  1. My father in law is my co sponsor and he filled out the I-864. I believe the I-864A is when its a joint sponsor living in the same household as yourself.

    edited: I just checked the USCIS website and the I-864A is a contract between the Sponsor and a Household member.

    That doesnt necessarily mean you have use the I-864A if the uncle lives with you (hypothetically, not sure if he is or not). Some use the I-864 still.

    cause i am living with my wife as her household member so i think i need to file file I 864 A form. My wife is my primary sponsor and her uncle is joint sponsor . Moreover Uncle does not live with us.

    While filling I 864 in conjunction with I 485 adjustment of status application i got confused al ittle bit?

    my wife is not woking at all and she has no source of income . Her co sponsor (uncle) can sponsor me .

    Is it necessary to file I 864 A along with I 864 or not?

    What is purpose of I 864 A?

    Note:I have filled out, I 485, I 130, I 765, G 325 A( 2 sets), I 693 + supplement forms, already.

  3. My spouse is going to apply for I 130 . Meanwhile i read through visa journey guide page. Here it is written that i have to submit 2 G325 A (biographic information ) applications. One for intending immigrant and other filled by US citizen(my wife).

    1.I just wanted to ask you is it true that i need to submit 2 sets of G 325 A applications along with I 130 (petition for alien relative)?

    2.if yes then what should i write(chek box) at the bottom of G 325 A application asking

    this application is submitted in connection with a) Naturalization B) permanent resident c) Other ,explain

    I (alien relative) have to check the box saying B) Permanet resident,i know, but please let me now which box should be marked by my wife (USC) in G 325 A application a) naturalization B) permanet resident c) other ,explain ?

    Note: i am applying for AOS on the basis of marriage . we both are in US.

    my wife USC does not meet requirement for supporting me even on basis of her assits and income.she has an uncle who earns $ 80000 per annum and he meets requirement to support me . Can he be my sponsor for adjustment of status(1 485)

    ;one more question does my wife need to be sponsor along with that uncle or his uncle can sponsor me alone.?

  5. Seems like your forms are out of date. Get the new ones at uscis.gov.

    Okay , I do no tthink so my form is old but in instruction of I 131 form which i downloaded from website uscis.gov i found following instruction under heading of photograph

    You must submit two identical color photographs ofyourself taken within 30 days of the filing of thisapplication. The photos must have a whitebackground, be printed on thin paper with a glossyfinish, and be unmounted and unretouched. NOTE:Digital photos are not acceptable.

    The photos should show a three-quarter frontal viewof the right side of your face, with your right earvisible and your head bare (unless you are wearing aheadress as required by a religious order of which youare a member).

  6. i am applying for AOS , got confused about photo requirement. I 485 requires 2 * @ inches photograph with white back ground and concurrently ia m applying for EAD and AP and photo requirement for AP is saying that it should show right side of face with visible right ear?

    Please reconfirm photo requirements and type of photo (i mean frontal view or side view)for each documnet of AOS.

    i am filling these applications.

    I 485 concurrently with I 130

    EAD application

    Advance parole application

    Medical examination forms( well it will be by civil surgeon offcourse)

    Affidaviit of support.

  7. I am also filling both application with my wife. She is filling I 130 and i have asked her to write name of city and country in which US embassy is located in my native country.May be i am wrong. But i do not think so it is N/A and i cannot leave it blank. Cause for example if i become ineligible for I 130 than i have to go to my native country and apply from there.

    It is entire medical examination. I think it is required when you adjust for status along with I 485 and AP and EAD and I 130 . It is I-693, Medical Examination of Aliens Seeking Adjustment of Status + i have vaccination sheet and i will ask him for supplemet too.

  9. I called yesterday to amny civil surgeons here so that to get idea of appointment times and their fees. I cam to know that fee is around $ 250 and many of them only accept cash and no credit.

    Does any body know any civil surgeos here in chicago for medical examination who charge with a lower fee ?.

    Moreover I have my vaccination sheet which is up to date and complete.

  10. sjoefl01, I'm so sorry. I know I appear to be following you round at the moment and it's not the case!

    It is possible to adjust from visitor status, and it's very dependant upon your intent upon entry. Using a tourist visa to circumvent the K visa requirements is visa fraud, however entering as a visitor and then undergoing a change of status is perfectly legal.

    You are correct that the I-130 is what qualifies you to adjust - it is an immediate relative petition. As I said in the post above that puts Ans into category A, because of this:

    Attach a copy of the ... relative ... petition filed with this application that will give you an immediately available visa number, if approved.

    It is also worth being aware that you may be asked to prove that you did not have immigrant intent on entry, but in order to get a B2 you have to show pretty significant ties and admission through POE was granted. Ans, you haven't given us much about your date of entry, but judging on a 6-month B2 entry granted, I make it that you entered in January sometime. It's not that soon to marry in late March!

  12. Dears Thanks alot for all your support. Well yes you are right that i am in apnic little bit. Law is stressful in USA . I am working on I 485 and I 130. As i told you earlier that id onot know what to write in on page1, part 2 of I 485 application .

    Let me remind you all that i am on valid B2 visa ( I 94 expiring in June) and married to USC recently.mean while i also want ot file for EAD and AP . any help willbe really appreciated

  13. Hi, congratulations on your wedding.

    ANS, please understand you are asking for a massive undertaking. This is somewhat unfair because we don't know your situation. There is a fairly simple procedure you can do to get more comfortable.

    (0) Before all else, read the appropriate forms and their instructions.

    (1) Read over the AOS FAQ offered by VisaJourney (see Visa FAQ link at the top).

    (2) Read over the AOS Guide (see "Guide" link at top).

    (3) Download all the appropriate forms from USCIS.gov. (see Immigration Fees & Forms > Forms).

    (4) Read the USCIS "How Do I" for adjusting to permanent residency, lawful permanent resident.

    (5) Download all the appropriate example forms from VisaJourney. (see "Example Forms" link at the top.)

    (6) In a text editor (or Microsoft Word), try filling out answers for each section of one form. If you have an area where you are confused, need more information, or whatnot, clearly mark this with a note of what you need or what does not make sense.

    (7) Repeat (6) for each form.

    (8) Update your Timeline on the website. (see your forum preferences for more.)

    (9) Compile any necessary information you are lacking. (IE: copies of birth certificate)

    (10) Do a search on the forums for anything you are uncertain about or unfamiliar with! *: Many people ask the same questions over and over. Search for their questions (IE: I-864, joint sponsor, SSN, EAD, work permit, travel permit, advance parole, etc.) before asking your own.

    (11) Look for any posters who have a similar situation (transfering from B2 to something else).

    (12) Keep a list of "hot words" or abbreviations or jargon you aren't familiar with. (IE: I-864 - this is the affidavit of support form. USC provides employment information to prove she can financially support the immigrant.)

    Every person's case will be different. The first step for you is becoming familiar with the AOS process and understanding all that it involves. Any answers we might give to general questions will probably end up leaving you more confused than before, especially if we start using terminology like 'biometrics' and 'NoAs'.

    VisaJourney does a very thorough job of helping an immigrant through the steps of this process, but it's really up to the individual (YOU) to read. Expect to spend anywhere from 5 days to a month getting familiar -- and that doesn't mean expert, but enough that you know what you are talking about.

    I cannot stress enough: read the instructions of the forms. They will tell you exactly what USCIS wants. Read the forms. Many of them are self-explanatory and request the same information more than once. Some terms are called slightly different things on more than one form, and reading them over can help explain them.

    Once you are done reading the forms, please read the example forms and the FAQ/Guide before you start asking questions!     This isn't meant to discourage you at all, but instead give you knowledge! Knowledge is power. :luv: You need to understand the immigration process for yourself if you are not using an attorney and unless your case is very complicated, I don't recommend a lawyer. Sitting down and learning this is all very important so you can know and be informed about how immigration to the US works. This way, you can know if something has gone wrong or what to expect next. You are less likely to have worries and stresses because you are involved. :)

    VJ allows you to update your timelime of events and give details about your specific situation. This is very strongly recommended if you want more detailed answers for your situation. You can use your signature to highlight what you do -- many people here have them, some colourful and some plain. These things are very easy to see and use to help us in helping you. Your timeline is more specific; you can say when you filed for something, when you received a response, when you get your different approvals. Sharing your timeline helps others research the process and we all gain more information on how fast (or slow) USCIS is.

    Also, please put down your District Office (this is the nearest office to the city that you live where your AOS will be handled; and where you interview). For example, your district office might be "Dallas", "Garden City", "Chicago" or "San Francisco." You can use this information to find other people that are also using this office, and you can compare your experience to them.

  14. i am filling form I 485 , i am on B2 valid visa ,I94 expiring in june, married USC yesterday . so please help me in filling page 1 part 2 of I 485, mean while iam also filling I 131. if anybody there who knows please let me know about which box should i mark on page 1 part 2 of I 485?

    Nobody really wants to go and look at the I 485 again. You should tell us what question was asked on line # part# page#. Relax and ask the question. You will get all the help you need here.

    if you're adjusting from b2 status, I do believe you will need to fill out the I-130 and I-485 so you can file it concurrently.

    i do not think so that i should fill I 130 along with I 485.i have studied requirements for adjustment of status and i have to file

    3. I-485

    4. I-765 (optional)

    5. I-131 (optional)
