  1. It will also depend on the husband. If he shows up in court and defends himself to all the allegations that has been filed against him, that will add more to the number of months to wait and the annulment case may even be denied. The court is pro-family and if possible does not want to annul a marriage. It will always depend on the judge though. If he/she is honest and goes by the book then your cousin has a long way to go.

  2. TODAY THE CONGRESSMANS OFFICE INFORMED ME THAT THE EMBASSY HAS JEAN AND I ON AR BECAUSE THEY DO NOT BELIVE OUR RELATIONSHIP IS REAL. I HAVE BEEN THERE TWICE IN THE PAST YEAR. SEND MONEY REGULARLY, SHE HAS MY ATM CARD, I PAID FOR BRACES ON HER TEETH, BOUGHT HER A NEW HONDA SCOOTER. WE HAD A CHURCH WEDDING WITH ABOUT ONE HUNDRED FIFTY PEOPLE PRESENT. HAVE HUNDREDS OF WEDDING PICTURES. PICTURES OF OUR HONEYMOON, PICTURES OF ME INTERACTING WITH HER FAMILY. I HAVE MET AND BEEN TO THE HOME OF THE MAYOR IN THE TOWN WHERE SHE LIVES.

    I AM DISTRAUGHT, DOES ANYONE HAVE ANY SUGGESTIONS. PLEASE KEEP IN MIND THAT THE EMBASSY HAS NOT RETURNED HER OASSPORT OR RETURNED OUR PAPERS TO USCIS.

    Hi John,

    If they are going to ask her for more evidence of genuine relationship, how about you make her as the beneficiary on your insurance, your last will and testament and other spouse benefits. Just be prepared to have the copies just in case the US embassy asked for it.

  3. Original plan was to live with my in-laws, save and move to an apartment. I backed out 2 months before I moved to US knowing the waiting time it takes to get EAD and green card and I will be spending most of my time at home. I told my husband that I am not comfortable staying for a long time at his parents house even if we are going to pay a part of the household expenses. I might do silly or stupid things and they will end up not liking me at the end of day. That is the last thing that I wanted to happen because they will be the only closest family that I will have once I got here in the US. I would rather wait and stay in the Philippines for a while if we are not going to have our own place. He got us an apartment 15 minutes drive away from my in-laws and my relationship with them especially his mom is fantastic.

  4. Hi!! june filers....i just got my schedule for interview on october 22. i also had approved AP and EAD. I was surprised to received a letter from USCIS coz i did not have any touch in the online status. But i was so happy to received the notice. I am now preparing my papers for the interview.

    I just hope and pray that everything would be good in my interview.

    hi jean, when did you file your AOS? I came on K3 as well and so far there is no update from USCIS since my biometrics last July 26, 2008.

  6. Received my AP in the mail today and a letter to do Biometrics for my EAD on the 09/09. I have a question for you guys can I go in sooner by just taking in the appointment letter. I really wanna get this ball rolling.

    I read some thread regarding this....one guy said that a lady from the bometrics center told her that people can actually get their biometrics done as soon as they receive their notices/appointment letter. and that they dont have to wait for the set date given to them. you could walk-in I guess. I mean, it's worth trying it.. i wish i've known this when i got my apt letter back then. but anyway, GOODLUCK! and congrats to ur AP!!!

    Thanks a lot I will call USCIS just to make sure. But I had read somewhere in this tread that someone actually did that. I will call USCIS on Monday and see if they object to me doing this (just to hear it from the horses mouth). Thanks a lot and good luck to all you guys with your approvals.

    They are not open on Monday. Tuesday-Saturday is their work days, at least here in California. I was the one who the USCIS employee talked to. Someone in the July filer called USCIS and they said to her she cannot do it but she went anyway the next day and it was done.

  7. ....hello again, heres the story, i met a girl during my medical exam last Friday, like me shes a K1 too, while were talking i ask her when is her interview and she told me September 03, so then i ask her if she paid DV already, and she told me she ddnt pay yet, coz she dont know about it, so then i explain it to her, while waiting for the results , we go out first coz its lunch time and were hungry, and she told me that shes is nervous so i ask her why?

    so then she told me that shes married with 2 kids!!!! and i say its okey as long as you comply all the documents needed, i can tell by her face that she wants to tell me something , and so i told her go on, im here to listen, with out hesitation she told all her application she put SINGLE!!! im schocked!!! i ask her why she apply for k1 thats she is married b4...she said she ddnt know about that certificated og no marriage!!!eventhough!!! darn..

    anyway i just want to help her, im stupid to tell her okey go with your interview, but then i dont have rights to tell her not to go, based on what shes tellin me, and i for sure i cant help her for right now, but maybe in the future, so i ask help from here, maybe would help her on the future..

    i ask her, and she told me yes she did told him, and i told her the first thing you can do is talk to your fiancee, tell him everything, im not sure if shes lying to me about telling her status on his fiancee, but based on what she told me, her fiancee visit her 4 times, so i think her fiancee knows her status, she just text me today, that will not go on with her interview, maybe she realized what might happen and what might the decisions on her, theres a possibility that she will get banned my lying, i dont know, but im sure she will not able to have her visa.....i feel sorry for her, i mean processing is a lot of work and now shes on the stage of getting there, and everything falls down, maybe in the future we can help her, what she can do...

    Before anything else, she needs to get a lawyer and file for an annulment. The documents they need to file K1 or K3/CR1 will come from the Judge's decision and annulment decree. What's her place of residence?

    What are you trying to explain?

    That I don`t have a NOA1 for I-130. I never received it.

    I submitted copies of processed checks and NOA for address change for I-130 as a prove.

    But nothing....

    That happened to my daughter's I-130 as well. We did not receive any notices for that. I submitted copies of the check that has a WAC number on it and I seem to think that proves that we have indeed filed I-130 for her but still got RFE for it. I guess that was not enough. I called CSC about it and they told me that my USC husband should be the one making the request for NOA and not me because he was the one who filed and signed for it. The next day my husband called CSC and inform them that he did not get NOAs for my daughter. They told him that they are going to mail out a reprint of the notice. After a week, NOA1 came in the mail and I made a copy and sent it with the RFE. That was 3 weeks ago.

    I guess your husband should call the office that you guys sent your I-130.

  9. i just want to make things clear for me and my fiance with regards to the medical exam requirement upon filing the AOS. i already read the new TB guidleines by CDC as well..

    i have no idea on this yet, i hope you can help us with some of our concerns...here i listed them..

    ABOUT THE VACCINATION:

    what will happen to the medical exam that we had at SLEC? will it be continued by a so called "civil surgeon" assigned by the USCIS once the beneficiary arrives in the u.s.? does that mean that our follow up vaccinations (the one started by SLEC) will have to be done in the u.s.? ( can i have a shot from some clinic here in the PI or i should continue it in the u.s.)

    ABOUT THE NEW TB TEST REQUIREMENT:

    with all these... how will i know the flow of the processing? WILL THE USCIS SEND ME A LETTER OF INSTRUCTION THAT I HAVE TO UNDERGO SUCH DIAGNOSTIC PROCEDURES? OR WILL I GET A NOTIFICATION AS SOON AS I ARRIVE AT THE POE?

    I do not think USCIS will send you a notice about it. But here is what I did and did not do. I had my additional shots here in the US at a health center and it did not cost me anything. I did not submit I-693. I could not find any CS in our area that charges $50 or lower. They want to always do a full medical on me before they fill up the I-693. I just photocopied my DS-3025 from SLEC and the vaccination paper that I got from the health center and mailed that together with the other paperworks last June 19, 2008. I had my biometrics done last July 26, 2008. So far I have not received any RFE regarding my medical.

  11. Last July 25, my fiance sent the documents that I needed in my coming interview and send it thru PhilPost (Philippine Postal) and it's almost three weeks now and yet I did not get hold of it. My worries started to escalate today when I tried to check it in our post office and it's not yet there. It's very unusual coz I used to received letters and cards from U.S. but it only took 10-14 days and it's delivered right here in our doorstep. BTW, I lived here in Zamboanga Sibugay Province and I understand that living in a far-flung province could sometimes take a little longer for any post to be delivered but hey, it's almost 3 weeks where did they sent it? :crying::crying::crying: I'm really worried coz it contain all the original docs like plane ticket, boarding pass, receipts with our names together plus docs of affidavit of support, etc. My Interview will be this Aug. 27 and I'm supposed to fly these coming sunday to Manila to have my medical but how can I fly without those docs that I needed? Is Philpost another gov't backlog? Anybody here experience the same thing like me?

    Yes, it took me a more than a month to receive it. Maybe because of the holidays at that time. It was sent first week of December. I received it second week of January. The next time we did it we used DHL.

    nagpa-medical ako july 29-30 tapos interview ko sa sept.2 pa ;) kaya sa tingin ko walang magiging problem kung magpapa-medical na kayo! tinanong ko 'yung gurl sa window e sa releasing section kung wala ba ako magiging problem kasi maaga ako nagpa-medical, sabi naman nya sa'kin wala naman daw basta kailangan bago mawalan ng bisa ang medical natin which according to her ay six months ang validity kailangan daw nasa usa na ako :thumbs: pero may nagsabi naman isa duon na three months lang daw ang validity, at mga dadalhin ay passport mo at passport ng anak mo, plus 3 2x2 photos, 'yung appointment letter mo, black pen at medical fee ;)

    One year ang validity ng medical to file for AOS for permanent residence(a.k.a. green card) when you get here sa US. The SLEC employee will give you an original copy of your vaccination supplement and instruct you to make copies of it.

    .. i suggest that you should bring a good manicure set.. coz its really expensive.. but hey when you get to have it done, got to the vietnamese they have much cheaper price..and i had a nice manicure...

    Try the jasmin rice, milagrosa rice tawag natin sa pinas. If you live in Burbank, there is a filipino grocery named Seafood City Supermarket in Van Nuys. You can buy daing, bagoong, itlog maalat, bangus, ligo sardines, pancit canton, sinigang mix, etc. It will take you around 15-20 minutes to get there. Here is the address:

    Use yahoo maps, if you do not have GPS to get the directions from your place. There is also one in Eagle Rock but I cannot find the address right now.

I am not sure who was it though. She does not need to file an annulment because she is not married and it will show in her cenomar that she is not. A lawyer right now is a not going to help. She will have to go through the interview and they will let her know any documents that they might need. Just bring an affidavit with her stating the reasons why the birth certificate of the child says they were married. Tell her to relax and just answer the questions truthfully. Your situation is not an isolated case. Keep us posted about the results of the interview.

    one thing i am worried about is the 'registration number' - doesn't this make the 'marriage' liable to show up on another NSO document when tying to get a CENOMAR?

    No. The forms that she is going to fill up will ask for her full name and parents name, date of birth & place of birth. They don't go by the registration number. Almost everyone doesn't know their registration number like I did when I got one.

  16. i think they will. i read a lot of stories here that it is ok to do the biometrics as "walk ins". i will just try my luck.

    I know it is a pain in the tush!

    Do you think they would get your fingerprints done if you just show up there? I'm not sure if they would but you can try calling and see what they can do about it.

    I can't wait to get that out of the way.

    Awesome! Even if they say they can't do it, the worst that could happen is you have to wait until the 28th. So it is a good idea and go over there and at least try to have it done earlier :)

    yep. besides my hubby doesnt have work on mondays. and it is just an hour drive from here to york, pa. i just hope they are open on mondays.

    They do walk-ins here in California. Their work schedule though is Tuesday-Saturday. They are close on Monday. You can try calling your local USCIS if they are open on Monday.

  17. hello...you can apply nbi clearance either your married or single name if you want...but at the nso when you are registered as married ,it would really come out that you are married....the best thing to do is to get cenomar for her...and about her kid if she was not really married to the father then maybe you need to file pettition for that error....im sure later somebody will give more accurate info than i do

    Some local civil registrar does not allow the mother to have the name of the child's last name to be the same as the father unless they are married so they lie about it. I am assuming same thing happens to the fiancee long ago.

  18. CENOMAR or certificate of no marriage will show if she is really married. Doing background checks if she is single or if previous marriage was terminated are just a couple of the major factors that delays the visa. Just to be on the safe side, bring the CENOMAR on her interview. It only takes 2-3 days to get one.
