Were you ever married to their mother?
yes,
the kids mother and myself were married at the time we have the kids, and after divorce we never been in court for legal custody,
but as she "the kids mother "was busy she ask me to take care of the kids,
so I send the kids to my mother, and they living with my mother for over 6 years now

Just between you two. Try and work something.
No requires document to avoid losing citizenship. They just come in and it's automatic. However, they have to be under 18 when they pass the point of entry check in. I'll suggest not to wait to have them come in last minute because things happen. Latest I'll suggest is a week before he turns 18.
will try and hope it works
thanks for being positive

2. A court that has jurisdiction needs to issue an order giving you full or joint custody. If the mother is cooperative this helps.
will try that, but it should be order for each one or for all the kids?

Just talk it out and assure wife it's round trip. Show her tickets. You can even sign a paper to hold your word true
I'll try to do that, but what is the required document to avoid losing the citizenship for them as under 18
and is it just between my an her or it should legal document from the court?

I believe that is wrong sorry. What makes you think you don’t need legal custody to transmit citizenship?
Then the younger one won’t be usa citizen either.
Both can apply to become citizens at age 23 if they are still LPRs.
don't be sorry thank you for correcting my wrong thought, so how we can fix that, is there any way to get the legal custody?

My opinion? Make a round trip on a weekend and take advantage of the automatic citizenship that he can get if he enters under 18 years and save $$ and USCIS headaches down the road. Trust me, if you have an opportunity like this to strike many USCIS birds with same stone, take it.
When he comes, he gets a stamp on PP that serves as a temporary GC for 1 year. He can leave and go back to take care of his studies. The benefits of this are as I explained above.
I like that
thanks
but what you think regarding the "legal custody" issue ?

Assuming you have physical and legal custody of him, he should enter the USA before he turns age 18 so that he is automatically a USA citizen. If he waits until after age 18, he can file N-400 in 2027.
File N-600 after he successfully gets a U.S. passport and U.S. passport card. You get just one chance at an N-600.
thanks
1. as he's over 17 no need to legal custody, that what I understand (correct me if I'm wrong please.)
2. but for his younger brother (he is 11 years old) I do not have a legal custody,
the kids mother and myself were married in the time we have the kids and after divorce never been in court,
the kids leaving with my mother for over 6 years
please adv..
the kids mother and myself) never been in court, but kids leaving with my mother Fatma for over 7 years -
Hi,
I'm US citizen, my son overseas just get his IR-2 visa approved in Mar 2022, he will turn he's 18 years in Jul 2nd 2022, however his final exam at the high school will completed by the end of Jul 2022
please advice
-should he enters to US before he turn the age of 18 years, or he can enter any time of the visa validation "within the 6 months from Mar 2022"?
-what is the case if enter after he turn 18 years ( to finish his high school ) is that will effect his green card and/or his citizenship?
-what is the case if enter before he turn 18 years ( as I'm confused between the N600 and the US passport)?
Thanks

What I meant was whether your application has been reassigned to the National Benefits Center after applying for the N400. It seems the bottleneck may be the processing of the I751 at the NBC
I'm so depressed, forget about me just be ready for your test and hope your interview be easy all the best

The 29th of June. Has your I-751 application been moved to NBC as well? I think the main issue is not the N400, but rather the processing of the I-751 at the NBC. Once my I-751 status changed to "ready to be scheduled for an interview", things moved rather quickly. Hope your cases will start moving soon as well - I have been through this wait as well and I know it is extenuating.
no move at all for (N400 & I751)
u right if I751 move will push N400

Breaking news - my I-751 was approved with no interview needed. No news about the N400 though - hopefully, it will be addressed at some point. At least, something happened!

now I can say you will schedule 4 interview N400 very soon
pls adv when your I751 transferred to NBC and they got there jurisdiction over ur I751 ?

Nothing about the N400 - I think either they approve the I-751 without interview, or I will have a combo interview
I hope that after the RFIE they will approve the I-751 without interview and you get the N400 interview very soon all the best

Not yet - I think that things will move quickly after responding to the RFIE. I am finishing to collect the documents I am planning to send right now: I hope to submit sometimes next week.
Regarding the writ of mandamus - I would wait for your application to be a few months outside of normal processing time. Right now, it seems to be right outside of normal processing time, and it may be rejected. I know it is frustrating, but hopefully things will move for you soon as well.
good question which field office sent you the RFIE SFO or NBC?

I'm about to file a mandamus against the USCIS by the end of May- any advice?

it's so unfair after waiting over 30 months you have to pay almost 5K to lawyer just to have them schedule an interview ..................

Anyone has some suggestion on which documentation to send? When I submitted the application, I sent the following:
- leases for the previous years with both me and my wife on it;
- joint tax returns for the few previous years - I sent the IRS official transcripts;
- health insurance documents
- driving licenses showing same address
We have separate bank accounts - we have a share one, but we don’t really use it. Also, my wife has not worked over the last 2 and a half years - she took a one year hiatus, then corona started and we decided together that she should not work as she would have had to be in contact with patients - she works in the medical field. Any advice on how to respond? Should I consult with a lawyer, or is it something that I can handle myself?
