  1. Alohaz, I just want to add that we didn't get any RFEs during the processing of our petitions at California Service Center. I hope that you will not get any RFEs too cause I saw in your timeline that you have only sent your petition last Dec. 14, 2007.

    1 We got out decision...Now waiting for the finality...

    2 After we get the finality we go to the ofice where we filed her annulment and have it documented...

    3 Then she will have to travel to where she got married and have it documented there as well...

    4 Then mail it to the NSO and get the copy there...

    Is that the proper procedures... at what point will we have adiquiate documentiation to place with our k-1 packet so that we can submit it? 1-4? looking for a straight answer... :blink:

    Same here, I've been there done that kind of thing myself. In fact my interview date is on February 7, 2008 and I passed my medical already. I think what you were referring to as the "decree" is the annotated marriage certificate. I have 3 copies of that myself.

    I have even read in one of the topics here a year ago where a woman who is now with with her husband in Texas said that based on her experience during the interview was that Decree of Nullity of Marriage with a court seal is the most important document to prove that the previous marriage has been terminated. I don't think you will get a court seal from NSO if what you are saying is that the decree will come from that government office. The court seal is from the judge that issued your decision.

  3. Sputum test? That is like another P2,100 for your medical expenses plus P294 for second x-ray. I also had my 2nd xray and I passed. I also got worried when they told me to get another one but they didnt find anything. I'm sorry for the delay it will cause you.

    HI!IVED BEEN THROUGH IN THAT CASE LAST AUG.2007,,, YES ..1 2 3 4 IS CORRECT AFTER U GOT FROM CVIL REGISTRAR WHERE SHE GOT MARRIED.SHE HAS TO WAIT 15 DAYS TO GET DECREE IN NSO,MAKE SURE THE CIVIL REGISTRAR MAIL IT TO THE NSO THROUGH LBC.AFTER 15 DAYS SHES CAN GET DECREE JUST FILE AND PASS ALL THE PAPERS THAT SHE GOT FROM CV,THEN GET MORE COPY OF DECREE IN NSO ,U NEE D ONE DECREE AND HER BIRTH CERTIFICATE AND PASSPORT PICTURE,MAKE SURE THAT SHE ATTACH THE DECISION OF THE COURT IN THE DECREE PAPER BFORE SHE SEND IT TO YOU,WAITING FOR FINALITY SOMETIMES TOOK LONG TIME OR 1 OR 2MOS.HOPE THIS INFO WILL HELP U IF U QUESTION ABOUT IT JUS SEND ME A MESSAGE,GOODLUCK I KNOW WAT U FEEL GUYS

    I need to correct you on the info that you are providing or you are going to confuse them more. The Decree of Nullity of Marriage will not come from NSO but from the court where they got the decision.

    Once you have the decree. You can work out the NSO stuff afterwards. I am in Baguio right now having a vacation and can't go online that much. I'll be back on saturday afternoon. Tell your fiancee my yahoo id(same as my account name at VJ) and send me a PM so that I could tell her more about the decree and maybe help you guys out.

  6. can we file the petition as soon as i get the finality????..my fiance is planning to do so...correct me if i am wrong but i have heard that you can file the petition for k1 as soon as you get the finality and make sure i will have the annotated mc before the interview..thanks again...

    We filed our petition once I got the decree. What we attached in our petition were photocopies of the decree and the decision. We did not include the finality and the annotated MC.

  7. thanks everyone for all your replies..this has been stressfull enough..annulment indeed requires patience..im thankful im halfway through it...im just confused ..some directed me to go to LCR cagayan valley where i got married right after i get the finality..some suggested to go both to the lcr where i filed my case and where i got married.?which is which...please enlighten me..going on both LCR wont be a big deal i just done want any mistakes in doing this..it has been a very very tiring and emotianally draining experience for me..i will surely do what raquel has suggested having it mailed through the dhl if they will let me too...thank you so much...please let me know.

    I asked for instruction from the court staff and they told me to bring a copy of the decision and the finality to LCR where I filed my case. So I went and they give me a certificate that says its recorded in their books. Next, I went to the LCR where my marriage is registered and give them another copy of the decision, finality and the certificate. They gave me an endorsement letter addressed to NSO and a copy of my marriage certificate with annotations that it has been annulled. I sent the letter through DHL and after 4 days I went directly to NSO bringing with me the receipt I paid at DHL and paid 2 copies of my annotated MC. There is a special area at NSO for people like us so the line is a bit shorter.

    Your brother with the help of good lawyer has to prove that his wife is not psychologically fit to be in a family but it doesnt necessarily mean its all about mental disorder.

    Let me quote the decision I got. Its a bit long but I hope it will be helpful for your brother and to other people reading this:

    Psychological Incapacity should refer to no less than a mental (not physical) incapacity that causes a party to be truly cognitive of the basic marital covenants that concomitantly must be assumed and discharged by the parties to the marriage which include their mutual obligations to live together, observe love, respect and fidelity and render help and support. More importantly, psychological incapacity must be characterized by a)gravity b)juridical antecedence and c)incurability. Thus it goes without saying that psychological incapacity is confined to the most serious cases of personality disorder which must be duly proven with concrete evidence of said disorder and not by mere narration of character differences nor a tale of disheartening stories which could be passed upon as another material for a soap opera.

    In this case, it is shown that the "personality disorder" of the defendant rests on his being a habitual drunkard, gambler and on his being an infidel on top of his refusal to give support to his child. It was elucidated that these demeanors render him to comply with his obligations as a husband as enshrined in the law. While habitual drunkenness, infidelity and excessive gambling are not per se indications that one is psychologically incapacitated, the Court notes from the totality of evidence presented by the plaintiff, that these demeanors displayed by the defendant are actually the very reasons why he could not perform his marital obligations. Despite, plea of the plaintiff for her husband to change and despite the fact that she had even left him, just for him to come to his senses, still the defendant did not change. Instead he continued on with his ways, unmindful of the fact that his family is already falling apart.

    It must be stressed that the law does not define with preciseness what psychological incapacity is and therefore the determination is left solely with the Court after studying carefully the facts of the case and the evidence presented by the parties.

    The ground to which the petition is anchored on must be taken in its proper context and should not be associated with insanity or a total mental inability to function in all aspects of human life. The ground is restricted to psychological incapacity "to comply with the essential marital obligation." The mental disposition of one or both spouses must be such as to prevent them in bringing about a healthy personal marital relationship within the family, which is necessary for its growth and development.

    The basic marital obligations to which the parties must fulfill are those enumerated in Article 68 of the Family Code, to wit:

    "The husband and wife are obliged to live together, observe mutual love, respect and fidelity, and mutual help and support."

    The establishment of conjugal living becomes an impossibility where the parties are incapacitated to live together and render mutual love and respect and fidelity as mentioned above.

    This court adheres to the view that marriage is not a fleeting relation but a lifetime commitment. The court would always want to abstain from becoming unwilling implement for rendering apart a family. However if it finds the psychological incapacity demonstrated by one of the parties of both as very grave so that the said party would not be able to carry out the ordinary duties required in marriage and the court finds out that this incapacity is rooted in the history of the concerned spouse antedating the marriage although the plaintiff only noticed the overt manifestation after the marriage and that the psychological incapacity is beyond cure, this court will not hesitate to annul the marriage. It is the view of the court in the instant petition that all the exacting requirements of the law prove that defendant-respondent is suffering from psychological incapacity. No one, not even the court could force the plaintiff and defendant to suffer a marriage that is in name only, which by law should be considered void from the beginning. Plaintiff must therefore be given relief from the bounds of his marital vows.

  9. Your annulment process is not officially complete. You risk receiving a RFE or worst a USCIS denial, if you don't submit the complete annulment package and NSO-issued annotated marriage certificate. Remember that the USCIS processes hundreds, if not thousands, of Filipina fiancees with annulment cases each year and they know what documents to look for. It is always wise to submit the complete package to avoid any problems later. Better to do it right the first time.

    You will need to bring your Certificate of Finality to the LCR where you filed your annulment for its registration. LCR-Bicol will then send the registration via registered snail mail to LCR-Cagayan Valley for the annotation of your marriage certificate. LCR-Cagayan will then endorse and send via registered snail mail to NSO. It takes take 4-8 weeks for this process, sometimes longer.

    If you could asked the LCR-Cagayan that you will use faster courier like DHL for the endorsement letter addressed to NSO it would be better. It will arrive after 1-2 days and you could go to NSO East Avenue directly to apply for your annotated MC. That's what I did. I was the one who sent it to DHL.     Reading this forum, i realize how nasty the annulment process in the Philippines..i think that is unfair for the people involve..i'm thinking about my brother who is planning to file annulment because his wife cheated on him while he work his butt off in Dubai..how long the process and how much is annulment in the Philippin?..just wanted to know!thanks!

    Usually P100k or more. Cheating alone, the court does not grant annulment to a spouse. It should be in the psychological incapacity category.

  10. wanna see how many peeps are for interview on FEBRUARY 2008??

    We got our hardcopy NOA2 approval Dec 6 and notice that our package was being sent to Manila within the week that follows. How will know when it gets there? Should I call? How long before I should expect Rona to recieve her package.

    I hired a Visa Service called APVISA which has pretty much abandon me and cannot get any answer from Alex there other than generic copy paste stuff from some document somewhere. No real life answers. I feel on my own and in the dark so please help us with this. James and Rona

    u have to have ur fiance call the NVC and get ur case number.

    then if u have the case number..

    Either call the us embassy via (02)301-2000 local 5184 & 5185 to check if the embassy has already documented ur papers..(coz, it doesnt matter if they already received it...they have to document it first b4 they can process it) OR check your case online at http://203.177.135.10/ivappointment/login.asp...

    Ok thanks so much for your reply. I found out that they have had it since the dec 14th. Also found out we have an appointment for interview on Feb 08 like many others of you at 6:30 am. The lady Grace also informed me we needed to pay a Document Research Fee of P650 that Rona would have to handle there in the Philippines and it involves texting codes there. here is the link for that http://usembassy.state.gov/manila/wwwfdelb.pdf Well we are handling that now.

    So guess my next questions are about her son -- we included him in the original paper work but nothing ever mentions him. How do I need to address him in this process? Does he too need a medical and what all else?? He is 7 years old. How do we setup for a medical appointment? Thanks everyone for your answers. I wasted alot of money on APVISA and they will not even return calls or emails.

    Rona and her son will have to do their medical and interview together. For their medical, they have to bring P6,090 for Rona, P4,914 for her son, passports, 3 pcs 2X2 pictures, appointment letter, black pen to fill out the forms and some food for her son because it takes time to wait for their turn especially if there are lots of people doing their medical same day as them.

    If they don't have their appointment letter, St. Lukes will accept the print-out schedule you will get online. Print 2 copies. My daughter and I are done with our medical even if our schedule is supposed to be on January 30, 2008. Check out Philippine Thread here in VJ and ask if you have more questions and for sure you will get a lot of answers. Goodluck.

    hello, after your medical you can't have your CFO if you dont have your passport with you. St. Lukes will take it together with your medical results and forward it to the embassy. You can only have it back once they have given you the visa.

  13. I have read most of his most of his blogposts before this topic was started. At first I was in awe with the guy(I even posted a blog about him) but when his next posts were all about his detailed expenses for his child's formula milk, hotel expenses, visa fees and such I was utterly dismayed. He was asking for donation on his website because he doesnt have a job and he needed money to get his family to the US. Its like why even have a family if you can't support them...and what's with the formula milk?Hello? Can't his wife breastfeed their baby? I know its none of my business but jeez, get a job man.

  14. hi raquel, we have the same interview date. went for my medicals on the 26th and got my results yesterday. i'm really thankful it went very well, although not as fast as i wanted it to be. ;) now waiting for the january 30 interview as well. hope to see you at the USEM grounds and goodluck to us.     its 10 pm here and we just got home from manila. we were there for 3 days and we got the results as well. i needed to have a 2nd xray cause they saw some abnormality in the first xray. i guess they just want to make sure that i am clean. i was worried what might that be. i dont smoke or drink at all. the second xray was okay and all went well after that.

    i hope to see you there too. just look for a woman with a 10-year old kid with long hair and that is us. i hope we don't get any delays with our visa. this waiting is killing me. happy new year too :)

  15. FYI - Feb interview dates

    I have friend who has their interview date Feb 4th. Medical was Dec 30 - She called and the told her she could do the medical anytime before the 30th as well. She went to St Lukes last week and did her medical early

    That saved them more time together getting ready to come back to the US rather than staying in manila a whole week for the interview. Just thought i would share this info if anybody would like to try the same. Call the USEM and set it up. so they can send the packet to St lukes.

    Anyone planning to do early Med exams? Funny, I already got the letter that my fiance will be receiving Packet IV, and this letter has the Medical exam date and Interview date but til now, she still haven't received it...

    No packet 4 yet but I am already done with our first day of medical. Second day is on the 26th.

    Is the embassy going to be okay with you doing it so early

    It says in the embassy website, medical is valid for 6 months. Some people at VJ had done it and they are now in the US with their spouses and children.

My 10-year old daughter and I went to St. Lukes last Dec. 20 bringing with me our passports, passport pictures with our names written at the back, 2 photocopies of printed schedule that I got online plus the original print-out, payment for me(P6,090.00) and my daughter(P4,914.00), a map that I got from US embassy website and a black pen. We arrived there at 7:30 am. The staff were friendly and they will give you directions on what to do next. They asked for my appointment letter and I told them that what I have was the schedule I printed online. They will accept it but they will write a note on my forms. I didn't mind just as long as they let us do our medical that day. The lady doctor who did our physical exam have this poker face and seems bored at what she was doing. She checked for scars on my wrists and she saw a tiny one. She asked what it was and I told her I got it from a cat who scratched my left arm long ago. She asked if I have history of TB or have been living with a person who has one, have taken marijuana, shabu or cocaine and all my answers were no. After 15 mins or so, we were glad to be out of her room. During our eye exam I found out that my daughter has 50/25 vision and she now needs glasses. I on the other hand has 20/25. They took my urine and blood sample and x-ray. They didn't do anything with my daughter except physical and eye exam. We presented our PDS forms at the check out counter and told us to come back on Dec. 26 for my daughter's Tuberculin Skin Test and our vaccination. They couldn't do it the next day because of the Christmas holidays. They needed like to 3 days to read the results. They gave us back our passports and official receipts with a note stapled saying we come back on 8 am Wednesday. We were out of the clinic by 10:30 am.

    I hope this is helpful for people who will be having their medical.

  18. now, make sure that your early medical is at least 4 weeks before your interview date to make sure that your results will still be valid for your interview. though i know some girls who took their medical exam more than 4 weeks before their interview and i guess it went okay.

    Not to be picky, but I think you meant "make sure that your early medical is at MOST 4 weeks before your interview date". If your medical exam is more than a month old, you will probably have to get another one.

    Medical results are valid for 6 months fyi.

    You don't need NOA2. What I brought was the schedule I printed online, payment, passport pictures and black pen. My St. Lukes schedule is January 30, 2008 but I went there last Dec. 20, 2007. My 10-year old daughter and I arrived there at 7:30 am and we were done at 10:30 am. We were told to come back on Dec. 26 because they dont do Tuberculin Skin Test for kids on Thursday because of the Christmas holidays. Vaccination for both of us will be done also on Dec. 26.

  20. What i do is ask specific subject on the part that i did not understand or other people's opinion about a certain topic. Give it an hour or so and I will get replies. That's how good people are in VJ. So don't hesitate to ask if something is bothering you. Goodluck :content:

    But I will be buying a roundtrip ticket with an open return flight, so when she get her Visa we can schedule our flights together.

    I'm completely new to air travel. Visiting Arlyn was only my second time flying.

    What exactly is an open return ticket and how do I get one? Does it cost considerably more? I'm assuming it is a ticket without a return date?

    The unfortunate thing is my time restrictions.

    I cannot leave until the 27th of December, and I "must" be home by January 11-15 range for work.

    Her interview is January 3.

    I want to be ther,e and I need to be home on time, and want us to fly together coming home ... does it look possible?

    Also, I checked out www.evaair.com, and their rates were 3 times the prices I got from NWA.

    Did you check out the Hot E-Fare section? My husband's tickets only cost $800 or less.
