they send them to Cental to be processed.

    There is a chance they may require you to send it to NVC, and not just to the interview.

    Thank you for your concern. I'm just updating that I finally got my PCC today and I scanned and sent it to my husband so that he can include it in our paperwork! He'll mail out the packages tomorrow....very excited for the next step! :joy:.....but not really ecstatic on the lengthy wait of 30-45 days.... :clock:

    I actually told my husband that we can scan and send a copy of the receipt to the NVC which the officer gives you as proof that you applied for a PCC. Like you said, if we get a check list then we should have it by then to send it right away.

    We'll try our luck and send without it because I did read in a previous forum where they mentioned that any docs that weren't sent to NVC must be presented at the consulate interview. :thumbs:

    I have a question which may or may not have been answered previously but here goes:

    My husband and I have put together all the documents required to submit to the NVC. However, Trinidad & Tobago police certificate of character is taking too long to get back (1 officer said 2wks, 1 said 4wks...today, I was told 6-8 wks!) This is the ONLY document outstanding for us to send our package to NVC. Can this document be check-listed as "unavailable" and then provided at the consulate interview?

    The I-94 is the Arrival / Departure Record, in either paper or electronic format, issued by a Customs and Border Protection (CBP) Officer to foreign visitors entering the United States. After April 30, 2013, most Arrival/Departure records will be created electronically upon arrival. Instead of a paper form, the visitor will be provided with an annotated stamp in the foreign passport. If provided a paper form, the admitting CBP Officer generally attaches the I-94 to the visitor's passport and stamps the departure date on the form.

    If you are employed as a babysitter (meaning you get a salary) then yes, it is considered self-employment. If you earn more than US$400 at babysitting, you are considered to be self-employed as far as the IRS is concerned, for all income earned in that business.
