    It is completely legal but intentions matter - hence non-disclosure.

    My wife is US citizen and we filed I-130 to bring her daughter(under 21) to US. We go case number and application is "being processed"
     
    I see information that it is possible to now file form I-129F to obtain K4 visa for the child. K4 visa maybe approved faster.
     
    Looking at instruction for form I-129F I do not see any guidelines for how to properly fill it out for this use case.
     
    Can someone provide more information about getting K4 visa in this case?

    My fiance in Philippines has child that will not be going with her to US, due to misguided advice we did not include the child in the initial I-129f petition.
    Our petition has been approved and made its way to NVC.
    We are looking for advice on what course of action to take. I know we should list the child on all DS forms for the embassy. I found that few countries embassy websites specifically point out that in case of child omission, petitioner needs to write a letter stating that he/she knows about existence of the child despite no mention of one in the initial petition. This letter should be presented if questions about child arise. We did not find similar statements on the Manilla Embassy page.
    We will contact the embassy next week, but any advice or shared experience, will be appreciated. As general guidance - child is less that 16 years old.
